Box 113 Palm Desert, CA 92261 DATE: July 9, 2009 CONTENTS: Subject Grant of Easement Prior 2006 Grant of Easement Aerial Map Vicinity Map RECOMMENDATION: By Minute Motion, authorize the Mayor to execute a Grant of Easement for legal access purposes over the Homme/Adams Park parcel from South Cliff Road to APN 628-120-013 (47400 South Cliff Road). DISCUSSION: Council approved a similar request at their meeting of May 25, 2006, when Resolution No. 06-70 was also adopted approving Tract Map No. 31135 for applicant Dori Cree. The prior easement, which recorded June 14, 2006, with the County, provides legal access along the physical location of South Cliff Road over the Homme/Adams Park parcel between Calle de Los Campesinos and the east property line of APN 628-120- 013. This prior easement provides legal access to TR 31135 as well as to other property owners off of South Cliff Road. The subject easement has been requested by the applicant to formalize access to the existing house at 47400 South Cliff Road. The easement follows the existing physical road location from South Cliff Road to the east line of APN 628-120-013. Staff Report Declare as Excess Property 1,711 Sq. Ft. and Authorize the Mayor to Execute a Grant Deed Page 2 of 2 July 9, 2009 Fiscal Impact: There is no fiscal impact associated with executing this easement. Staff recommends that Council Authorize the Mayor to execute a grant of easement for legal access purposes over the Homme/Adams Park parcel from South Cliff Road to APN 628-120-013 (47400 South Cliff Road).
