REQUEST: CONSIDERATION OF LEGISLATIVE REVIEW COMMITTEE ACTION
ON AB 1042 (CARTER) AT ITS MEETING OF APRIL 28, 2009.

By Minute Motion, concur with the action taken by the Legislative Review Committee at its
meeting of April 28, 2009, and direct staff to prepare a letter of support for the Mayor's signature
with regard to AB 1042 (Carter) relative to local ordinances.
BACKGROUND:
Existing law authorizes cities to make and enforce, within their limits, all local police, sanitary,
and other ordinances not in conflict with general laws. If passed, AB 1042 would declare the
intent of the legislature to enact legislation that would require school districts to comply with City
and County ordinances relating to drainage, road improvements, and other specified conditions
when constructing new school facilities. Situations have occurred in the construction, rehab,
renovation, etc., of properties under the jurisdiction of school districts that have had significant
impact on local issues including traffic, landscaping, ingress, egress, etc. Current law does not
require school districts to consult with the municipalities in which they are located and specific
projects have had a negative impact as described above.
Therefore, Legislative Review Committee recommends that the City Council support AB 1042
and direct staff to prepare a letter stating that position to appropriate legislators and committees
for the, 1ayor's signature.

LEGISLATIVE COUNSEL'S DIGEST
AB 1042, as introduced, Carter. Local ordinances.
Existing law authorizes cities and counties to make and enforce
within their limits all local police, sanitary, and other ordinances
not in conflict with general laws.
This bill would declare the intent of the Legislature to enact
legislation that would require school districts to comply with city
and county ordinances relating to drainage and road improvements and
conditions when constructing new school facilities.
Vote: majority. Appropriation: no. Fiscal committee: no.
State -mandated local program: no.
THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. It is the intent of the Legislature to enact
legislation that would require school districts to comply with city
and county ordinances relating to drainage and road improvements and
conditions when constructing new school facilities.
