Executive Summary: Sustainability has been identified as one of the goals by the Palm Desert City Council. While the term sustainability may mean different things to different people, the Brundtland report's definition is widely accepted as it is applied to development. "Sustainable development is development that meets the needs of the present without compromising the ability of future generations fo meet their own needs." As the topic of sustainability is discussed and studied, one quickly learns that sustainability is not just about the environment, but about communities and the economy as well. At the very least, the intent of this ordinance is to integrate multiple components of sustainability and bring them together under a single program (ordinance), providing a foundational structure upon which to build a viable future. The development and adoption of a "Green Building" ordinance at the local level is an effective way to implement changes in the construction process when done in a manner that includes participation by a variety of stakeholders and utilizes a range of private sector resources. Background: On December 13, 2007, the Palm Desert City Council adopted Resolution No. 07-78 and directed staff to develop a mandatory Green Building Ordinance (GBO). This Resolution began a process of developing a greenhouse gas inventory. In conjunction, the City decided to produce its first "sustainability plan." On June 26, 2008 Council authorized the City Manager to execute a contract with EcoMotion will provide an overall policy guidance for Council and executive management, EcoMotion was tasked with developing the City's first sustainability plan and greenhouse gas (GHG) inventory. On March 18, 2009 EcoMotion kicked off a series of workshops that covered the following eight categories of a sustainability program. • The Built Environment • Greenhouse Gas Inventory • Water Management • Air Quality • Land Use • Transportation • Materials Management • Energy Management The groups were tasked to develop goals for each planning area and identify programs and initiatives to achieve those goals. The Built Environment group discussed developing a Green Building ordinance that incorporates green building strategies that can reduce impacts on the environment that result from reduced energy use, water conservation, site development that preserves bio-diversity and limits use of green fields, use of renewable and locally manufactured materials, and limiting the use of chemicals in construction materials and processes. G:�BIdgSfty\Suzanne Cicchini\Word FileslStaff Reports\Green Building Ordinance 062509\Staff Report Draft for Green Ordinance.docx Green Building Ordinance June 25, 2009 Page 3 Many of these strategies are not only related to the reduction of greenhouse gases (directly, or indirectly), but they lend themselves to reducing the destruction of the many diverse eco-systems that clean our air and water, absorb carbon dioxide, and provide habitat for wildlife. A green building is a healthy building that will endure the test of time, provides homeowners with satisfaction of their project long after it's been completed, and has minimal impact on the environment and community not only when it is originally constructed, but throughout the life of the building. All new building types would be covered under the green building ordinance. This includes City owned buildings, commercial buildings, multi-family construction, single- family homes, and mixed use. The Built Environment group overwhelming agreed to recommend adopting the 2008 California Green Building Standards Code (CGSC), Title 24, Part 11, as approved and copyrighted by the California Building Standards Commission with the condition that the voluntary requirements of the code become mandatory requirements. Green buildings can include the use of certified sustainable wood products and high-recycled-content products. Recycling of waste that occurs during demolition, deconstruction, and construction reduces the amount of waste deposited in landfills. The proper orientation and passive solar design of a building reduces demands on its heating and cooling systems. The use of advanced-design heating, ventilating, and air conditioning systems provide increased energy efficiency and improved indoor air quality. Enhancement of indoor air quality is also achieved by the selection and use of construction materials that do not emit chemicals which are toxic or irritating to building occupants. The use of water conserving methods and equipment reduce the per capita demand on resources and infrastructure. The installation of alternative and renewable energy systems can supplement conventional methods of energy production; and WHEREAS, in recent years, green building design, construction and operational techniques have become increasingly widespread. Many homeowners, businesses, and building professionals have voluntarily sought to incorporate green building techniques into their projects. A number of local and national systems have been developed to serve as guides to green building practices; and WHEREAS, Chapter 15.11, "Green