Recommendation:
By Minute Motion, authorize the Mayor to execute a Grant Deed to
reconvey title to the land encompassed by a portion of the well site located
at Fred Waring Drive and San Pascual Avenue back to Coachella Valley
Water District (CVWD).
Discussion:
In April 2000, CVWD acquired Lots 18 and 19 of Palma Village Unit No. 10 (see
attached map of Palma Village Unit No. 10), which are located at the west end of the
Fred Waring Drive strip park. CVWD intended to grant to the City of Palm Desert Lots
18 and 19 except for the portions thereof to be used for the well site that currently exists
over portions of Lots 18 and 19. However, the Grant Deed that was recorded on
April 12, 2002, as Document No. 2002-192282 to make this conveyance to the City had
the wrong legal description attached, and the City actually acquired title to a portion of
the well site property (currently APN 622-200-071). Therefore, the subject Grant Deed
grants the property on the easterly approximately one-half of the existing well site back
to CVWD. CVWD will be granting the correct portions of Lots 18 and 19 to the City of
Palm Desert (APNs 622-200-068 and 069) concurrently with the subject reconveyance.

Therefore, staff recommends that the City Council authorize the Mayor to
execute a Grant Deed to reconvey title to the land encompassed by a portion of
the well site located at Fred Waring Drive and San Pascual Avenue back to
CVW D.
