Funds are available in account No. 870-4688-464-4001 for the purpose of relocation costs.
Executive Summary
Sagecrest Apartments are located at 73-775 Santa Rosa Way, Palm Desert (also known as 44-200
San Pasqual Avenue, Palm Desert). The 14-unit apartment complex was acquired by the Palm
Desert Redevelopment Agency on February 28, 2008. In order to redevelop the site, a relocation
plan for the remaining 2 tenants requires review and approval. The attached Sagecrest Relocation
Plan outlines the eligible relocation assistance for the remaining tenants and complies with California
Relocation Law. The law requires preparation and a public review period of a relocation plan, which
has been completed. Approval of the Final Relocation Plan will comply with state law and is
necessary before the site is redeveloped.
Backqround
Public entities undertaking projects that may displace residents are governed in their relocation
assistance and real property acquisition efforts by Title 25, Division 1, Chapter 6, Subchapter 1 of
the California Code of Regulations. The future redevelopment of the Sagecrest site (the "Project")
triggers relocation assistance obligations under State Relocation Law (California Government Code
Section 7260 et. seq.) (the "Law") and the State Relocation Guidelines (California Code of
Regulations, Title 25, Chapter 6, et. seq. (the "Guidelines"). Among the various obligations of the
Law is the requirement to prepare a relocation plan addressing the circumstances and needs of
those persons potentially displaced by the Project. The Agency retained specialty consultants, PMC
(formally known as Pacific Municipal Consultants) in May of 2009 to prepare the Relocation Plan
(the "Plan") for the Sagecrest Apartments.

The Plan has been prepared in accordance with the specific requirements set out in Section 6038 of
the Guidelines concerning projects that involve the displacement of less than 15 households. The
plan provides a project description, the results of needs assessment survey conducted among
residents, a housing resource study, and details of the Agency's proposed relocation program. No
displacement activities have taken place prior to the required reviews and approval of this Plan.
In January 2010, a copy of the Plan for the Project was mailed via both regular and certified mail to
each of the project occupants with notification of the 30-day review period. The Plan was provided to
the public for the mandatory 30-day review period, and no comments were received. In addition, a
notice was published in the newspaper identifying the availability of the plan for review to tenants
that may have resided at the property after the Agency's acquisition in 2008. The thirty (30) day
comment period ended at 5:00 p.m. on February 22, 2010, and no comments were received. Upon
approval, a copy of the Plan will be forwarded to the California Department of Housing and
Community Development(HCD).
California Environmental Quality Review (CEQA)
For the purposes of CEQA, the Director of Community Development has determined that the proposed
relocation of a limited number of residents is exempt from further review under Section 15280 of the
California Code of Regulations, Title 14, Division 6, Chapter 3.
Staff recommends that the City Council and Agency Board hold a public hearing on the Final
Relocation Plan for the Sagecrest Apartments. Following the conclusion of the public hearing,
approve the above actions related to the Sagecrest Apartments, and approval to move forward with
individual eligibility letters to the remaining qualifying tenants.
Fiscal Analysis
Funds are available in account No. 870-4688-464-4001 for the purpose of relocation costs. No
further fiscal impact is anticipated at this time. '

RELOCATION PLAN
INTRODUCTION
The City of Palm Desert Redevelopment Agency has taken action which may result in the
redevelopment of property within the City of Paim Deserf. As a result, some housing will be
affected and two households renting units on the site will have to be permanently displaced for
this project to go forward. The property is located at 73-775 Santa Rosa Way, Palm Desert,
California (also known as 44200 San Pascual Avenue, Palm Desert, California). See attached
project site map (Attachment 1�. The Assessor's Parcel Number is 627-122-013.
The Paim Desert Redevelopment Agency ("Agency"J is proposing to develop new housing units
on this property. All of the units will be affordable to families of low and/or moderate income.
The Agency has retained the professional firm of PMC to prepare and administer this Relocation
and Replacement Housing Plan (the "Plan"�, under the direction of and involvement with the
Agency. This Pian provides the results of a needs assessment survey, a housing resource study,
and details of the proposed relocation program of the displacing entity, the Palm Desert
Redevelopment Agency. This Plan sets forfh policies and procedures necessary to conform with
statutes and regulations established by the California Relocation Assistance Law, California
Government Code section 7260 et seq. (the "CRAL") and the California Relocation Assistance
and Real Properfy Acquisition Guidelines, Title 25, California Code of Regulations, Chapter 6,
Section 6000 et seq. (the "Guidelines").
If there are federal funds involved in this project, this Plan and benefits may also need to
conform with the Uniform Relocation Act (46 U.S.C. Section 4600 et seq.), its implementing
regulations (49 C.F.R, part 24), and other requirements and regulations of the applicable funding
source.
No displacement activities will take place prior to the required reviews and approvai of this Plan
by the Agency Board of Directors.
A.ASSESSMENT OF NEEDS
To obtain information for the preparation of this Plan, personal interviews were conducted by
PMC, representing the Agency, with the two households living on the project site. Personai
interviews were conducted on Tuesday, August 18, 2009 with both households. Follow-up
questions were subsequently discussed on the phone. Both households' primary language is
Spanish. The interviews and phone discussions were conducted in Spanish by a native Spanish
speaker.
APARTMENT#4
Aparfment #4 household occupants include three adults and two children, ages 10 and 4. Two
of the adults are husband and wife, parents to the children, and the third adult, the grandfather
of the children, resides with the family. The 10-year-old child attends Palm Desert Middle School.
The mother is not employed and stays home with the children. The grandfather is a general
laborer and is employed. The father is a cook and has two jobs. The household does not have
any pets. None of the household residents reporfed any medical conditions that req�ire speciai
accommodations or equipment. The househoid's monthly income is approximately $4,475,
which places them in the "lower" income category as established by the U.S. Department of
Housing and Urban Development (HUD) for Riverside County. Attached are the most current
income limits as established by HCD for Riverside County (Attachment 2�.

