Recommendation:
Waive further reading and adopt Resolution No. 09-i5 vacating a portion of
Guadalupe Avenue at Monterey Avenue and, by Minute Motion, authorize the
Mayor to execute an easement agreement, all to accommodate Precise Plan No.
07-07, Delio Office Building, 44-450 Monterey Avenue.
Discussion:
Planning Commission approved case No. P.P. 07-07, known as the Delio Office Building,
located at 44-450 Monterey Avenue at the meeting of December 4, 2007, as Resolution No.
2459. The project consists of the construction of a professional office building and parking lot
on the east side of Monterey Avenue at Guadalupe Avenue. The vacation is requested to
accommodate the design of the approved precise plan. The project requires a portion of
Guadalupe Avenue to be vacated, as depicted in the attached Exhibit "B." As approved under
the aforementioned Resolution for the precise plan approval, the developer will relocate the cul-
de-sac at the west end of Guadalupe to the east, similar to that done on Catalina Way behind
the office buildings constructed by Michael Homme, which are located immediately north of this
proposed office building.
Staff has no objection to the vacation as it has been determined that the subject right-of-way,
described as a portion of Guadalupe Avenue, is unnecessary for present or prospective public

purposes. The existing public utility easement within the proposed street vacation area will be
retained until two utility companies' (Coachella Valley Water District and Southern California
Gas Company) existing facilities are abandoned and removed, and new facilities are in place
and approved by each utility company. The public utility easement shall be deemed vacated
after the last utility company's final approval of their prior facilities removal and their relocated
facilities.
Government Code Section 65402 requires, in part, that the Planning Commission report to City
Council that the subject vacation is consistent with the adopted General Plan. At their meeting
of July 1, 2008, the Planning Commission, by minute motion, determined that the subject
vacation is consistent with the General Plan. At the City Council meeting of February 12, 2009,
Council adopted Resolution 09-10 setting a public hearing for the meeting of March 12, 2009, to
consider the subject street vacation.
In 1982, the City acquired the first north-south row of lots along the east side of Monterey
Avenue, as shown on the attached record map (Palma Village Unit No. 12), to accommodate
the realignment of Monterey Avenue. There are gaps over two of the City-owned lots (Lots 312
and 313) having variable widths between the easterly right-of-way line of Monterey Avenue (55
feet half width) and the west property line of the project property owner (shaded area of
attached Exhibit "B" to the Easement Agreement). Previous City Manager Carlos Ortega
requested that the City grant an easement for landscaping, sidewalk, driveway, and
encroachment of a small portion of the proposed building structure over the gaps instead of
conveying fee title to the adjoining owner (Delio). An Easement Agreement was drafted by the
City Attorney's office and has been executed by the adjoining owner. Staff, however, wants to
eliminate the potential encroachment of the proposed building and require the applicanUowner
to have the lot line(s) adjusted to follow the proposed building footprint by the parcel map waiver
process through the City. The Easement Agreement will need to be modified to reflect this
change, and the applicant/owner will need to have a Parcel Map Waiver processed through the
City to avoid the future building encroachment onto the City's lots.
Therefore, staff recommends that City Council waive further reading and adopt Resolution No.
09- vacating a portion of Guadalupe Avenue at Monterey Avenue and, by Minute Motion,
authorize the Mayor to execute a modified Easement Agreement, all to accommodate Precise
Plan No. 07-07, Delio Office Building, 44-450 Monterey Avenue.

RESOLUTION NO. 09-15
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, VACATING A PORTION OF GUADALUPE
AVENUE AT MONTEREY AVENUE TO ACCOMMODATE PRECISE
PLAN NO. 07-07 (DELIO OFFICE BUILDING, 44-450 MONTEREY
AVENUE) UNDER PROVISIONS OF DIVISION 9, PART 3, OF THE
STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA.
WHEREAS, the City Council initiated proceedings to vacate the public
rights-of-way, more particularly described in Exhibits "A" and "B", attached hereto, and
the City Council finds that said notices of such vacation were published and posted, as
require by law; and
WHEREAS, the City Council on the 12t" day of March 2009 held a public hearing
as required by law, at which hearing all persons interested in or objecting to the
proposed vacation were heard, and said public hearing was duly and regularly closed;
and
WHEREAS, the City Council of the City of Palm Desert considered such matter
and finds from the evidence submitted that the right-of-way described as a portion of
Guadalupe Avenue, more particularly described in Exhibits "A" and "B", attached hereto
and made a part of, is unnecessary for present or prospective public purposes.
NOW, THEREFORE, the City Council of the City of Palm Desert, California,
DOES HEREBY RESOLVE AS FOLLOWS:
1. That the right-of-way, known as a portion of Guadalupe Avenue, be vacated as
described and as set forth in Exhibits "A" and "B" attached hereto subject to and
retaining all public utility easements and other easements of record existing
within said public rights-of-way until such time as any existing utility facilities are
relocated within new or other existing easements for the same and the
abandoned facilities within the vacated area have been removed, all to the
approval of any affected utility company. The public utility easement within the
limits of the street vacation area shall be deemed vacated at the last final
approval of the last utility company to abandon and relocate their facilities
(Coachella Valley Water District and Southern California Gas Company).
2. That the City Clerk of Palm Desert, California, shall cause a certified copy of this
resolution and order to be recorded in the Office of the County Recorder of
Riverside County, California.
PASSED, APPROVED, and ADOPTED at the regular meeting of the Palm Desert City
Council held on this 12th day of March 2009.

