Adopt the Categorical Exemption for the City Signal Interconnect, Fred Waring at San Pascual Signal Modification, Fred Waring/Monterey Turn Pockets, Highway 111 Improvements, and the PM 10 Soil Stabilization projects; and , 2. Authorize the Director of Public Works to execute and file the Notice of Exemption with the County Clerk. Background: On January 5, 2009, the City of Palm Desert was notified of the approval of the Federal Statewide Transportation Improvement Program (FSTIP) that included the eight Congestion Mitigation and Air Quality (CMAQ) grant funded projects. With this approval, the City could now proceed with the development of the projects and submit for approval by the State Department of Transportation (Caltrans) Local Assistance. Previously, on October 20, 2008, City Council awarded a contract with LSA Associates, Inc., to complete the environmental documentation for five of the less complicated projects. The projects need to be environmentally cleared in order to meet state and federal requirements prior to completion of design and starting construction. The projects listed below were grouped together to take advantage of work and cost efficiencies: 1. City Signal Interconnect 2. Fred Waring at San Pascual Signal Modification 3. Fred Waring/Monterey Avenue Turn Pockets 4. Highway 111 Improvements 5. PM 10 Soil Stabilization The City Signal Interconnect project will connect conduit and fiber optic cable to complete the traffic signal communication system in the core of the city. The signal at Fred Waring Drive and San Pascual will be upgraded to a six phase, fully-actuated traffic signal that will provide protected left turn movement and full access to Fred Waring Drive for the San Pascual traffic. The Fred Waring Drive/Monterey Avenue project will provide turn pockets at various locations. The PM10 Soil Stabilization project will include two properties owned by the City and the application will consist of a polymer stabilizer to control dust during high winds. The three remaining CMAQ funded projects will be done separately under a design consultant contract. These projects are: the Monterey/I-10 Ramp Modification; the Mid-Valley Bike Path; and the Westbound Fred Waring to Northbound Highway 111 Free Right Turn Pocket. On December 11, 2008, City Council approved of the shift of$1,100,000 of CMAQ grant funds from the Fred Waring/Monterey Turn Pocket project to the Mid-Valley Bike Path project. This was recommended based upon the issue that the Turn Pocket project includes capacity-type improvements, which are not eligible for CMAQ funding. An amendment to the FSTIP is currently being processed for this change in CMAQ project funding. Discussion: LSA Associates, Inc., has completed the environmental documentation to meet California Environmental Quality Act (CEQA) and National Environmental Quality Act (NEPA) requirements. The CEQA and NEPA documentation will be submitted to Caltrans Local Assistance for review and approval. The five projects have no impact on the environment and, therefore, meet the criteria for a Categorical Exemption. Attached are the CEQA Notice of Exemption Forms, and the Project Location Maps for the five projects to be filed with the County Clerk. Except for the Fred Waring/Monterey Turn Pocket project, the CEQA and NEPA documentation will then be submitted to Caltrans. Staff requests that City Council adopt the Categorical Exemption for the aforementioned five projects, and authorize the Director of Public Works to execute and file the Notice of Exemption with the County Clerk. During construction any yellow traffic striping and pavement-marking material should be tested and removed in accordance with the State of California Department of Transportation Special Standard Procedure XE 15-300. If human remains are encountered,State Health and Safety Code Section 7050.5 states that no further disturbance shall occur until the County Coroner has made a determination of origin and disposition pursuant to Public Resources Code Section 5097.98. The County Coroner must be notified of the find immediately. If the remains are determined to be prehistoric, the Coroner will notify the Native American Heritage Commission (NAHC), which will determine and notify a Most Likely Descendant (MLD). JTB�1589.1 CITY�2006 Findings: Cultural Resources:A records search conducted at the Eastern Information Center at the University of California at Riverside revealed no previously reported cultural resources in the project, or adjacent to the project in any location with the potential for adverse affect. All cultural resources previously recorded are standing structures. No cultural deposition was identified within the site during a site visit. It has been determined that the project has an extremely low potential to contain a"unique archaeological resource" or"historical resource" under CEQA. As a result,the project does not meet any of the four significance criteria for inclusion on the California Register of Historical Resources. Natural Environment: Of the 30 special interest species identified in the literature search, 15 have potential to be present on the proposed project site.Of these 15 species,two are federally/State listed(Coachella Valley milkvetch[Astragalus lentiginosus var. coachellae])and Coachella Valley fringe-toed lizard(Uma inornata), and one is a federal candidate for listing,the Palm Springs round-tailed ground squirrel(Spermophilus tereticaudus chlorus). The proposed project lies within the boundaries of the Coachella Valley Multipie Species Habitat Conservation Plan(CVMSHCP).It does not lie within a conservation area.Any project-related effects to the Coachella Valley milkvetch,Coachella Valley fringe-toed lizard,or the Palm Springs round-tailed ground squirrel are covered through compliance with the CVMSHCP.The project will comply with the CVMSHCP through payment of fees and satisfy any other relevant provisions of the CVMSHCP.No CVMSHCP species specific focused surveys are required by the plan within the PM10 Soil Stabilization project limits.In addition no other special interest species surveys are required.
