Recommendation:
By Minute Motion, approve Amendment No. 1 to Contract No. C26550 in
the amount of$14,317 for Landscape Maintenance Area No. 6.
Funds are available in General Fund Account No. 110-4614-453-3370,
Repair/Maintenance Medians.
Discussion:
On May 22, 2007, the City Clerk advertised and called for proposals for professional
horticultural services for the City's Landscape Maintenance Area No. 6. The contract
was awarded to Hort Tech, Inc., for an 11-month term in the amount of $149,600.
On June 12, 2008, the City Council approved the extension of the contract for a period
of one year in the amount of $157,796. This amount included Amendment No. 1, which
City Council approved on February 28, 2008, for the maintenance of two additional
frontage areas in the amount of$300 a month, and a 3% cost of living increase.
The contract extension amount submitted for Council approval was calculated based on
the amount of the original contract (11 months), plus a cost of living adjustment. The
new contract amount should have been calculated based on a 12-month term.
Consequently, the existing purchase order is underfunded by one month.

Therefore, staff recommends that, by Minute Motion, City Council approve Amendment
No. 1 to Contract No. C26550 for Landscape Maintenance Area No. 6 by adding
$14,317 for the missing month, bringing the contract to a grand total of $172,113.
Fiscal Impact: Funds are available in Repair/Maintenance Median Account No. 110-
4614-453-3370.

The amount of the Contract will be increased by the Sum of: Fourteen Thousand Three Hundred Seventeen
Dollars ($14,317.00).

This Contract Amendment covers changes to the subject contract as described herein. The Contractor shall construct,
furnish equipment and materials, and perform all work as necessary or required to complete the Change Amendment
items for a lump sum price agreed upon between the Contractor and the City of Palm Desert, otherwise referred to as
Owner.

The undersigned Contractor approves the foregoing Contract Amendment# 1 as to the changes, if any, in the contract
price specified for each item including any and all supervision costs and other miscellaneous costs relating to the
change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said
Contract Amendment # 1 . The Contractor agrees to furnish all labor and materials and perForm all other necessary
work, inclusive of that directly or indirectly related to the approved time extension, required to complete the Change
Amendment items. This document will become a supplement of the contract and all provisions will apply hereto. It is
understood that the Change Amendment shall be effective when approved by the Owner.
Execution of this Contract Amendment by the Contractor constitutes a binding accord and satisfaction that fully
satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity,
arising out of or related to the subject of the Contract Amendment, whether known or unknown, including but not
limited to direct and indirect costs and/or damages for delay, disruption, acceleration, loss of productivity, and stacking
of trades, as well as any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.