Building," is intended to raise the level of construction in the City of Palm Desert in order to encourage water and resource conservation, reduce waste generated by construction projects, increase energy efficiency in buildings, provide durable buildings that are efficient and economical to own and operate and promote the health and productivity of residents, workers, and visitors to the City; and WHEREAS, nothing in this ordinance is intended to duplicate, contradict, or enter a field which has been fully occupied by state law, including the California Building Standards Code. NOW, THEREFORE, the City Council of the City of Palm Desert does ordain as follows: Ordinance No. 1189 SECTION 1. Findings. The City Council finds that: A. A duly noticed public hearing regarding the proposed amendment to the Municipal Code was held by the City Council on June 25, 2009. B. The proposed Chapter 15.11, "Green Building," preserves and enhances the environment, in that it would set forth minimum green building measures within the City of Palm Desert and shall apply to the planning, design, operation, construction, alteration, movement, enlargement, replacement, repair, equipment, use and occupancy, location, maintenance, removal and demolition of every building or structure or any appurtenances connected or attached to such buildings or structures. C. In accordance with CEQA Section 15061(b) (3), "CEQA" applies only to projects that have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA." Staff has determined that the proposed ordinance is exempt from CEQA review. D. Because the design, construction, and maintenance of buildings and structures within the city can have a significant impact on the city's environmental sustainability, resource usage, energy efficiency, waste management, and the health and productivity of residents, workers, and visitors over the life of the building. Encouraging commercial and residential projects to incorporate green building measures is necessary to achieve the public health and welfare benefits of green building. SECTION 2. Chapter 15.11, "Green Building," is hereby added to Title 15, "BUILDINGS AND CONSTRUCTION," of the Palm Desert Municipal Code to read and provide as follows: Chapter 15.11 GREEN BUILDING Sections: 15.06.010 Adoption. 15.06.020 Purposes. 15.06.030 Amendments 15.06.040 Validity. 15.06.050 Penalties and Enforcement Ordinance No. 1189 15.06.010 Adoption. That certain document in book form entitled "California Green Building Standards Code, Title 24, Part 11, 2008 Edition," as approved and copyrighted by the "California Building Standards Commission, 2525 Natomas Park Drive, Suite 130, Sacramento, California, 95833," prescribing regulations governing installation, construction, maintenance, alteration, repair and inspection, one copy of which document is now on file in the office of the City Clerk of the City of Palm Desert, except as portions thereof are herein specifically amended, deleted and added to, is hereby adopted by reference as "The California Green Building Standards Code" of the City of Palm Desert," and from the date on which the ordinance codified in this chapter shall take effect, the provisions thereof shall be controlling within the corporate limits of the City of Palm Desert. 15.06.020 Purposes. The purpose of this code is to improve public health, safety and general welfare by enhancing the design and construction of buildings through the use of building concepts having a positive environmental impact and encouraging sustainable construction practices in the following categories: 1. Planning and design. 2. Energy efficiency. 3. Water efficiency and conservation. 4. Material conservation and resource efficiency. 5. Environmental air quality. 15.06.030 Amendments. A. The city council of the city of Palm Desert hereby declares that should any section, subsection, sentence, clause or phrase of this chapter or the code hereby adopted is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of the ordinance codified in this chapter. The City Council of the city of Palm Desert hereby declares that is would have passed the ordinance codified in this chapter, and each section, subsection, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutionaL 15.06.050 Penalties and Enforcement a) Each violation of the provisions of this chapter shall constitute a misdemeanor, and shall be punishable by imprisonment in the county jail for up to six (6) months, or by a fine of up to one thousand dollars ($1,000), or both. Each day that a violation continues shall be deemed a new and separate offense. b) The Building Official shall have the authority to enforce this chapter as specified in section Chapter 1.12 of the Palm Desert Municipal Code, including but not limited to the authority to order that work be stopped where any work is being done contrary to the provisions of this chapter. SECTION 3. If any portion of this ordinance is for any reason held by any court to be invalid or unconstitutional, that portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereof nor other applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable.
