HomeMy WebLinkAboutWVR - Fashion Week El Paseo 2009Xu CITY OF PALM DESERT COMMUNITY SERVICES DEPARTMENT STAFF REPORT REQUEST: WAIVER OF MUNICIPAL PROVISIONS IN CONJUNCTION WITH THE 2009 FASHION WEEK SUBMITTED BY: Pat Scully, CFEE, Senior Management Analyst DATE: March 12, 2009 CONTENTS: Letter of Request from Palm Springs Life Recommendation: By Minute Motion, permit the sale, possession and consumption of alcoholic beverages on City owned property and waive the 9 p.m. regulation for amplified sound in conjunction with a special event, Fashion Week, scheduled to be held March 23-30, 2009. Background: Each year Palm Springs Life hosts Fashion Week, which is scheduled to be held in 2009 from March 23-30. This event consists of indoor activities, fashion shows, hosted receptions, etc. In conjunction with the production of this event, a tent will be constructed on the City owned property located on Larkspur Avenue between El Paseo and Shadow Mountain Drive. Pursuant to Palm Desert Municipal Code 9.58.040 the City Council must grant permission to allow alcoholic beverages on City owned property. Palm Springs Life is the applicant for the possession and consumption of spirits at its annual fashion week event. The possession and consumption of spirits will be limited to a tented area specifically designated as such. From Monday, March 23 to Monday, March 30, specific events will be held in a tent located on City owned property, which will include amplified sound. Each of these events will conclude no later than 10 p.m., and the sound will be limited to inside the tented area. Since City ordinance requires that amplified sound cease by 9 p.m. a waiver of this provision is requested. The City Council will grant, if passed, the possession and consumption of spirits contingent on the approval of the Palm Desert Police Department and a one -day permit issued by the Alcohol Beverage Control Board. City staff will work with event organizers on the location Staff Report — 2009 Fashion Week March 12, 2009 Page 2 of 2 and hours of operation for the possession and consumption of spirits. Event organizers have been most cooperative in complying with all aspects of the Municipal Code as it affects this event and have requested these waivers to ensure the successful production and promotion of the event. Therefore, staff recommends that the City Council provide a waiver to the Municipal Code as required for the sale, possession and consumption of spirits and waive the 9 p.m. for curfew for amplified sound for the dates requested.
