Authorize the Mayor to execute the subject agreement. Funding is available for this project in Account No. 234-4594-422-4001, Traffic Signal Coordination account. No General Fund money is being used for this project. Backqround In October 2008, City staff submitted a proposal for a Traffic Signal Synchronization project in response to a call for projects to be funded by the Coachella Valley Air Quality Trust Fund (also known as COLMAC funds). Staff received notification in July 2009 that the proposed project funding had been approved. On November 12, 2009, City Council authorized staff to issue a request for proposals (RFP) for the synchronization of 25 traffic signals. The estimated cost of the project was $70,000 with COLMAC funding $50,000, and the City contributing $20,000. A Notice Inviting Proposals was advertised and staff solicited proposals for signal synchronization services from the professional community for this project. On January 15, 2010, staff received twelve proposals for the project. A proposal review committee comprised of staff numerically ranked the proposals in the areas of qualifications of the firm and its personnel, management Staff Report Award Contract No. C29330 to Advantec Consulting Engineers, Inc. February 25, 2010 Page2of2 approach, technical approach to this particular project, and overall completeness of the proposal. The following three firms were the highest-ranked firms based upon the submitted proposals: Firm Location Bid Amount Advantec Consulting Engineers, Inc. Ontario, CA $65,500 Albert A. Webb Associates Palm Desert, CA $68,808 Fehr & Peers Riverside, CA $69,090 Of these, Advantec received the highest score. The firm submitted an excellent proposal that demonstrated thorough knowledge of the project, and had references from agencies that have used, and continue to use their services. Advantec, has successfully completed similar projects for other cities including the City of Irvine and the City of Lancaster. Cost proposals were opened from the three highest ranking firms. The cost proposals were scored based on a relative deviation (plus or minus) from the City's cost estimate. Each short listed firm also received a location score based on the location of the firm and their sub- consultants. The cost and location scores were factored into the overall score of each firm. Based on the overall score, Advantec was selected as the preferred consultant. Staff proceeded to negotiate the scope and cost based on the proposal received. Therefore, staff is confident in the value being received. Fiscal Analvsis This project is primarily funded using a COLMAC grant. Approximately 71 percent of the project will be funded by COLMAC, and the City will fund the remainder using Traffic Signal Funds. The full $65,550 cost of the project will initially be paid by the City and, at the conclusion of the project, the City will be reimbursed for approximately $46,540 with COLMAC funds for their portion of the cost. WITNESSETH: WHEREAS, CONSULTANT is a corporation, the principal members of which are Professional CONSULTANTS duly registered under the laws of the State of California; and WHEREAS, CITY desires to engage CONSULTANT to render certain technical and professional services as set forth in Exhibit "A" (CONSULTANT'S Proposal of Services) in connection with the design of Traffic Sianal Svnchronization Proiect. NOW, THEREFORE, the parties hereto agree as follows: (1) CITY hereby agrees to engage CONSULTANT to perform the technical and/or professional services as hereinafter set forth. �2) CONSULTANT shall perform all work necessary within the schedules provided herein to complete the services set forth in Exhibit "A" attached hereto and by reference incorporated herein and made a part hereof. (3) All information, data, reports and records and maps as are existing and available from the CITY and necessary for the carryings out of the work outlined in Exhibit "A" hereof shall be furnished to CONSULTANT without charge by CITY and CITY shall cooperate in every way reasonable in the carrying out of the work without delay. (4) CONSULTANT represents that, it employs or will employ at its own expense, all personnel required in performing the services under this Agreement. (5) All of the services required hereunder will be performed by CONSULTANT or under its direct supervision, and all personnel engaged in the work shall be qualified and shall be authorized or permitted under state and local law to perform such services. (6) The execution of this Agreement by the parties hereto does not constitute an authorization to proceed. CITY's Director of Public Works has not authorized CONSULTANT to proceed. (7) The CONSULTANT shall work closely with the CITY's Director of Public Works, or his designated representative, who shall be the principal officer of the CITY. The CONSULTANT shall review and receive the Director of Public Works approval of the details of work as it progresses. The Registered Civil CONSULTANT hereby designated by the CONSULTANT as its representative for supervision of the work required by this Agreement is Leo K. Lee. R.C.E. No. C42445. (8) The CONSULTANT warrants that he has not employed or retained any company or person, other than a bona fide employee working solely for the consultant, to solicit or secure this