The household expressed a preference to rent their replacement unit in the same general area
�Palm Deserf). They need to remain close to their child's school (Palm Deserf Middle School).
They also need to remain close to their places of empioyment. The grandfather does not know
how to drive and walks to work (about a half hour walk).
The househoid must be relocated into a dwelling that meets their family size and does not ailow
overcrowded conditions. Presently, with a total of five occupants, the household meets the
overcrowded conditions criteria, but not the severely overcrowded conditions criteria. in order
to provide for non-overcrowded conditions, this household will need a replacement dwelling
unit with a total of 5 rooms (including bedrooms, living, family, and dining rooms, but excluding
hallways, bathrooms, and porches�. The simplest way to ensure the replacement unit for this
household does not contribute to overcrowded housing conditions would be for the
replacement unit to have three bedrooms, in compliance with the Agency's policy on
occupancy standards and in compliance with HUD occupancy standards.
APARTMENT#1 O
Aparfment #10 household occupants include two adults and two children, ages 17 and 13. The
17-year-oid child just graduated from high school, is not currently employed, and has not
determined his future school plans yet. The 13-year-old child attends Palm Desert Middle Schooi.
The father is a seasonal laborer and earns approximately $1,150 per month. He works in
Coachelia, approximately 30 to 40 minutes away by car. The second adult who resides with the
family is the father's brother. He is unemployed. The total househoid income is $1,150 per month,
which places them in the extremely low-income category as established by HUD for Riverside
County. The househoid does not have any pets. None of the household residents have any
medical conditions that require special accommodations or equipment.
The household prefers to rent their replacement unit in the same general area (Palm Deserf�.
They are interested in any subsidized housing options for which they might qualify. They need to
remain close to their 13-year-old child's school (Palm Deserf Middle School). When the father
cannot drive the 13-year-old to schooi, the child walks to and from school, so proximity to the
middle school is especially imporfant to them. The household must be relocated into a dwelling
that meets their family size and does not aliow overcrowded conditions. Presentiy, the household
does not meet the overcrowded conditions criteria. A two-bedroom dwelling would maintain
their non-overcrowded housing conditions, in compliance with the Agency's policy on
occupancy standards and in compliance with HUD occupancy standards.

B. REPLACEMENT HOUSING RESOURCES
A resource survey was made on August 19, 2009, and September 9, 2009, to identify available
comparable, decent, safe, and sanitary units available in close proximity to the project site. One
two-bedroom unit and one three-bedroom unit will be required to adequately relocate the

project site households. Therefore, the survey focused on confirming the availability of
comparable, decent, safe, and sanitary units that contain the required minimum number of
bedrooms, are of adequate size for each household, and are comparable with respect to the
number of rooms and habitable living space.
The results of the resource survey show that at the end of August and beginning of September
2009, there were at least nine availabie comparable, decent, safe, and sanitary units of
adequate size containing two bedrooms (Attachment 3). These available two-bedroom units
ranged in rent from $875 per month to $1,250 per month. The households' current rent is $950
per month. The majority of these two-bedroom units inciuded two bathrooms, while some had
only one bathroom or one and a half bathrooms. Seven of these units were located within 1
mile of the tenants' existing home, and two were located within 2 miles of their current home.
Most of the units had comparable or superior amenities.
The resource survey showed that there were at least three available comparable, decent, safe,
and sanitary units of adequate size containing three bedrooms. These available three-bedroom
units ranged in rent from $1,049 per month to $1,195 per month. The households' current rent is
$950 per month. Both of these units included two bathrooms. Both units had comparable or
superior amenities.
The replacement housing resources identified meet the specific ne.eds as identified in Section A
as ali the housing identified contain two and three bedrooms and are located within
approximately 2 miles of the existing homes, within the distances required for the households to
meet their work and school proximity needs.
C. CONCURRENT RESIDENTIAL DISPLACEMENT
There is no concurrent residential displacement anticipated by the Palm Desert Redevelopment
Agency that would affect the available replacement housing.
D.TEMPORARY HOUSING
There is no anticipated need for temporary housing. Should such a need arise, the displacing
entity will respond appropriately and in conformance with all applicable laws and requirements.
If temporary moves are necessary and if it wiil minimize the impact to the displacee the Agency
may provide permanent relocation in lieu of temporary relocation.
E. PROGRAM ASSURANCES AND STANDARDS
There are adequate funds to relocate both the households. Services will be provided to ensure
that displacement does not result in different or separate treatment of households based on
race, nationality, color, religion, national origin, sex, marital status, familial status, disability, or any
other basis protected by the federal Fair Housing Amendments Act, the Americans with
Disabilities Act, Title VI of the Civil Rights Act of 1964, Title VIII of the Civil Rights Act of 1968, the
California Fair Employment and Housing Act, and the Unruh Act, as well as any other arbitrary or
unlawful discrimination.
No one will be dispiaced without 90 days notice and unless "comparabie" replacement housing
can be located and is available. Comparable housing includes standards such as decent, safe,
and sanitary (as defined in Section 6008(d) of the Guidelines); comparable as to the number of
bedrooms, living space, and type and quality of construction of the acquired unit but not lesser

