SUBMITTED BY: Tony Bagato Principal Planner APPLICANT: City of Palm Desert 73-510 Fred Waring Drive Palm Desert, CA 92260 DATE: January 22, 2009 Recommendation: That the City Council, by minute motion, authorize the City Manager to review and approve a Temporary Use Permit as the property owner for Entrada del Paseo. Executive Summary: Approval of staff's recommendation will allow the City Manager to execute a Temporary Use Permit as the property owner for the Entrada del Paseo property. The proposed Temporary Use Permit will allow the operation of a weekly Certified Farmers Market for outdoor seasonal sales located in the parking lot of Entrada del Paseo. The proposed market will operate every Wednesday beginning February 11, 2009 and concluding in June, 2009. The setup time will begin at 8 am with the market opening at 10 am. The market will end at 2 pm with all vendors and cleanup done by 4 pm. Discussion: The Certified Farmers Market (CFM) is operated by the Palm Springs Cultural Center, a nonprofit organization. The mission of the Certified Farmers Market is to serve the community as a gathering place where local farmers and vendors can offer fresh agricultural and related products. Currently, CFM operates an open market in Palm Springs on Saturday mornings and in La Quinta on Sunday mornings. A certified farmers Staff Report Certified Farmers Market TUP January 22, 2009 Page 2 of 2 market promotes sustainability by using farmers with the local region, with over 80% of the vendors being certified farmers. Staff has met with the representatives for the CFM and believes that the proposed market will provide a community benefit that can operate at Entrada del Paseo with appropriate review and conditions of approval. The applicants are in the process of completing the Temporary Use Permit Application that will be reviewed by various city departments. Staff will work with the applicant make sure that all insurance documentation is provided, as well as proper care and maintenance of the market site. All Temporary Use Permit applications require approval by the property owner before staff can review and approve them. Since the property is owned by the City of Palm Desert, staff is requesting that the City Council authorize the City Manager to review and execute the Temporary Use Permit as the property owner representative.
