Wohlmuth, City Manager DATE: September 24, 2009 ATTACHMENT: Nomination Application Package for the MAC Recommendation By Minute Motion, that the City Council nominate for appointment a primary and alternate representatives to serve as the City of Palm Desert's representatives to the Santa Rosa and San Jacinto National Monument Advisory Committee (MAC). The terms of both positions will be from October 2009 through December 16, 2011. Executive Summary and Backqround On June 12, 2008, the City Council nominated Councilmember Jim Ferguson for appointment as the City of Palm Desert's primary representative for the Santa Rosa and San Jacinto National Monument Advisory Council. The City Council did not nominate an alternate for the appointment to MAC. The City Council nominates an appointment, as the Secretary of Interior makes the appointment with the Secretary of Agriculture's concurrence. Unfortunately, after Palm Desert's June 12, 2008, nomination, the Secretary of Interior did not appoint Councilmember Ferguson to the MAC. The cities within the Coachella Valley, adjacent to the Santa Rosa and San Jacinto National Monument have, or may have, representatives on the MAC. Currently, only Rancho Mirage, Palm Springs, and La Quinta have representatives appointed to MAC. The cities of Palm Desert, Cathedral City, Indian Wells and the County of Riverside currently do not have representatives appointed to the MAC. Some of these entities have nominated representatives but not appointed representatives, such as Palm Desert. To be eligible for appointment to MAC, an individual must be qualified through education, training, knowledge, or experience to give informed advice regarding an industry, discipline, or interest identified in Section 7 of the Santa Rosa and San Jacinto Mountains National Monument Act of 2000. The appointees must also have demonstrated experience or knowledge of the geographic area in which the National City of Palm Desert's Representative for MAC Page 2 of 2 September 24, 2009 Monument is located; have demonstrated a commitment to collaborate in seeking solutions to a wide spectrum of resource management issues; and have the ability to represent their designated industry, discipline or interest. The representatives hold a 3-year term staggered with the other appointments. If the City Council wishes to re-nominate Councilmember Ferguson as the City's representative, the nomination form must be resubmitted. The nomination form for the City's alternate representative must also be submitted. The City of Palm Desert's last primary representative was former Councilmember Buford Crites. The Committee operates in accordance with the Act; FACA; Final Rule on Federal Advisory Committee Management(Final RuIe), General Services Administration(66 FR 37728, July 19, 2001); and the Santa Rosa and San Jacinto Mountains National Monument Advisory Committee ChaRer(Charter), approved by the Secretary of ihe Interior on November 15, 2007 and the Acting Secretary of Agriculture on December 7, 2007, and filed on December 10, 2007. This document establishes rules and procedures deemed necessary and desirable by the Committee, as authorized by Section 7(e) of the Act. Provisions of the Act, FACA, Final Rule, and Charter applicable to operations of the Committee are not repeated in these Bylaws and Standard Operating Procedures. SECTION I: MEMBER REQUIREMENTS AND TERMS a. GENERAL REQUIREMENTS: To be eiigible for appointment to the Committee, a person must be qualified through education, training, knowledge, or experience to give informed advice regarding an industry,discipline, or interest identified in Section 7 of the Act; have demonstrated experience or knowledge of the geographical area in which the National Monument is located; have demonstrated a commitment to collaborate in seekin� solutions to a wide spectrum of resource management issues; and have the ability to represent their designated industry, discipline, or interest. b. STAGGERED TERI�IS: Primary and altemate Committee members will be appointed to serve 3-year terms on a staggered term basis, with 5 of the I S positions subject to appointment or reappointment of representatives each year. For this purpose, groupings of Committee positions are as follows: Group 1 City of Rancho Mirage City of Palm Desert Agua Caliente Band of Cahuilla Indians Pinyon Community Council Regional college or university expert in natural science and reseazch 1 Group 2 City of Cathedral City City of Indian Wells County of Riverside Winter Park Authority Coachella Valley tilountains Conservancy Group 3 City of Palm Springs City of La Quinta Local conservation organization Local developer or builder organization California Department of Fish and Game or California Department of Parks and Recreation c. CONCUR.RENCY OF TERMS: Terms of primary and alternate members representing the same industry, discipline, or interest sha(1 be concurrent. d. TERMINATION OF SERYICE: The Secretaries may, after written notice, terminate the service of a member if, in the judgment of the Secretaries, removal is in the public interest. Members may also be terminated if they no longer meet the requirements under which they were appointed; fail or are unable to participate regularly in Committee work; or have violated Federal law or the regulations of the Department of the Interior or the Department of Agriculture. SECTION II: ELECTION OF CHAIRPERSON AND VICE CHAIRPERSON The Committee will annually elect a Chairperson and Vice Chairperson from among its primary members. Individuals nominated for these positions must be in attendance at the meeting when such election occurs, or, if not able to attend such meeting, have informed the Designated Federal Official (DFO) in advance regarding their willingness to serve in either capacity. A majority of Committee members in attendance is deemed sufficient to eIect a Chairperson