in rooms or living space than necessary to accommodate the displaced household; in an area
that does not have unreasonable environmentai conditions; not generally less desirable than the
acquired unit with respect to location to schools, employment, health and medical facilities,
and other public and commercial facilities and services; and within the financial means of the
displaced household as defined in Section 6008,Subdivision (c)(5) of the Guidelines.
The relocation program to be implemented by the displacing entity conforms with the standards
and provisions set forth in Government Code Section 7260 et seq., the Guidelines, California
Health and Safety Code Section 33410 et seq., if applicable, and all other applicable
regulations and requirements.
F. RELOCATION ASSISTANCE PROGRAM
PMC Staff will be available to assist any dispiaced househoid with questions about relocation
and/or assistance in relocating. PMC will maintain personal contact with aii individuals until the
relocation process has been completed. PMC can be contacted toll-free at 1-866-828-6762
from 8:00 a.m. to 5:00 p.m., Monday through Friday. In addition, relocation staff will be availabie
to speak on the phone to residents on weekday evenings and weekends. Spanish-speaking
bilingual relocation staff will be available to speak to residents with limited English.
PMC offices are located at 1590 Drew Avenue, Suite 120, Davis, California. PMC relocation staff
can make accommodations as necessary to meet with the residents at the properfy or at a
designated location in near proximity to the property.
The Palm Deserf Redevelopment Agency office is located at 73510 Fred Waring Drive, Palm
Desert, California, and Agency staff is available from 8:00 a.m. to 5:00 p.m., Monday through
Friday.
A comprehensive relocation assistance program, with technical and advisory assistance, will be
provided to the househoids being displaced. Close contact will be maintained with each
household.
The following services and tasks will be underfaken by PMC staff:
1. Each displaced household will be personally interviewed to gather information appropriate to
determine needs and preferences with regard to the replacement of existing accommodations.
2. As soon as feasible, the relocation representative shall explain the relocation payments and
other assistance for which households and individuals may be eligible, including related eligibility
requirements and the procedures for obtaining such assistance.
3. Tenants wili receive timely referrals to at Ieast three comparable replacement units and, if
necessary, transportation wiil be provided to inspect potential replacement units. Assistance will
be provided to complete appropriate forms and coordinate moving arrangements. Displacees
will be kept informed of Project timing and receive appropriate notice to prepare for required
moves. Claims for compensable expenses associated with the move will be processed
expeditiously.
4. Special assistance in the form of referrals to governmental and social service agencies will be
made, as appropriate.
5. Bilingual assistance will be provided, as needed.

PMC staff will distribute informationai brochures to residential tenants (Exhibit C).
G.CITIZEN PARTICIPATION/PLAN REVIEW
This Plan will be provided to each household and will be made available to the public for the
mandatory thirty (30) day review period. Comments to this Plan will be included as a Pian
addendum prior to submission for approval before the Palm Desert Redevelopment Agency
Board. A copy of the approved Plan will be forwarded to the California Deparfment of Housing
and Community Development (HCD).
H. RELOCATION BENEFIT CATEGORIES
Relocation benefits will be provided in accordance with the California Relocation Assistance
Law (CRAL), the Guidelines, and all other applicable regulations and requirements. Benefits will
be paid upon submission of required claim forms and documentation in accordance with
approved procedures.The displacing entity will provide appropriate benefits for each displaced
household as required by the above laws and requirements.
RESIDENTIAL MOVING EXPENSE PAYMENTS
The subject households will be eligible to receive a payment for moving expenses. Payments will
be made based upon either a fixed room count schedule for self-moves or an invoice for actual
reasonable moving expenses from a licensed professional mover.
1. Fixed Payment (For Self-Moves) -A fixed payment for self-move moving expenses based
on the number of rooms containing furnit�re or other personal properfy to be moved.The
fixed moving payment will be based upon the most recent Federal Highway
Administration schedules maintained by the California Department of Transporfation. At
present,the room count (4) transiates into$1,175 for a Fixed Move(Attachment 5).

2. Actual Reasonabie Moving Expense Payments-The displaced households may elect to
have a licensed, professional mover perform the move; if so, the displacing entity will pay
for the actual cost of the move up to 50 miles and all reasonable charges for packing,
unpacking, insurance, and utility connection charges. The payment will be made directly
to the mover.
Pursuant to Public Law 105-1 17, aliens not lawfully present in the United States are not eligible for
relocation assistance, unless such ineligibility would result in exceptional hardship to a qualifying
spouse, parent, or child. All persons seeking relocation assistance are required to certify that
they are a United States citizen or national, or an alien lawfully present in the United States.
RENTAL ASSISTANCE/DOWN PAYMENT ASSISTANCE
Displaced househoids who are residential tenants and who have estabiished residency within
the project site for a minimum of 90 days prior to the "initiation of negotiations"will be eligible for
both Rental Assistance and Moving Expense Payments.
"Initiation of Negotiations" is defined as the first written offer to buy the properfy from which the
households will be displaced. In this case, the estimated or actuai date of the first written offer to

purchase the properties of the tenant households is November 16, 2007. Except in the case of
Last Resorf situations, Rental Assistance Payments will be limited to a maximum of $5,250 based
upon the monthly housing need over a forfy-two (42) month period. in addition, the households
may opt to apply the amount to which they are entitled toward the purchase of a replacement
unit.
LAST RESORT HOUSING PAYMENT
A comparable housing survey was completed on August 19, 2009, and September 9, 2009, and
determined that comparable housing was availabie within a 2-mile radius. However, the rent
amounts of all the comparable housing units exceed 30% of Apartment #10's average monthly
income, requiring that "Last Resort Housing Payments" be necessary for this household.
Last Resort Housing payments are authorized by statute if affordable "comparable replacement
housing" cannot be found for the displaced tenant (i.e., housing not more than 30% of the
household's average monthly income). In this case, payments may be made beyond the
$5,250 statutory cap up to 42 months worfh of rental assistance. The supplemental increment
beyond $5,250 may be paid in installments or in a lump sum at the discretion of the displacing
entity.
Unless the Last Resorf housing Payment is excessive, the Redevelopment Agency will allow a
lump sum payment. Likewise, if a household chooses to purchase a repiacement home rather
than rent, the household will have the right to request a lump sum payment of the entire
balance to which they are entitled.
To be eligible for Last Resort Housing Payments, household residents must be �egally residing in
the U.S., uniess the following sources of funding are used for the project: Federal Community
Development Block Grant (CDBG), Section 108 Loan Guarantee, or HOME Investment
Partnerships funds. If any of these funds are used for any aspect of the redevelopment project,
then Section 104(d) of the Housing and Community Development Act (HCD) is applicabie and
tenants do not need to be legally in the U.S. to be eligible for Last Resort Housing. In addition, if
Section 104(d) is applicable, Last Resort Housing payments are payable up to 60 months of
rental assistance, instead of up to 42 months under URA. At this time, the source of funding for
this redevelopment project is unknown and residents are not required to provide proof of legal
residency unless they are applying for these benefits.
For the Aparfment #4 household, the housing survey identified comparable units that would
allow the household to pay less than 30%of its household income toward housing costs.
I. PAYMENT OF RELOCATION BENEFITS
Relocation benefit payments will be made expeditiously. Claims and supporting documentation
for relocation benefits must be filed with the displacing entity within eighteen �18) months from:
• The date the claimant moves from the acquired properfy.
OR
• The date on which final payment for the acquisition of real properfy is made, whichever
is later. Procedures for preparing and filing of claims and processing and delivering of
payments are attached(Attachment 6).