EASEMENT AGREEMENT
This Easement Agreement entered into this Z 2-day of ��c�.. D�j
2008 by and between the City of Palm Desert, a municipal corporation (city) and Paul G. „
Delio and Karina Delio, as Trustees of the Paul G. Delio and Karina Delio Living Trust
. ,
(Owner) of parcels commonly known as Delio Commercial Development.
WHEREAS, The City is the owner of public right-of-way located adjacent to
owner's property which is utilizing a portion of the right-of-way for landscaping and
construction of sidewalks on the east side of Monterey Avenue located in the City of Yalm
Desert, State of California.
WHEREAS, Owner is the legal owner of property described and set forth in Exhibit
C attached hereto and made a part hereo£ A portion of the City-owned property is on the
owner's side of the sidewalk, and the City is desirous of allowing owner to utilize that
portion of the City-owned property located adjacent to owner's property as long as owner
shall construct planting, landscaping, and other items including a driveway adjacent to the
Owner's building. Said City portion is described as Parcel A and Parcel B as described in
Exhibit A and depicted in Exhibit B attached hereto and made a part hereo£
NOW THEREFORE, it is agreed as follows:
For and in consideration of these recitals as well as the terms set forth herein, the
City hereby grants to Owner, the non-exclusive right to enter on and use that portion of the
City's right-of-way located on the owner's side of the sidewalk on the east side of Monterey
in order to construct landscaping and planter bed and potential encroachment of a structure

on a small part of the same as reflected in Exhibit `B-1" attached hereto and made a part
hereof.
2. Term. This easement shall be in effect from and after the date hereof and shall
terminate at such future date as it is determined by the City that there exists a need for the
property covered by this easement for public purposes. Notification of such need shall be
given at least six months in advance of the utilization. Normally such notification will only
be given in the event owner fails to comply with all conditions of use of said property.
3. Conditions of Use. Easement holder is authorized to use the property subject to
the easement utilizing the same for landscaping and yard and open space area with minimal
encroachment by construction thereon other than landscaping and other amenities dealing
with landscaping that are acceptable to the city. The location and design of any and all
improvements shall be submitted to the City for their review and approval prior to
construction. Such approval will not be unreasonably withheld and is in addition to any and
all other approvals required for construction on said property.
4. Maintenance and Repair. Said property shall be maintained at owner's sole
expense in accordance with the standards of the City of Palm Desert for landscaped areas.
Owner agrees that it will not permit or allow public or private nuisance to exist on their
property and on the easement property and shall surrender same if notice is given pursuant
to paragraph 2 hereof.
5. Indemnity. The Owner agrees to hold the City free and harmless from any and all
claims, demands, suits or any kind of expenses including the payment of all expenses of
investigation of any such action including reasonable attorney's fees and costs and actions of

any type arising out of or incurring as a result of the use of said property by the owner, their
successors, assigns, agents, employees, guests and invitees.

RESOLUTION NO. 09-10
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, INITIATING PROCEEDINGS TO VACATE A
PORTION OF GUADALUPE AVENUE AT MONTEREY AVENUE
UNDER PROVISIONS OF DIVISION 9, PART 3, CHAPTER 4 OF THE
STREETS � HIGHWAYS CODE OF THE STATE OF CALIFORNIA, AND
FIXING A TIME AND PLACE FOR HEARING ALL PERSONS
INTERESTED IN OR OBJECTING TO THE PROPOSED VACATION.
The City Council of the City of Palm Desert, California, does hereby
DETERMINE, ORDER and RESOLVE as follows:
I.
That it intends to, and by this resolution does, initiate proceedings under the
provisions of Division 9, Part 3, Chapter 4 of the Streets and Highways Code, to vacate
a portion of Guadalupe Avenue at Monterey Avenue as described in Exhibit A and
depicted in Exhibit B; and
II.
That the hour of 4:00 p.m. on the 12th day of March 2009 in the Council
Chamber, 73-510 Fred Waring Drive, Palm Desert, California, is hereby fixed as the
time and place of hearing all persons interested in or objecting to the proposed vacation
of said public street; and
III.
That the City Clerk is hereby directed to publish a notice of said hearing in The
Desert Sun, a newspaper of general circulation, circulated in the City of Palm Desert,
California, twice, the first date of publication being two (2) weeks before the date of the
hearing, and the City officials of the City of Palm Desert are hereby instructed to post
notice of such vacation, as required by law, at least two (2) weeks before the day set for
the hearing.
PASSED, APPROVED, and ADOPTED at the regular meeting of the Palm
Desert City Council held on this 12th day of February 2009.
