ON SB 683 (R. CALDERON) AT ITS MEETING OF APRIL 28, 2009.

RECOMMENDATION:
By Minute Motion, concur with the action taken by the Legislative Review Committee at its
meeting of April 28, 2009, and direct staff to prepare a letter of opposition for the Mayor's
signature with regard to SB 683 (R. Calderon) relative to Workers' Compensation.
BACKGROUND:
Existing law establishes a worker compensation system to compensate employees for injuries
sustained in the course of employment and requires the Administrative Director to conduct
audits to ensure that injured workers are properly and accurately receiving the full measure of
compensation they are entitled to receive. If passed, SB 683 would require a group of self -
insurers to annually file with the Director, an annual audit by an independent Certified Public
Accountant of the financial accounts and records of the groups self -insurer. Appropriate safe
guards are currently in place to provide checks and balances as well as accountability for
workers' compensation carriers and claims.
Therefore, Legislative Review Committee recommends that the City Council oppose SB 683 and
direct staff to prepare a letter stating that position to appropriate legislators and committees for
the Mayor's signature.

An act to add Section 3702.11 to the Labor Code, relating to workers' compensation.
LEGISLATIVE COUNSEL'S DIGEST
SB 683, as introduced, Calderon. Workers' compensation: group self -insurers: audits.
Existing law establishes a workers' compensation system, administered by the Administrative Director of
the Division of Workers' Compensation, to compensate an employee for injuries sustained in the course of
his or her employment.
Existing law requires the administrative director to conduct audits of insurers, self -insured employers,
and 3rd-party administrators to ensure that injured workers are promptly and accurately receiving the full
measure of compensation they are entitled to receive.
This bill would require a group self -insurer to annually file with the director an annual audit by an
independent, certified public accountant of the financial accounts and records of the group self -insurer. The
bill would prohibit audited financial or claim information of individual members of the group self -insurer
from being made public.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 3702.11 is added to the Labor Code, to read:
3702.11. A group self -insurer shall annually file with the director an annual audit by an independent,
certified public accountant of the financial accounts and records of the group self -insurer. No audited
financial or claim information of individual members of the group self -insurer shall be made public.