No household will be displaced until comparable housing is located as defined above and in
Section 6008, Subdivisions (c) and (d) of the Guidelines. Relocation staff will inspect any
replacement units to which referrals are made to verify that they meet all the standards of
decent,safe, and sanitary as defined in Section 6008, Subdivision (d) of the Guidelines. However,
no household will be denied benefits if it chooses to move to a replacement unit which does not
meet the standards of decent, safe, and sanitary housing.
J. EvicrioN PoucY
The displacing entity recognizes that eviction is permissible only as a last resort and that
relocation records must be documented to reflect the specific circumstances surrounding any
eviction. Eviction wili only take place in cases of nonpayment of rent, serious violation of the
rental agreement, a dangerous or illegal act in the unit, or if the household refuses all
reasonable offers to move. Eviction wiil not affect the eligibility of a person legally entitled to
relocation benefits.
K.APPEALS POLICY
The appeals policy will follow the standards described in Section 6150 et seq. of the Guidelines
as modified by the Palm Desert Redevelopment Agency's Relocation Assistance and Real
Properfy Acquisition Guidelines. Briefly stated, the displaced household witl have the right to ask
for review when there is a complaint regarding any of its rights to relocation and relocation
assistance, such as a determination as to eligibility, the amount of payment, or the failure to
provide a comparable replacement housing referral. A copy of the City of Palm Desert, Palm
Desert Redevelopment Agency, and the Palm Desert Housing Authority's Relocation Assistance
and Real Properfy Acquisition Guidelines (Resolution 99-104, Ordinance 926A, Resolution HA-8,
Resolution HA-10, Resolution 383, Resolution 99-85, and Resolution 99105 is attached
(Attachment 7).
L. PROJECTED DATES OF DISPLACEMENT
Households will receive a 90-day notice to vacate before they are required to move. These
notices are expected to be issued on or about March 1, 2010. Relocation is expected to be
completed for all households on or abo�t June 1, 2010.
M. ESTIMATED RELOCATION COSTS
The dispiacing entity anticipates using the following funds for the relocation costs associated
with this redevelopment project:
• Redevelopment Agency Funds
No Federai Community Development Block Grant (CDBG), Section 108 Loan Guarantee, or
HOME Investment Parfnerships funds have been nor will be used for this redevelopment project,
nor any other funds that would make Section 104(dJ of the Housing and Community
Development Act (HCD) appiicable to this project.
Any and ail required financial assistance wiil be provided to the households. The Apartment #10
household may qualify for Last Resorf Housing Payments due to their income. To be eligible,
residents must income qualify and be legally residing in the U.S. Pursuant to Public Law 105-1 17,

INTRODUCTION
This booklet describes the relocation payments and other relocation assistance provided under
the Uniform Relocation Assistance and Real Properfy Acquisition Policies Act of 1970, as
amended (URA) to tenants dispiaced from their homes. This includes any family or individual
that must move as a direct result of rehabilitation, demolition or acquisition for a project in which
Federal funds are used.
If you are notified that you will be displaced, it is important that you do not move before you
learn what you must do to receive the relocation payments and other assistance to which you
are entitled.
Pursuant to Public Law 105-117, aliens nof lawfully present in fhe United States are not eligible for
relocation assistance, unless such ineligibility would resulf in exceptional hardship to a qualifying
spovse, parent, or child. All persons seeking relocation assistance will be required to certify that
fhey are a United States citizen or national, or an alien Iawfully present in fhe United Stafes.
This booklet may not answer all of your questions. If you have more questions about your
relocation, contact the Agency responsible for the project. (Check the back of this booklet for
the name of the person to contact at the Agency.) Ask your questions before you move.
Afterwards, it may be too late.
SUMMARY OF RELOCATION ASSISTANCE
As an eligible tenant displaced from your home, you will be offered the following advisory and
financial assistance:
• Advisory Services. This includes referrals to comparable and suitable replacement
homes, the inspection of repiacement housing to ensure that it meets established
standards, help in preparing claim forms for relocation payments and other assistance to
minimize the impact of the move.
• Payment for Moving Expenses. You may choose either a:
- Payment for Your Actual Reasonable Moving and Related Expenses, or
- Fixed Moving Expense and Dislocation Allowance, or
- A combination of both, based on circumstances.
• Replacement Housing Assistance. To enable you to rent, or if you prefer, buy a
comparable or suitable replacement home, you may choose either:
- Rental Assistance, or
- Purchase Assistance.
If you disagree with the Agency's decision as to the relocation assistance for which you are
eligible,you may appeal that decision.