Agreement, and that he has not paid or agreed to pay any company or person, other than a bona fide employee working solely for the consultant, any fee, commission, percentage, brokerage fee, gifts, or any other consideration, contingent upon or resulting from the award or making of this Agreement. For breach or violation of this warranty, CITY shall have the right to annul this Agreement without liability or in its discretion to deduct from the contract price or consideration, or otherwise recover, the full amount of such fee, commission, percentage, brokerage fee, gift or contingent fee. (9) The right is reserved by the CITY to terminate the Agreement at any time upon seven (7) days written notice, in the event the project is to be abandoned or indefinitely postponed, or in the event the CONSULTANT'S services, in the sole judgment of CITY, are unsatisfactory or because of the CONSULTANT'S failure to prosecute the work with diligence or within the time limits specified or because of his disability or death. In any such case, the CONSULTANT shall be paid the reasonable value of the services rendered, based upon CONSULTANT'S standard hourly rates, up to the time of the termination. The CONSULTANT shall keep adequate records to substantiate costs and provide copies of original timecards in the event of termination or suspension. (10) All documents including tracings, drawings, estimates, reports, investigations and computations shall be delivered to and become the property of the CITY. CITY acknowledges and agrees that all plans, specifications, reports and other design documents prepared by CONSULTANT pursuant to this agreement shall be used exclusively on this project and shall not be used for any other work without the written consent of CONSULTANT. In the event CITY and CONSULTANT permit the re- use or other use of the plans, specifications, reports or other design documents, CITY shall require the party using them to indemnify and hold harmless CITY and CONSULTANT regarding such re-use or other use, and CITY shall require the party using them to eliminate any and all references to CONSULTANT from the plans, specifications, reports and other design documents. (11) The CONSULTANT shall comply with all federal, state and local laws, ordinances and regulations applicable to work. (12) No change in the character or extent of the work to be performed by the CONSULTANT shall be made except by supplemental authority in writing between CITY and the CONSULTANT. The supplemental authority shall set forth the changes of work, extension of time and adjustment of the fee to be paid by CITY to the CONSULTANT, if any. (13) In connection with the execution of this Agreement, the CONSULTANT shall not discriminate against any employee or applicant for employment because of race, religion, color, sex or national origin. The CONSULTANT shall take affirmative actions to insure equal employment opportunity and that employees are treated, during their employment, without regard to their race, religion, color, sex or national origin. Such actions shall include, but not limited to, the following: employment, upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay, or other forms of compensation and selection for training, including apprenticeship. This clause shall be included in each related subcontract, if any, awarded by the CONSULTANT. (14) The CITY agrees to pay the CONSULTANT for the work required by this Agreement on the following basis: CONSULTANT shall submit invoices monthly for services performed in the previous month not to exceed the total contract amount of: $65.550.00 (Sixtv-five Thousand Five Hundred Fiftv Dollars 00/100 ONLI�. CITY agrees to pay all undisputed invoices within thirty (30) days of receipt of invoice. CITY agrees to notify CONSULTANT of disputed invoices within fifteen (15) days of receipt of said invoice. (15) The CONSULTANT agrees to complete the work and submit the Final Design as displayed in Exhibit "A". (16) In the event that any judgment is entered in any action upon this Agreement, the party hereto against whom such judgment is rendered agrees to pay the other party an amount equal to the reasonable value of the legal services performed in his or its behalf in such action and that such amount may be added to and made a part of such judgment. (17) This Agreement shall be binding on the successors and assigns of the parties, but it shall not be assigned by the CONSULTANT without written consent of the CITY. (18) The CONSULTANT shall be an independent contractor, not an employee of the CITY. (19) Prohibited interests are as follows: No officer, member or employee of the CITY during his tenure or one year thereafter shall have any interest, direct or indirect, in this Agreement or the proceeds thereof. The parties hereto covenant and agree that to their knowledge no member of the City Council, officer or employee of the CITY has any interest, whether contractual, non-contractual, financial or otherwise, in this transaction, or in business of the contracting party other than the CITY, and that if any such interest comes to the knowledge of either party at any time a full and complete disclosure of all such information will be made in writing to the other party or parties, even if such interest would not be considered a conflict of interest