Executive Summary The Owner's Certification of Water Quality Management Plan for Parcel Map Waiver No. 10-165 and the Covenant and Agreement Establishing Notification Process ar�d Responsibility for Water Quality Management Plan Implementation and Maintenance are for a portion of City-owned parcel APN 627-092-045. The subject property is located along the Alessandro Alley next to 44-849 Las Palmas Avenue, which is an apartment complex with covered parking for twelve spaces running parallel to the Alessandro Alley. The City Council approved the even exchange of the City-owned property, excepting the portion retained for right-of-way, for the southerly portion of 44-849 Las Palmas Avenue. Also, as part of the Alessandro Alley Project, the remainder portion of APN 627-092-045 will be improved with parking improvements and a carport providing an equal number of covered parking spaces to replace those removed from 44-849 Las Palmas Avenue. An approved Water Quality Management Plan is required prior to constructing the new parking improvements. Discussion The City-owned property (APN 627-092-045) is zoned R-1 (single family residential) and has access only to Alessandro Alley. The square footage and lot width of this Staff Report WQMP and Covenant for PMW No. 10-065 Page 2 of 3 December 9, 2010 property are considerably less than the minimum development standards for an R-1 zone. On April 23, 2009, the City Council approved the exchange of this property excepting the portion retained for the Alessandro Alley right-of-way. The property at 44-849 Las Palmas Avenue (APN 627-092-035) is an eleven unit apartment complex zoned R-3 (multi-family residential) and is adjacent to the City- owned property. This property has covered parking for twelve spaces that parallel the Alessandro Alley. The southerly 25.5 feet, excepting portions thereof, is approximately 3,488 square feet and will be exchanged for the remainder portion of APN 627-092-045. The parking and carports on the southerly portion of 44-849 Las Palmas Avenue will be removed as part of the Alessandro Alley Improvement Project. The Palm Desert Municipal Code Section 25.58 requires that all residential properties provide onsite parking spaces, and at least half are to be covered for shading. This requires parking improvements on the remainder portion of APN 627-092-045 that provide twelve parking spaces and a carport to replace the twelve spaces and carports to be removed as part of the project. On August 4, 2010, the Planning Commission approved Parcel Map Waiver (PMW) No. 10-165 to merge the remainder portion of APN 627-092-045 with 44-889 Las Palmas Avenue. The paved area for the parking improvements exceeds 5,000 square feet, which requires that a Water Quality Management Plan (WQMP) be implemented to design, construct, and maintain improvements specified in the WQMP using site specific Best Management Practices (BMP). The City of Palm Desert, along with the County of Riverside, the Riverside County Flood Control and Water Conservation District, Coachella Valley Water, the City of Banning and eight other Coachella Valley cities are all co-permittees to the Municipal Separate Storm Sewer System (MS4 Permit), which the City approved in 1991 in response to the requirements of the National Pollutant Discharge Elimination System (NPDES). The MS4 Permit is reissued every five years and requires the co-permittees to implement and follow a Stormwater Management Plan (SWMP). The MS4 and SWMP require a project specific Water Quality Management Plan (WQMP). The Whitewater River Region WQMP as required by the Whitewater River Watershed SWMP has been developed to further address post-construction Urban Runoff from New Development and Redevelopment projects under the jurisdiction of the Permittees, which the subject WQMP is in compliance with. Both the SWMP and the WQMP are updated every five years in response to the requirements of the MS4 Permit. As part of the Alessandro Alley Improvement Project the Palm Desert Redevelopment Agency will provide funding and maintenance of the improvements until completed. The executed Covenant and Agreement will ensure that when the subject property is conveyed to the owners of 44-889 Las Palmas, they and future owners will comply with the approved WQMP and operate and maintain the BMPs as outlined in the WQMP. Fiscal Analvsis The cost to implement the subject WQMP has been budgeted as part of the Alessandro Alley Improvement Project. Funds are available in Account No. 850-4341-433-4001. There will be no fiscal impact on the General Fund. The site is located one block north of Highway 111, between Las Palmas Avenue and Monterey Avenue in the City of Palm Desert. This final WQMP is intended to comply with the requirements of the City of Palm Desert (City) and the California Regional Water Quatity Control Board MS-4 Permit for the Colorado River Region Basin for the preparation and implementation of a project-specific WQMP which includes site specific best management practices (BMPs). The undersigned, while owning the property/project described in the preceding paragraph, shall be responsible for the implementation of this WQMP and will ensure that this WQMP is amended as appropriate to reflect up-to-date conditions on the site. This WQMP will be reviewed with the facility operator, facility supervisors, employees, tenants, maintenance and service contractors, or any other party (or parties) having responsibility for implementing portions of this WQMP. At least one copy of this WQMP will be maintained at the project site or project office in perpetuity. The undersigned is authorized to certify and to approve implementation