GENERAL QUESTIONS
How Will I Know I Am Eligible For Relocation Assistance?
You should receive a written notice explaining your eligibility for relocation assistance. You
should not move before receiving that notice. If you do, you may not receive relocation
assistance.
How Will The Agency Know How Much Help I Need?
You will be contacted at an early date and personally interviewed by a representative of the
Agency to determine your relocation needs and preferences for replacement housing and
advisory services.The interviewer will ask certain questions about you and other members of your
household, including questions about your income. It is to your advantage to provide the
information so that the Agency can assist you in moving with a minimum of hardship. The
information you give wiil be kept in confidence.
How Soon Will I Have To Move?
If possible, a mutually agreeabie date for the move will be worked out. You will be given
enough time to make plans for moving. Unless there is a health or safety emergency, you will
not be required to move without at least 90 days advance written notice of (1) at least one
"comparable replacement home"that is available to you and (2) the earliest date by which you
must move.
What Is A Comparable Replacement Home?
A comparable replacement home is:
• Decent, safe, and sanitary.
• Functionally equivalent to (and equal or better than) your present home.
• Actually available for you to rent.
• Affordable.
• Reasonably accessible to your place of employment.
• Generally as well located with respect to public and commercial facilities, such as
schools and shopping, as your present home.
• Not subject to unreasonable adverse environmental conditions.
• Available to all persons regardless of race, color, religion, sex, or national origin.
What is Decent, Safe, and Sanitary Housing?
Decent, safe, and sanitary housing is housing that:
• Meets appiicable housing and occupancy requirements.

• Is structurally sound,weathertight, and in good repair.
• Contains a safe, adequate electrical wiring system.
• Has adequate living space for the occupants.
• Has a kitchen with a sink, hot and cold running water, and connections for a stove and
refrigerator (if you were displaced from a housekeeping unit).
• Has a separate, complete bathroom with hot and cold running water.
• Has heating as required by climatic conditions.
• Has an unobstructed exit to safe, open space at ground level.
• Meets standards protecting occupants from lead-based paint hazards.
• If you are person with a physical disability, is free of any barriers which would preclude
your reasonable use of the unit.
Will The Agency Heip Me find A Replacement Home?
Yes. You will be provided with referrals to housing that has been inspected to ensure that it
meets established standards. If possible, you will be referred to at least three comparable
replacement homes. The maximum financial assistance for which you may qualify will be based
on the cost of the most representative comparable replacement home that is available to you.
Promptly after you become eligible for relocation assistance, the Agency will inform you of such
unit and the maximum payment available.
Once the Agency representative has a clear understanding of your needs and preferences, he
or she wiil work with you to assure that you are given the best possible choice of housing and will
be provided the opportunity to inspect these units prior to selecting.
If you would like to move to government-owned housing let the Agency representative know of
your interest. Generaliy, an eligible displaced person receives preference for such long term
housing assistance if feasible. You will be given assistance in completing any required applica-
tion forms.
What If I Find My Own Replacement Housing?
You have every right to find your own replacement housing. However, before you rent or buy,
ask the Agency to inspect the unit to make sure that it is decent, safe, and sanitary. If the
housing unit is not decent, safe, and sanitary, you will not receive a replacement housing
payment.
What If i Encounter A Probiem In Obtaining Housing Of My Choice?
If you encounter a problem in buying or renting housing of your choice, notify the Agency
immediately. The Agency will look into the matter and try to resolve it. You will receive this help
whether you were referred to the housing unit or found it yourself.

If you are unable to buy or rent a housing unit because of discriminatory practices on the parf of
a reai estate broker, rental agent, lender, or a properfy owner, the Agency will help you file a
formal housing discrimination complaint with the U.S. Deparfment of Housing and Urban
Development or the appropriate State or local fair housing agency.
What Other Services Will i Receive?
In addition to heip in obtaining a comparable replacement home, other assistance, as
necessary, will be provided in order to minimize the impact of your move. This assistance may
include referral to appropriate public and private agencies that provide services concerning
housing financing, employment, health, weifare, or legal assistance. The range of services
depends on the needs of the person being displaced. You shouid ask the Agency
representative to tell you about the specific services that will be available to help you and your
family.
What Is a Payment For Actual Reasonable Moving and Related Expenses?
You may choose to receive a relocation payment to cover the reasonabie cost of your move. If
you choose a Payment For Actual Reasonable Moving And Related Expenses, you may inciude
in your claim the reasonable and necessary costs for:
• Transportation for you and your family.
• Packing, moving and unpacking your household goods.
• Disconnecting and reconnecting household appliances and other personal property
(e.g., telephone and cable TV).
• Storage of household goods, as may be necessary.
• Insurance for the replacement value of your properfy during the move and necessary
storage.
• The replacement value of properfy lost, stolen or damaged in the move (but not through
your neglect) if insurance is not reasonably availabie.
The Agency wili explain all eligible moving costs, as well as those which are not eligible.You must
be able to account for any costs that you incur, so keep all your receipts. Select your mover
with care. The Agency can help you select a reliable and reputable mover.
You may elect to pay your moving costs yourself and be repaid by the Agency or, if you prefer,
you may have the Agency pay the mover. In either case, let the Agency know before you
move.
What Is A fixed Moving Expense And Dislocation Allowance?
If you choose a Fixed Moving Expense and Dislocation Allowance,you will receive an allowance
which is based on the number of rooms in your home or the number of rooms of furniture you will
be moving, as shown on Attachment 5 of the Plan.
If you do not have a large amount of personal properfy to move, this payment should be more
advantageous. No special documentation is required to supporf your claim. You need only

