Discussion: In November 2007, the City of Palm Desert was awarded federal CMAQ grant funds for the following eight projects in the total amount of$8,228,000: Proiect Amount Monterey/10 Interchange Ramp Modification $1,566,000 WB Fred Waring Free Right Turn Lane to NB Hwy 111 $ 686,000 Fred Waring/Monterey Turn Pockets $1,100,000 Traffic Signal Modification on Fred Waring at San Pascual $ 202,000 Mid Valley Bike Path $3,000,000 PM 10 Soil Stabilization at Two Sites $ 301,000 NB Highway 111 Sidewalk and Plaza Way Left Turn Improvements $ 620,000 City Traffic Signal Interconnect $ 753,000 On January 5, 2009, the City was notified of approval of the Federal Statewide Transportation Improvement Program (FSTIP) by the Federal Highway Administration of the Department of Transportation (see attached letter). With this approval, the City now can submit projects for implementation and approval by the State Department of Transportation (Caltrans Local Assistance). On September 29, 2008, CVAG Executive Committee approved deprogramming $800,000 of CMAQ Funds from the Mid-Valley Bike Path Project to fund the Sun Line street sweeping funding shortfall. Also, on December 11, 2008, City Council approved the shift of $1,100,000 of CMAQ Grant funds from the Fred Waring/Monterey Turn Staff Report Federal Approval of CMAQ Grant Project Funding January 22, 2009 Page 2 of 2 Pocket Project to the Mid-Valley Bike Path Project. This was recommended based upon the issue that the improvements are capacity-type improvements and are not eligible for CMAQ funding. A letter to CVAG requesting this shift in project funding was sent to CVAG (see attached letter). Both of these actions will require processing an amendment to the FSTIP. Environmental documentation to meet CEQA and NEPA requirements for review and approval by Caltrans is currently underway on six of the projects and should be completed by this spring. After design is completed, also underway on the six projects; staff will request approval to proceed to construction. A preliminary study is being performed on the Mid-Valley Bike Path project. Upon completion of the study, a request for proposal will be issued to hire a firm to complete environmental documentation and final design. Staff has submitted an application to Caltrans Local Assistance for approval to begin environmental documentation and final design of the WB Fred Waring Free Right Turn Lane to NB Hwy 111. This project is the only project that has CMAQ funding for design/environmental, right of way acquisition, and construction. ADMiN1STRATION ISSUES 13A Regional Clean Street Management Program -John Wohlmuth Mr. Wohlmuth reported that in a closed session on Ju{y 28'", the Executive Committee discussed the findings of a Caltrans audifi which identified a $5.1 million issue regarding the street sweeping contract with SunLine. Mr. Woh{muth also reported that after same discussion, the Executive Committee directed staf#to enter into a MOU wi#h Caftrans which repaid FHWA the�5.1 million. CVAG sent a letter to RCTC discussing deprogramming $2.8 million of CMAQ funds during this cyc(e to repay Caltrans. Mr. Wohimuth indicated that SunLine met regarding the issue as well. They also sent a letter ta RCTC asicing that SunLine and CVAG be allowed to resolve the issues without involvement by RCTC. Sunl.ine aiso requested a meeting be#ween two members from the Executive Committee,their Chair and Vice Chair. Mayor Roche and Mayor Benson represented CVAG's Executive Committee where options far repaym�ent were discussed. Mr.Wohlmuth discussed the various options briefiy and indicated that the option agreed upon was the deprogramming of the two lawest ranked projects, as we!! as approximately$800,004 flf the Palm Desert Bike Lane Project. The remaining $2.6 million would come out of fu#ure CMAQ funding. In November 20Q7, the City of Palm Desert was awarded CMAQ grant funds for eight prajects in the amount of $8,227,040. The grant included CMAQ funds for the Fred Waring-Monterey Turn Pocket project in the amount $1,100,000, and the Mid-Va(ley Bike Lana project in the amount of$3,00�,000. The tatal estimated project cost for the Turn Pocket project is approximafely $3,075,�OQ, and approximately$6,000,000 far the Bike Path project. Following the award of fhe CMAQ grant funds, a question arose whether the Turn Lane project is a capacity-enhancing improvement that would not be eligible under the CMAQ guidelines. Sta�f originally revised the CMAQ grant application to only include the signal work. However, the signal work is required to accommodate the construction af the turn pockets. Staff has discussed this issue with CVAG and RCTC staff, and concluded that the project would Iikely be rejected upon submitfa! for approval to Caltrans Local Assistance. On December 11, 2008, the F'alm Desert City Council approved the shift of $1,100,000 in CMAQ grant funds for the Fred Waring-Monterey Turn Pocket project to the Bike Path project, and authorized #he submittal of this request for approval to CVAG.