and Vice Chairperson when such election has been announced in advance of the meeting. Election of these officers will usually occur at the first meeting of the Committee during the calendar year. 2 SECTION III: ROLES AND RESP01�1SIBILITIES a. CHAIRPERSON A��ID VICE CHAIRPERSON: The Chairperson is responsible for conducting meetings of the Committee, which may include the following: conducting voting regarding recommendations of the Committee; appointing individuals and a chairperson, with concurrence of the DFO, to serve on a subgroup; calling for nominations and election of a Chairperson and Vice Chairperson; confemng with the D�O regarding calls for Committee meetings and issues to be addressed on meeting agendas; and certifying the accuracy of Committee meeting minutes. The Vice Chairperson will assume the role of Chairperson when the Chairperson is absent. If the Chairperson resigns or is terminated, the Vice Chairperson wilI continue in the role of Chairperson until the next annual election for both positions. b. ALTERNATE MEMBERS: An alternate member of the Committee serves in place of the primary member representing a particular industry, discipline, or interest during absences or upon resignation or termination of the primary member. During absences of the primary rnember, the alternate member shall function in the same manner and shall be accorded the same rights and privileges as the primary member. An alternate member shal]not make motions before the Committee or cast votes regarding recommendations under consideration by the Committee when the primary member is in attendance at meetings of the Cornmittee. An alternate member, however, may participate in Committee discussions at the discretion of the Committee Chairperson, and may participate in subgroups if appointed by the Committee Chairperson with the concurrence of the DFO. Alternate members cannot serve as Chairperson or Vice Chairperson unless the primary member representing the same industry, discipline, or interest has resigned or has been terminated. Approved by the Committee on March 1,2008. 3 r Santa Rosa and San Jacinto Mountains National Monument Advisory Committee (MAC) The Santa Rosa and San racinto Mountains National Monument invites you to submit a nomination application for any of eight primary representative positions or 15 alternate representative positions on the Monument Advisory Commiitee(MAC). Members are appointed to three-year terms, except as described below,by the Secretary of the Interior with concurrence by the Secretary of Agnculture. The MAC advises the Secretaries througlz thc Designated Federal Official (I�lational Monument Manager) on issues related to implementation of the Santa Rosa and San Jacinto Mountains National Monument Management Plan, and operates in accordance with the Federal Advisory Committee Act and the Committee's charter. Z'hree of the eight primary positions have been vacant due to resignation; therefore, the upcoming terms for them will be less than the customary three years in order to maintain an established rotation of Committee members. The remaining five primary positions are currently filled, but their tenms wi11 expire on December 16, 2008. The Committee's charter was revised in December 2UU7 to allow for the appointment of alternate representatives, one for each of the 15 interests and organizations represented on the iV1AC. Hence, this is the first time a call for nominations for these alternates has occurred, To maintain concurrency with the terms of primary representatives, terms for some alternates will be abbrcviated for the initial appointments. Background and Instructions The Santa Rosa and San Jacinto ylountains vational Vlonument Advisory Committee (NIAC) advises the Secretary of the Interior and the Secretary of Agriculture through the Designated fiederal Official (National Monument Manager) on issues related to implementation of the National Monument Management Plan. It operates in accordance ti�•ith the Federal Advisory Committee Act and the Santa Rosa and San Jacinto :�Iountains \ationa!vlonument Advisory Committee Charter. Niembers o£the MAC are U.S. citizens appointed for three-year terms by the Secretary of the Interior with concurrence of the Secretary of Agriculture. As volunteers, members serve without pay, but will be reimbursed for travel and per diem expenses for National Monument related business and travel, when appropriate and approved in advance, at the current rates for government employees. 1�here are 15 primary representatives and 15 alternate representatives serving on the N1AC. In accordance with the Santa Rosa and San Jacinto vlountains National Monument Act of 2000, the Committee includes a representative with expertise in natural science and research selected from a regional college or university; and representatives of the California Department of Fish and Game or California Department of Parks and Recreation; County of Riverside; cities of Palm Springs, Cathedral City, Rancho Mirage, La Quinta,Palm Desert, and Indian Wells; Agua Caliente Band of Cahuilla Indians; Coachella Valley Mountains Conservancy; a local conservation organization; a iocal developer or builder organization; Winter Park Authority; and the Pinyon Community Council. The MAC charter approved in December 2007 allows for the appointment of one alternate representative for each of these interests and organizations. A nomination application includes forms for both the U.S. Department of the Interior and U.S. Department of Agriculture. Complete nomination packages include letters of reference and a recommendation from the interest or organization being represented. Additional information which addresses a nominee's qualifications(e.g.,resume or curriculum vitae) should be submitted with the nomination package. Nominations may be made by any person, group, or organization, including self-nomination.