move your personal properfy and complete the appropriate claim form in order to receive your
payment.
How Much Rentai Assistance Will I Receive?
You may be eligible to receive Rental Assistance for a 42-month period. The assistance is
computed in the following manner:
The assistance needed for one month is determined by subtracting the "base monthly rent" for
your present home from the cost of rent and utilities for your new home (or a comparable
replacement home, if that cost is lower). That monthly need, if any, is multiplied by 42, to
determine the total amount that you will receive. This amount will be paid directly to you. The
Agency must provide the assistance in monthly installments or other periodic payments.
Generally, the base monthly rent for your present home is the lesser of: (1) the monthly rent and
average monthly cost for utilities, or (2) thirty (30) percent of your average monthly gross
household income, if you are low-income based on HUD income limits.
Examples: Let's say that the monthly rent and average cost for�tilities for your present home are
$250; the monthly rent and estimated average utility costs for a comparable replacement home
are $350; and your monthly gross income is $700. In this case yo�r"base monthly rent"would be
$210 because you are low-income and that amount (30 percent of your income) is less than the
monthly cost of rent and �tilities at your present home ($250).
• If yo� rent a replacement home for $350 per month, including estimated average
monthly utility charges, you will receive $5,880. That amount is 42 times $140 (the
difference between the "base monthly rent" for your present home ($210) and the cost
fora comparable replacement home ($350)).
• If you rent a replacement home for $310, inciuding estimated average monthly utility
charges, you will receive $4,200. That amount is 42 times $100 (the difference between
the "base monthly rent" for your present home ($210) and the actual cost of your new
home ($310)).
To qualify for rental assistance, you must rent and occupy a decent, safe, and sanitary home
within one year after the date you move. However, the Agency will extend this period for good
cause.
If I Decide to Buy, Rather Than Rent, How Much Assistance Will 1 Receive?
If you buy a replacement home, you may be eligible for assistance to make a down payment
equal to the amount you would receive if you rented a comparable replacement home (i.e., 42
times the amount obtained by subtracting the "base monthly rent" for your present home from
the monthly rent and estimated average monthly utility costs for a comparabie replacement
home�. A down payment assistance payment will be paid in a lump sum.
Example: Assuming the information in the prior examples, the downpayment assistance
payment would be $5,880. That amount is 42 times $140 (the difference between the "base
monthly rent" for your present home ($210) and the monthly rent and estimated average
monthly utilities cost for a comparable replacement home ($350). The full amount of the
payment must be applied to the purchase of the replacement dwelling.

Must I File A Claim To Obtain A Relocation Payment?
Yes. You must file a claim for each relocation payment. The Agency will, however, provide you
with the required claim form, help you to complete it, and explain the type of documentation, if
any,that you must submit in order to receive the payment.
If you must pay any relocation expenses before you move (e.g., a security deposit when you
sign a lease for your new home�, discuss your financial needs with the Agency. While
refundable deposits are not covered by URA payments,you may be abie to obtain an advance
payment to meet these costs. An advance payment may be placed in"escrow"or paid directly
to a contractor to ensure that the move will be completed on a timely basis.
You must file your claim within 18 months after the date you move. However, it is to your
advantage to file as soon as possible after you move. The sooner you submit your claim, the
sooner it can be processed and paid. If you are unable to file your claim within 18 months, ask
the Agency to extend this period.
Be careful no# to confuse this 18-month period with the 12-month period within which you must
rent (or buy) and occupy a replacement dwelling in order to be eligible for a replacement
housing payment.
You will be paid promptiy after you file an acceptable claim. If there is any question regarding
your right to a relocation payment or the amount of the payment, you will be notified, in writing,
of the problem and the action you may take to resolve the matter.
Will I Have To Pay Rent To The Agency Before I Move?
Yes, you are required to pay rent per your rental agreement until the date that you move. Do 1
Have To Pay Federal Income Taxes On My Relocation Payments?
No. Section 216 of the URA states that you need not reporf relocation payments as parf of your
gross income for Federal tax purposes. For information on State or local income taxes, you
should check with the State or local income tax office in your area or with your personal tax
advisor.
What If I Don't Receive The Required Assistance - Can I Appeal?
If you disagree with the Agency's decision as to your right to relocation assistance or the amount
of a payment, or the adequacy of the housing to which you have been referred, you may
appeal the decision pursuant to the Palm Desert Redevelopment Agency's Relocation
Assistance and Real Property Acquisition Guidelines.
The Agency will inform you of its appeal procedures. At a minimum, you will have 60 days to file
your appeal with the Agency after ypu receive written notification of the Agency's
determination on your claim. Your appeal must be in writing.
If you are a low- or moderate-income person and are dissatisfied with the Agency's
determination on your appeal, you may have an additional right to request administrative
review of that decision (e.g., by the State).
You can expect a fair decision on any appeal. However, if you are not satisfied with the final
administrative decision on your appeal,you may seek review of the matter by the courfs.

(NTRODUCCION
Este folleto describe los pagos de reubicacion y otra asistencia de reubicacion suministrada
segun la Ley de Politica Uniforme de Asistencia para la Reubicacion y Adquisicion de
Propiedades Inmuebles de 1970, y sus reformas (URA, siglas en ingles) a los inquilinos

�Cubndo tendre que mudarme?

�Que pasa si tengo un problema obteniendo una vivienda de mi preferencia?
Si tiene un problema comprando o alquilando una vivienda de su preferencia, notifiquele a la
Agencia de inmediato. La Agencia investigara el asunto y tratara de resolverlo. Usted recibira
esa ayuda sin imporfar si se le recomendo la unidad de vivienda o si la encontro usted mismo.
Si no puede comprar o alquilar una unidad de vivienda debido a practicas discriminatorias por
parfe de un corredor de bienes raices, agente de alquiler, prestamista o propietario, la Agencia
le ayudara a registrar una queja formal de discriminacion en la vivienda con el Deparfamento
de Vivienda y Desarrollo Urbano de los Estados Unidos o la agencia de viviendas equitativas
estatal o local apropiada.
�Que otros servicios recibire?
Ademas de ayudarie a obtener una vivienda comparable de reemplazo, se suministrara otra
asistencia, segun sea necesario, a fin de minimizar el impacto de su mudanza. Esta asistencia
podria incluir una recomendacion a las agencias publicas y privadas apropiadas de
financiamiento de viviendas, empleo, salud, bienestar o asistencia legal. La gama de servicios
depende de las necesidades de la persona a la que se le esta reubicando. Se le recomienda
que le pida al representante de la Agencia que le expliq�e acerca de los servicios especificos
que estaran disponibles para ayudarle a usted y a su familia.
�Que es un pago real y razonable relacionado a los Gastos de Mudanza?
Usted puede optar por recibir un pago de reubicacion para cubrir el costo razonable de su
mudanza. Si usted escoge un Pago para Gastos de Mudanza y Relacionados Efectivos y
Razonables, usted podra incluir en su reclamacion los costos razonables y necesarios para:
• Transporfe para usted y su familia.
• Empacar, mudar y desempacar sus bienes del hogar.
• Desconectar y volver a conectar los electrodomesticos del hogar y otros bienes
personales (por ej., el telefono y la television por cabie�.
• Almacenamiento de los bienes del hogar,segun pueda ser necesario.
• Seguro para el valor de reemplazo de sus bienes durante la mudanza y el
almacenamiento necesario.