of this WQMP. The subject parcel is currently undeveloped, with little or no vegetation. The parking lot will be developed with the repaving of Alessandro Alley, part of the Alessandro Alley Improvement Project initiated by the Palm Desert RDA. The project plans have been approved by the City and the project is ready to go "out to bid". The new parking lot will be paved with asphalt, have covered canopy parking, block walls on three sides (one of which is existing), adjacent landscaping, and a retention basin at the low end of the parking lot to capture storm runoff. The site is not subject to offsite storm flows. Some of the onsite storm flow percolates into the existing ground. The remainder accumulates and flows north-westerly along an adjacent parcel (APN 672-092-044) to San Benito Court, a public street. Ultimately, these flows are intercepted by a 42" storm drain in Las Palmas Avenue, conveyed to a 24'x8' channel along San Pasqual, which flows to the Whitewater River. A retention basin will be provided at the low (northerly) end of the parking lot. The capacity of the basin is 330 cubic feet. However, the maximum 100-year storm volume is 911 cubic feet (see calculations in Appendix F). Therefore, a drywell is recommended to address the difference between the basin capacity provided and the 100-year volume. With a drywell installed (assuming a nominal percolation rate of 0.05 cfs), the 100-year storm flow is retained with approximately 0.5' af freeboard. If the basin capacity is exceeded, overflow will continue north-westerly (through a "dropped block" opening in the adjacent CMU wall) in a manner consistent with the pre-developed flow patterns. Expected pollutants to be generated by the project during construction include sediment and turbidity, nutrients, organic compounds, trash and debris, oxygen demanding substances, bacteria and viruses, oil and grease, pesticides and metals. Appendix B of this project-specific WQMP includes: a. A Vicinity Map identifying the project site in sufficient detail to allow the project site to be plotted on Permittee base mapping; and b. A Site Plan for the project. The Site Plan included as part of Appendix B depicts the following project features: ■ Location and identification of all structural BMPs, including Treatment Control BMPs. ■ Landscaped areas. ■ Paved areas and intended uses (i.e., parking, sidewalks, etc.). ■ Number and type of structures and intended uses (e.g., buildings, etc.). ■ Infrastructure (i.e., streets, storm drains, etc.) that will revert to public agency ownership and operation. ■ Location of existing and proposed public and private storm drainage facilities (i.e., storm drains, channels, basins, etc.), including catch basins, drywells and other inlets/outlet structures. Pathogens are an impairment in the Coachella Valley Storm Water Channel from Dillon Road to the Salton Sea. 2) Toxaphene is an insecticide which was banned from use in the United States in 1990. Therefore, it is not a potential for the project but is currently a receiving water impairment. 3) Petroleum hydrocarbons are one of the most common organic compounds associated with street and parking lots and are a potential pollutant for the site. See Section V.2 for a description of appropriate Source Control BMPs. 4) Oil and grease associated with landscaping and onsite operations are potential pollutants for the development. See Section V.2 for a description of appropriate Source Control BMPs. Discussion of Receiving Water Impairment: Most of the pollutants which have caused impairment to the projecYs receiving waters are no longer being used. Many of these pollutants can be traced back to agricultural operations prevalent in the Coachella Valley. In addition, water quality management practices (i.e., the MS4 Permit requirements) have been implemented throughout the region to govern storm and non-storm water discharges to the designated receiving waters. These discharges have the ability to impact the "Beneficial Uses" of the receiving waters and can cause or threaten to cause a condition of"pollution" or"nuisance". The purpose of the project WQMP is to provide Best Management Practices (BMPs) which the property owner or their designee will implement and maintain to meet the requirements of the MS4 permit, thus minimizing the pollutant load associated with urban runoff. Hydrologic Conditions of Concern Local Jurisdiction Requires On-Site Retention of Urban Runoff: Yes � The project will be required to retain urban runoff onsite in conformance with local ordinance (See Table 6, Permittees Requiring Onsite Retention of Stormwater, of the Whitewater River Region WQMP). This section does not need to be completed. See SDP No. 08-909 Hydrology Report, dated 10/8/09, for Reference. No ❑ This section must be completed. This Project meets the following condition: � Condition A: Runoff from the Project is discharged directly to a publicly-owned, operated and maintained MS4; the discharge is in full compliance with Permittee requirements for connections and discharges to the MS4 (including both quality and quantity requirements); the discharge would not significantly impact stream habitat in proximate Receiving Waters; and the discharge is authorized by the Permittee. � Condition B: The project disturbs less than 1 acre and is not part of a larger common plan of development that exceeds 1 acre of disturbance. The disturbed area calculation must include all disturbances associated with larger plans of development. � Condition C: The project's runoff flow rate, volume, velocity and duration for the post-development condition do not exceed the pre-development condition for