By Minute Motion, approve Amendment No. 1 to Contract C29550 with Kirkpatrick
Landscaping Services, Inc., (Kirkpatrick) for a net increase to the contract price of
$2,278.22 for adjustments in the scope of work for Landscape Maintenance Area
17 (LMA 17).
Funds are available in the General Fund Account No. 110-4610-453-3320, Repair/Maintenance
Landscaping.
Backqround
On May 27, 2010, the City Council awarded Contract No. C29550 in the amount of $138,696.00
to Kirkpatrick for the maintenance of LMA 17. The Palm Desert Civic Center Park is included in
LMA 17, and in order to properly reflect current site conditions, an amendment to the contract is
needed.
On September 9, 2010, the City Council awarded the construction contract for the Aquatic Center
at Civic Center Park to ASR Constructors, Inc., (ASR) and they are now in control of the Aquatic
Center site. The landscape maintenance for the Aquatic Center site was originally part of LMA 17.
The site totals 8.14 acres and contains the 3.44 acre date grove, 2.07 acres of turf area, and 2.63
acres of shrub beds. Since ASR has assumed control of the site and started construction of the
Aquatic Center; landscape maintenance services are no longer needed and are not being
performed.

Kirkpatrick has tendered a proposai to reduce the monthly contract maintenance fee reflecting the
reduction in the area they maintain. Their proposal is for a reduction of $900.00 per month, or
$6,300.00 for the remaining seven months of the fiscal year. Staff has reviewed their proposal
and finds it reasonable and compensatory for the reduction in area and for the levels of services.
It should be noted that, although this is a relatively larger area, the levels of service were minimal.
The date grove required only weeding and irrigation; the turf area received much less use than
other areas in the park thus required less maintenance; and the shrub beds contain mature
shrubs that need minimal maintenance such as weeding and irrigation and little to no pruning.
Staff has found that usage of the Civic Center pog Park requires additional work, which includes
power washing of the hardscape, picnic tables, and benches. As a result, a quote for the
additional work was requested from Kirkpatrick. They submitted a proposal for the additional work
based on the approved additional labor rate per the contract and staff finds the quote to be
reasonable and fair. Their proposal is for an additional $1,225.46 per month, or $8,578.22 for the
remaining seven months of the fiscal year.
Amendment Number 1 to Contract No. 29550 consists of a decrease in the monthly contract
amount of $6,300.00 as a result of the construction of the Aquatic Center; and an increase of
$8,578.22 for the additional Civic Center pog Park services. The net change to the contract cost
is an increase of $325.46 per month, or $2,278.22 for the remaining seven months of Fiscal Year
2010-2011.
Fiscal Analvsis
The amount of Contract No. C29550 is increased to $140,974.22. This is an on-going
maintenance activity with no fiscal impact beyond the contract amount.

This Professionai Service Amendment covers changes to the subject contract as described herein and as set forth in
Exhibit A. The Consultant shall perform all work as necessary or required to complete the Professional Service
Amendment items for a lump sum price agreed upon between the Consultant and the City of Palm Desert, otherwise
referred to as Owner.

The undersigned Consultant approves the foregoing Contract Amendment#1 as to the changes, if any, in the contract
price specified for each item including any and all supervision costs and other miscellaneous costs relating to the
change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said
Contract Amendment #1. The Consultant agrees to furnish all labor and materials and perform all other necessary
work, inclusive of that directly or indirectly related to the approved time extension, required to complete the
Professional Service Amendment items. This document will become a supplement of the contract and all provisions
will apply hereto. It is understood that the Professional Service Amendment shall be effective when approved by the
Owner.
Execution of this Professional Service Amendment by the Consultant constitutes a binding accord and satisfaction that
fully satisfies, waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or
equity, arising out of or related to the subject of the Professional Service Amendment, whether known or unknown,
including but not limited to direct and indirect costs and/or damages for delay, disruption, acceleration, and loss of
productivity, as well as any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.