�Que es un Subsidio Fijo para los Gastos de Mudanza y la Reubicacion?
Si escoge un Subsidio Fijo para los Gastos de Mudanza y la Reubicacion, recibira un subsidio
que se basa en el numero de habitaciones en su casa o el numero de habitaciones de muebles
que usted mudara, segun se muestra en el Anexo 5 del Plan.
Si no tiene una cantidad grande de bienes personales que mudar, este pago deberia ser mas
ventajoso. No se requiere ninguna documentacion especial para justificar su reclamacion. Lo
unico que tiene que hacer es mudar sus bienes personales y completar el formulario de
reclamacion apropiado a fin de recibir su pago.
�Cu6nta Asistencia de Alquiler recibire?
Es posible que pueda ser elegible para recibir Asistencia de Aiquiler por un periodo de 42
meses. La asistencia se calcula de la siguiente manera:
La asistencia necesaria para un mes se determina restando el "alquiler mensual base" de su
vivienda actual al costo del alquiler y los servicios publicos para su vivienda nueva (o una
vivienda comparable de reemplazo, en caso de que ese costo sea mas bajo). Esa necesidad
mensual, si la hubiere, es multiplicada por 42, para determinar la cantidad total que usted
recibira. Esta cantidad se le pagara directamente a usted. La Agencia debe proporcionar la
asistencia en pagos mensuales u otros pagos periodicos. Por lo general, el alquiler mensual base
para su vivienda actual es la cantidad que resulte menor entre: (1) el alquiler mensual y el costo
mensual promedio de los servicios p�blicos o (2) el treinta (30) por ciento de sus ingresos

oportunamente.

ATTACHMENT 6: RELOCATION PAYMENT POLICY REGARDING PROCEDURES FOR RELOCATION
PAYMENTS AND ASSISTANCE
Relocation assistance policy
The Palm Desert Redevelopment Agency wili provide all relocation assistance in accordance
with the State of California, Title 25, Housing and Community Development Guidelines ("Code"),
as amended. A copy of the Code is available at the City Clerk's office during normal operating
hours. Relocation resources shall be available to all displaced persons without discrimination.
Claims and supporfing documents for relocation assistance must be filed with the Agency within
18 months from the date the claimant moves from the acquired properfy
Relocation payment procedures
The filing and processing of claims will be as follows:
1. Claimant (s) will provide all necessary documentation to substantiate eligibility for
assistance.
2. Required claim forms wiii be prepared by relocation personnel in conjunction with
claimant(s). Signed claims and supporfing documentation will be submitted by
relocation personnel to the Agency.
3. The Agency will review and approve claims for payment or request additional
information as necessary.
4. The Agency will issue relocation assistance checks for pick-up by PMC at the Agency
offices, unless circumstances dictate otherwise.
5. Final payments will be issued after confirmation that the Project area premises have
been completely vacated, and actual residency after replacement unit is verified.
6. Receipts of payments will be maintained in the relocation case file.

ATTACHMENT 7: APPEALS POLICY AND PROCEDURES
The appeals policy will follow the standards described in Section 6150 et seq. of the Guidelines
as modified by the Paim Desert Redevelopment Agency's Relocation Assistance and Real
Properfy Acquisition Guidelines. Briefly stated, the displaced household will have fhe right to ask
for review when there is a complaint regarding any of its rights to relocation and relocation
assistance, such as a determination as to eligibility, the amount of payment, or the failure to
provide a comparable replacement housing referral. A copy of the City of Palm Deserf, Palm
Deserf Redevelopment Agency, and the Palm Desert Housing Authority's Relocation Assistance
and Real Property Acquisition Guidelines (Resolution 99-104, Ordinance 926A, Resolution HA-8,
Resolution HA-10, Resolution 383, Resolution 99-85, and Resolution 99105 is attached to this
Relocation Plan.

THE COMMISSIONERS OF "THE PALM DESERT HOUSING AUTHORITY
HEREBY FINDS, DETERMINES, RES�LVES AND ORDERS AS FOLLOWS:
SectiQn 1. The Palm Desert Housing Authority {the
��Authority") must provide relocation assistance and must make all
of the payments required by Chapter 16 (commencing with Section
7260) of Division 7 of Title 1 of the Government Code (the
"Act") , including the making of such payments financed by the
federal government. Section 7272.3 of the Act provides that the
Act shall not be construed Co limit any other authority which the
Authority may have to make other relocation assistance payments,
or to make any relocation assistance payment in an amount which
exceeds the maximum amount for such payment autharized by the
Act.
Section 2. The Department of Housing and Community
Deve2opment has adopted Relocation Assistance and Real Property
Acquisition Guidelines (Chapter 6 of Title 25 of the California
Code of Regulations Section, commencing with Section 6000) (the
"Guidelines") in order to implement and interpret the Act and to
assist public entities in the development of regulations and
procedures implementing the Act. Section 7267.8 of the Act
provides that all public entities must adopt rules and
regulations to implement payments an@ to administer relocation
assistance under the Act. Such rules and regulations must be in
accordance with the Guidelines. Section 6006 of the Guidelines
provides �hat such rules and regulations may prescribe additional
procedures and requirements that are appropriate to the
particular activities of the Authority and not inconsistent with
the Act . �
Section 3 . The Act has been amended from time to tirne.
The Guidelines were amended in 1997 to conform with changes in
the Act .
Section 4. The Authority desires to provide relocation
assistance and to make payments in accordance with the Act and
the Guidelines. Further, the Commissioners desire ta encourage