under applicable laws. The CONSULTANT hereby covenants that he has, at the time of this Agreement, no interest, and that he shall not acquire any interest in the future, direct or indirect, which would conflict in any manner or degree with the performance of services required to be performed pursuant to this Agreement. The CONSULTANT further covenants that in the performance of this work no person having any such interest shall be employed by the CONSULTANT. (20) The CONSULTANT shall indemnify and save harmless the CITY, its officers and employees from and against any liability, loss, cost or expense resulting from any injury or damage to persons or property arising out of, pertaining to, or relating to the negligence, recklessness, or willful misconduct of the CONSULTANT, its agents or employees, while engaged in the performance of this Agreement. The CONSULTANT shall submit to CITY, prior to the issuance of the Notice to Proceed, certification of adequate coverage for "errors and omission" insurance in amounts approved by the City Attorney. Any such insurance shall not be canceled prior to written notice to and approval from the CITY. (21) The City shall not be responsible for payment for services by the Consultant that are directly related to addressing discrepancies, errors, omissions, ambiguities, etc. in the plans, specifications, and estimates prepared by the consultant. (22) In case of conflicts within the contract documents, the document precedence shall be as follows: (a) This Agreement; (b) Exhibit "A" (CONSULTANT'S Proposal of Services, and any written modifications thereto). Erwin, City Attorney Director of Public Works Proposal for Traffic Signai Synchronization Project(Project No. 552-10)for the City of Palm Desert 3.3 Scope of Work Signal timing synchronization is vital to maximizing the traffic flow. Each corridor is unique and shall be thoroughly analyzed and evaluated to optimize the operations of the signals. For this project, ADVANTEC will develop optimized signal timings in a professional manner that will ensure perceptible improvements to the public. The following scope of work expands upon the tasks outlined in the Request for Proposal (RFP) and Addendum 1. It illustrates our familiarity with this type of projects. For brevity and succinctness, the requirements of the RFP are implicitly incorporated into our work plan without being repeated here. Task 1—Project Management Upon contract award, ADVANTEC will conduct a Project Kick-Off Meeting with the City's Project Manager to establish communication channels and protocols; discuss the scope of work, schedule, and budget; gather available information; and obtain a thorough understanding of the goals for the project, including constraints, key issues and opportunities. We will conduct regular progress meetings with the City to update the progress and work accomplished. Any new issues arisen would be given detailed debriefing such that the City becomes aware of them, and can give proper directions to resolve them. ADVANTEC will prepare agendas prior to each meeting, and provide meeting minutes that summarize the progress and key decisions made at these meetings. Task 2—Data Collection &Field Review ADVANTEC will collect and review all the materials provided by the City. If requested,we may use our staff to assist the City in data collection from the City's office with minimum disruption to City staff. Besides data collection,ADVANTEC will, at the beginning of the project, conduct field review of all the signalized intersections within the project limits. During the field review, we will gather pertinent data/information, such as: • Roadway geometry and lane configurations. • Lengths of turn pockets • Existing signal phasing and timing • Speed limits • Major sources/sinks of traffic generators 11 .AI)VANTEC � Cunsu/ting Engincr�s Proposal for Traffic Signal Synchronization Project(Project No. 552-10)for the City of Palm Desert ADVANTEC will also conduct a 'Before' field travel time study using a "floating car" survey. The survey utilizes a commercial-off-the-shelf software (e.g.JAMAR or TSPPj that connects a GPS receiver to a laptop computer. The GPS receiver outputs data every second, which includes the speed of the vehicle, measured to a very high degree of accuracy. The software then uses the GPS coordinates to track the speed and distance of the surveying vehicle. At the end of the run, the data will then be processed to provide comprehensive Measures of Effectiveness (MOE) analysis reports, which includes travel time, average speed, number of stops, average delay, fuel consumption estimates, pollutant emission estimates, and so on. These parameters will serve as a basis for evaluating the benefits of the improved signal timing. A minimum of five floating car runs in each direction along Country Club Drive and Fred Waring Drive will be performed during peak hours. Results of the survey will be used to evaluate travel time, delay, and number of stops (measures of effectiveness), and to identify optimization strategies for signal synchronization (e.g. entire corridor end-to-end vs zone-by-zone optimization). ADVANTEC will summarize in a report the traffic patterns of the corridor and our proposed optimization strategy. Within two weeks after the completion of the signal timing implementation and finetuning, ADVANTEC will perform "After Studies" to obtain data for verifying the "measures of effectiveness". Similar to the "Before Studies", ADVANTEC will perform a minimum of five (5) floating car in each direction and around the same time periods as the 'Before studies'. As a value-added service, ADVANTEC will provide a synchronized video (approx. 