the 2- year, 24-hour and 10-year 24-hour rainfall events. This condition can be achieved by minimizing impervious area on a site and incorporating other site-design concepts that mimic pre-development conditions. This condition must be substantiated by hydrologic modeling methods acceptable to the Permittee. � None Refer to Section 3.4 of the Whitewater River Region WQMP for additional requirements. Supporting engineering studies, calculations, and reports will be included in Appendix C in the final WQMP. Best Management Practices This project implements Best Management Practices (BMPs) to address the Pollutants of Concern that may potentially be generated from the use of the project site. These BMPs have been selected and implemented to comply with the Section 3.5 of the WQMP and consist of Site Design, Source Control and, if/where necessary, Treatment Control BMPs as described herein. V.1 Site Design and Treatment Control BMPs Local Jurisdiction Requires On-Site Retention of Urban Runoff: Yes � The project will be required to retain urban runoff onsite in conformance with Iocal ordinance (See Table 6, Permittees Requiring Onsite Retention of Stormwater, of the Whitewater River Region WQMP). Section V.1 does not need to be completed. No ❑ Section V.1 must be completed. This section of the Project-Specific WQMP documents the Site Design BMPs and, if/where necessary the Treatment Control BMPs that will be implemented on the Project to meet the requirements within Section 3.5.1 of the WQMP. Section 3.5.1, includes requirements to implement Site Design Concepts and BMPs, and includes requirements to address the project's Pollutants of Concern with BMPs. Further sub-section 3.5.1.1 specifically requires that the projects Pollutants of Concern be addressed with Site Desiqn BMPs to the extent feasible. This project incorporates Site Design BMPs to fully address the Pollutants of Concern where and to the extent feasible. If and where it has been acceptably demonstrated to the Permittee that it is infeasible to fully meet this requirement with Site Design BMPs, this section includes a description of the conventional Treatment Control BMPs that will be substituted to meet the same requirements. In addressing pollutants of concern, BMPs are selected using Table 2 below. For example, maintenance of vehicles (which contributes to storm water contamination by oil and grease) is not authorized in this area. Similarly, washing of vehicles and other equipment is also not authorized in the parking lot. Activity restrictions such as these meet the intent of the best management practices. 5.2.1.3 Irrigation System and Landscape Maintenance Yes Owner shall ensure that the irrigation systems within the project site are operating properly. Owner shall also ensure that the ground's landscaping is maintained regularly so that the project site is in compliance with all City and Coachella Valley Water District water quality req ui rements. 5.2.1.4 Common Area Litter Control Yes Owner shall ensure that the parking lot, landscape area and retention basin are regularly maintained and kept free of litter so that the project site is in compliance with all City water quality requirements. 5.2.1.5 Street Sweeping Yes Owner shall ensure that the parking lot is regularly swept so that the project site is in compliance with all City water quality requirements. Streets/driveways and parking lots shall be swept at least quarterly, including just prior to start of the rainy season (October 1 st). At a minimum, routine maintenance of drainage facilities should take place in the late summer or early fall prior to the start of the rainy season (October 1 st). Drainage facilities must be cleaned if accumulated sediment/debris fills 25% or more of the storage capacity of the facility. 5.2.2 Structural Source Control BMPs 5.2.2.1 MS4 Stenciling and Signage No The site does not drain directly to MS4 facilities. Essentially the entire proposed site drains to an infiltration basin, which is equipped with a drywell to help increase percolation rates. 5.2.2.2 Landscape and Irrigation System Design Yes The project will be designed to include native, drought tolerant plants. These plants use less water, and help reduce the use of fertilizers and pesticides. The irrigation system will be programmable and utilize drip emitters, limiting excess irrigation runoff. The landscape and irrigation system will be designed in accordance with the City's water quality requirements and the Coachella Valley Water DistricYs irrigation requirements. 5.2.2.3 Protect Slopes and Channels No The project site does not contain any existing or proposed slopes and channels. 5.2.2.4 Provide Community Car Wash Racks No The project site will not include community car wash racks as part of the project design. Operations and Maintenance Responsibility for BMPs Appendix G of this project-specific WQMP will include a copy of an executed Covenant and Agreement used to ensure the ongoing operation, maintenance, funding, transfer and implementation of the project-specific WQMP requirements as part of the final WQMP. The City of Palm Desert is the current owner of the parcel which includes the proposed parking lot and drainage facilities (i.e., an infiltration basin and drywell). As such, the owner, their agents, and/or their assignees will be responsible for the operations and maintenance of the project BMPs. Maintenance of the basin and drywell consists primarily of removing trash and debris from the parking lot and basin, which could potentially clog the drywell and reduce its potential for infiltration. Declarant is the fee owner of the real property (the "Property") situated