That the City Council:
1. Waive further reading and adopt Resolution No.2010-2q authorizing
staff to collect a $168 fee forreviewing parking compliance of
Recreational Vehicles (RV) on Private Property associated with Title 8
Health and Safety of the Palm Desert Municipal Code; and
2. Provide direction to staff regarding contradictory requirements in the
municipal code relating to RV parking, between the requirements of
Sections 8.40.080D Recreational Vehicles on Private Property,
9.26.040C Unlawful Camping, and 10.96.020B Temporary Parking
Permit Procedure.
Commission Recommendation
The Architectural Review Commission (ARC) and RV Parking Subcommittee both
recommended approval of establishing a $168 fee associated with the review of parking
recreational vehicles on private property.
Executive Summary
Staff recommends approval of establishing a fee of $168 to review applications requesting
approval of parking locations for recreational vehicles on private property. This fee was

discussed in staff reports and verbal presentations to the Architectural Review
Commission, the RV Parking Subcommittee, and City Council within Ordinance No. 1207.
However, the fee was not actually established in that ordinance; the adoption of this
resolution will do so.
Background
Ordinance No. 1207 amending Chapter 8.40 Recreational Vehicles on Private Property
was approved on February 11, 2010 at first reading and again at second reading on
February 25, 2010. Staff and the RV Parking Subcommittee recommend that the fee be
reestablished in the amount of $168 (equivalent to the cost of processing similar cases
through the ARC), to be updated periodically when other development fees are revised by
City Council resolution. Staff typically spends four or more hours on recreational vehicle
cases. The process involves discussions with the applicant to get a full submittal, field site
review, preparation and noticing nearby property owners, writing an ARC staff report, and
the actual presentation in the ARC meeting. Additional time is required when cases are
appealed or called up by the City Council.
Further, staff has found a conflict between three separate sections of the code. Chapter
8.40.080D of Recreational Vehicles on Private Property relative to temporary parking
states that, "No permit shall be issued for a recreational vehicle parked in a public street or
blocking a public right-of-way." Chapter 9.26.040C of Unlawful Camping states, "Motor
homes equipped with sleeping and toilet facilities may be granted a permit by the city for
camping for a period of up to seventy-two hours in either: (1) any publicly -owned parking lot
or right-of-way; or..." Additionally, Chapter 10.96.020 states,
The parking and/or storage of recreational vehicles on public streets is
prohibited in the city, unless a permit is obtained as provided in subsection B,
below." Item B. states, "Upon receipt of a properly completed application, a
parking permit shall be issued by the code enforcement officer to any
individual who desires to park a recreational vehicle on a public street in the
city for a period of time not to exceed seventy-two consecutive hours.
Application for a permit shall be made to the code enforcement officer on a
form provided by the code enforcement department. Application for the
permit shall be made on the next day that the city offices are open following
the arrival of the applicant's recreational vehicle in the city.
These three codes are causing conflict regarding a clear policy, and staff would like
guidance from the City Council. Based on City Council direction, staff will return with the
appropriate amendments to either Chapter for proper agreement.
Staff recommends adopting the resolution to establish and collect a fee of $168, and
requests further direction on the whether or not Recreational Vehicles should be allowed to
park in the public right-of-way for up to 72 hours.