2 minute duration) with the 'before' and 'after' travel time runs of a selected corridor to augment the study. The video will show the actual field conditions of a vehicle traveling on a corridor from a passenger's perspective and the real-time track of the vehicle on the time-space diagram. This video is a valuable tool to explain benefits of signal synchronization to lay persons and for presentation to elected officials. Tables and charts in Microsoft Excel format will be used to analyze and compare the MOEs of the 'before' and `after' studies, with a column showing the percentage of improvements for each parameter. This will serve as a basis for evaluating the benefits of the improved signal timings. An estimate of the 'benefits' of the signal timing optimization and synchronization results will be conducted using some of the MOE parameters such as total delay, travel time, fuel usage, pollutant emission, etc. These benefits will be quantified and,wherever possible,converted to monetary terms �2 ADVANTEC � Cunsultin�En€;rnccrs Proposal for Traffic Signal Synchronization Project(Project No. 552-10)for the City of Palm Desert in order to arrive at an average annual monetary savings to the travelers of the corridor. These results will be summarized in a Technical Memorandum. Task 3—Traffic Signal Timing Improvements Using the SYNCHRO base model provided by the City, ADVANTEC will update the model based on information collected from the City and in the field. ADVANTEC will optimize the signal timings parameters, such as cycle lengths, splits, offsets. Special attention will be given to intersections that operate at poor levels of service (LOS D or worse) to identify possible improvements. Special techniques may be adopted such as: • Lead-lead versus lead-lag phasing; • Half-cycle or other realistic harmonic cycle lengths for lightly traveled intersections, or double cycle lengths for heavily traveled intersections; � System breaks with different cycle lengths; • Pedestrian timing adjustment techniques. Each intersection and each corridor are unique and shall be thoroughly analyzed, simulated and then optimized to produce several synchronized signal systems. We will optimize all the intersections and corridors in meeting all the requirements by the City, including the development of: AM, mid-day, PM, off-peak, Saturday, Sunday timing plans, for both summer and winter seasons. ADVANTEC will also evaluate all the timing parameters, including minimum green, ped clearance, yellow, all-red, vehicle extension, gap reduction, etc., and make appropriate recommendations to the City for any changes proposed. Once developed, the SYNCHRO model results and database will be provided to the City for review. Upon review of the optimized signal timing by the City, a meeting will be conducted to discuss any comments. We will incorporate such comments into the signal timing plans, and resubmit to the City. Upon final approval of the optimized signal timing parameters, ADVANTEC will prepare signal timing sheets in the City's format. These timing sheets or plans will be forwarded to the City for approval. Upon receipt of any necessary corrections, the final timing sheet or plans will be prepared and delivered to the City. They will bear the stamp and signature of our Project Manager, a Registered Professional Traffic Engineer and Professional Traffic Operation Engineer. 13 ADTjAlVTEC � Consrrltrn�Enginccrs Proposal for Traffic Signal Synchronization Project(Project No. 552-10)for the City of Palm Desert Upon completion of implementation of all new signal timings by the City, monitoring and finetuning immediately follow. Based on our experience on similar projects, a number of signal timing improvements could be made through careful field observations subsequent to the implementation of new signal timings. For example, the offsets may be fine-tuned to coincide with arrival of the platoons so that waiting queues are dispersed prior to their arrival; green splits may be adjusted to balance the demand of the different approaches; cycle lengths may be modified to reduce delays; etc. The hours spent in the field during implementation and fine-tuning is extremely important towards successfully implementing improved signal timings with perceptible differences. More time spent in the field will invariably lead to improved signal timings. Therefore, ADVANTEC staff will observe the field traffic conditions during the key time periods to assist the City in fine-tuning the signal timings. We have done this for all our signal timing implementation projects, and found that this is very important towards successful implementation of optimized signal timing. Task 4—Deliverables Electronic copies of signal timing sheets, final Synchro models, time-space diagrams will be submitted � to the City. At the end of the project, a Project Report will be prepared that summarizes the methodology and results of the project.