in the City of Palm Desert, County of Riverside, State of California, and legally described in Exhibit "A", which is attached hereto and incorporated within by reference. B. Declarant has applied to the City of Palm Desert ("City") for Parcel Map Waiver No. 10-165 C. As a condition of approval and prior to the map recordation and/or issuance of any permits, the City is requiring Declarant to execute and record an agreement stating that the future property owners shall be informed of the requirements to implement and maintain the Best Management Practices ("BMPs") as described in the approved project specific Water Quality Management Plan. D. Declarant intends by this document to comply with the conditions imposed by the City and to impose upon the Property mutually beneficial restrictions, conditions, covenants and agreements for the benefit of Property. � NOW, THEREFORE, for the purpose of complying with the conditions imposed by the City of Palm Desert for the approval of Case No.PMW 10-165, Declarant hereby declares that the Property is and hereafter shall be held, conveyed, transferred, mortgaged, encumbered, leased, rented, used, occupied, sold and improved subject to the following declarations, limitations, covenants, conditions, restrictions and easements, all of which are imposed as equitable servitudes pursuant to a general plan for the development of the Property, for the purpose enhancing and protecting the value and attractiveness of the Property, and each Parcel thereof, in accordance with the plan of improvement of the Property, and to comply with certain conditions imposed by the City for the approval of Case No. PMW 10-165 , and shall be binding and inure to the benefit of each successor and assignee in the interest of each such party. Any conveyance, transfer, sale, assignment, lease or sublease made by Declarant of a Parcel of the Property shall be and hereby is deemed to incorporate be reference all the provisions of the Covenant and Agreement including, but not limited to, all the covenants, conditions, restrictions, limitations, grants of easement, rights, right- of-way, and equitable servitude contained herein. 1. This Covenant and Agreement hereby establishes a notification process for future individual property owners to ensure they are subject to and adhere to the Water Quality Management Plan implementation measures and that it shall be the responsibility of the Declarant, it heirs, successors and assigns to implement and maintain all Best Management Practices (BMPs) in good working order. 2. Declarant shall use it best efforts to diligently implement and maintain all BMPs in a manner assuring peak performance at all times. All reasonable precautions shall be exercised by Declarant, its heirs, successors and assigns, in the removal and extraction of any material(s) from the BMPs and the ultimate disposal of the material(s) in a manner consistent with all relevant laws and regulations in effect at the time. As may be requested from time to time by the City, Declarant, its heirs, successors and assigns shall provide the City with documentation identifying the material(s) removed, the quantity, and disposal destination. 3. In the event Declarant, or its heirs, successors or assigns, fail to undertake the maintenance contemplated by this Covenant and Agreement within twenty-one (21) days of being given written notice by the City, or fails to complete and maintenance contemplated by this Covenant and Agreement with reasonable diligence, the City is hereby authorized to cause any maintenance necessary to be completed and charge the entire cost and expense to the Declarant or Declarant's succesors or assigns, including administrative costs, reasonable attorneys fees and interest thereon at the maximum rate authorized by the Civil Code from the date of the notice of expense until paid in full. As an additional remedy, the Public Works Director may withdraw any previous urban runoff-related approval with respect to the Property on which BMP's have been installed and/or implemented until such time as Declarant, its heirs, successors or assigns, repays to City its reasonable costs incurred in accordance with this paragraph. 4. Any Person who now or hereafter owns or acquires any right, title or interest in or to any parcel of the Property shall be deemed to have consented and agree to every covenant, condition, restriction and easement contained herein. 5. In addition, each of the provisions hereof shall operate as covenants running with the land for the benefit of the Property and each Parcel thereof and shall inure to the benefit of all owners of the Parcels thereof, their successors and assigns in interest, and shall apply to and bind each successive owner of each Parcel, their successors and assigns in interest. 6. The terms of this Covenant and Agreement may be enforced by the City, its successors or assigns, and by any owner, lessee or tenant of the Parcels of the Property. Should the City or any owner, lessee or tenant bring an action to enforce any of the terms of this Covenant and Agreement, the prevailing party shall be entitled to costs of suit including reasonable attorneys' fees. 7. Subject to the prior written approval of the City by its Public Works Director, any provisions contained herein may be terminated, modified or amended as to all of the Property or any portion hereof. No such termination, modification or amendment shall be effective until there shall have been executed, acknowledged and recorded in the Office of the Recorder of Riverside County, California an appropriate instrument evidencing the same including the consent thereto by the City.