and expedite acquisition by agreements with property owners and
desires to minimize litigation and relieve congestion in the
courts. Based on the foregoing, the Authority hereby approves
and adopts the Guidelines, on file in the office of the Secretary

rules and regulations to implernent payments and to administer
relocation assistance undex the Act, subject to the following:
(a? If the Act or the Guidelines are amended
subsequent to the adoption of this Resolution, the Authority�s
rules and regulations are automatically amended to be consistent
with the Act and the Guidelines, as amended.
(b) Any reference in the Guidelines to '�public entity"
shall apply to the Authority unless the context requires
otherwise.
tc; Any reference in the Guidelines to the '�head of
the public entity" shall be deemed to be a reference to the
Chairmar. of the Authority or an impartial designee of the
Chairman.
(d) In accordance with Section 6032 of the Guidelines,
the Autho�ity will provide relocation advisory assisLance. The
relocation advisory assistance will satisfy the requirements of
Section 6040 of the Guidelines and be provided in accordance with
the provisions of Article 2 of tt�e Guidelines.
{e} In the event formal review and xeconsideration is
requested pursuant to Section 6158 of the Guidelines, the review
shall be conducted by the relocation appeals boazd established
pursuant to Health and Safety Code Section 33417.5, which
relocation appeals board shall proceed with respect to any appeal
in the manner and within the time frame seti forth in Section 6158
of the Guidelines.

Act and the Guidelines, the Authority may make any additional
relocation payments which in the Commissionex's opinion may be
� reasonably necessary under the circumstances of the particular

DETERMINES, RESOLVES AND ORDERS AS FOLLOWS:
Section 1. Pursuant to Health and Safety Code Section
33415, the Agency must provide relocation assistance and must
make aIl of the payments required by Chapter 16 (commencing with
Section 726d) of Division 7 of Title 1 of the Government Code
(the "Act°) , including the making of such payments financed by
the federal gavernment. Health and Safety Code Section 33415 and
Section 7272 .3 of the Act provide that Section 33415 and the Act,
respectively, shall not be construed to limit any other authority
which the Agency may have to make other relocation assistance
payments, or to make any relocation assistance payment in an
amount which exceeds the maximum amount for such payment
authorized by the Act.
Sectioz�_2. The Department of Housing and Community
DeveTopment has adopted Relocation Assistance and Real Property
Acquisition Guidelines (Chapter 6 of Title 25 of the California
Code of Regulations Section, commencing with Section 6000) (the
"Guidelines") in order to implement and interpret �he Act and to
assist public enLities ii� the development of regulations and�
pracedures implementing the Act. Section 7267.8 ot the Act
provides that all public entities must adopt rules and
regulations to implement payments and to administer relocation
assistance under the Act. Such rules and regulations must be in
accordance with the Guidelines. Section 6006 of the Guidelines
provides that such rules and regulations may prescribe additional
procedures and requirements that are appropriate to the
particular activities of the Agency and not inconsistent with the
Act.
Section 3. Th.e Act has been amended from time to time.
The Guidelines were amended in 1997 to conform with changes in
the Act.
Section 4. The Agency desires to provide relocation
assistance and to make payments with respect to the Agency
Project Areas in accordance with tne Act and the Guideli.nes.

Fuxther, the Agency desires to encourage and expedite acquisition
by agreements with property owners and desires to minimize
litigation and relieve congestion in the courts. Based on the
foregoing, the Agency hereby approves and adopts the Guidelines,
on file in the office of the Agency Secretary and incorporated
herein by reference, as its method for relocation required
pursuant to Health and Safety Code Section 33411 and as its rules
and regulations to implement paymen�s and to administer
relocation assistance under the Act, subject to the following:
(a) If the Act or the Guidelines are amended
subsequent to the adoption of this Resolution, the Agency's
method and rules and regulations are automa�ically amended to be
consistent with the Act and the Guidelines, as amended.
(b) Any reference in the Guidelines to "public entity"
shall apply to the Agency unless the context requires otherwise.
(c) Any reference in the Guidelines to �he "head of
the public entity" shall be deemed to be a reference to the
Executive Director of the Agency or an impartial designee of the
Executive Director.
(d) In accordance with Section 6032 of the Guidelines,
the Agency will provide relocation advisory assistance. The
relocation advisory assistance will satisfy the requirements of
Section 6040 of the Gui.del.ines and be provide� in accordance wi-th
the provisions of Article 2 of the Guidelines.
(e) In the event formal review and reconsideration is
requested pursuant to Section 6158 of the Guidelines, the review
shall be conducted by the relocation appeals board established
pursuant tQ Health and Safet.y Code Section 33417.5, which
relacation appeals board shall proceed with respect to any appeal
in the manner and within the time frame set forth in Section 6158
of the Guidelines.
{�} No persons or families of low or moderate income
shall be displaced unless and until there is a suitable housing
unit available and ready for occupancy by such displaced person
or family at rents comparable to those at the time of their
displacement. Such housing units shall be suitable to the needs
of such displaced persons or families and shall be decent, safe,

sanitary, and otherwiae standard dwellings. The Agency shall not
displace such persons or families until such housing units are
available and ready for occupancy.
(g) In addition to making the payments required by the
Act and the Guidelines, the Agency may make any additional
relocation payments which in the Agency's opinion may be
reasonably necessaxy under the circumstances of the particular
case to carry out the purposes of redevelopment and to further
the goals of the Agency set forth herein.
Section 5. Resolution No. 90 of the Agency, including
all amendments and modifications thereto, and any other prior
method or plan required pursuant to Health and Safety Code
Section 33411 and any prior rules and regulations required to
implement payments and to administer relocation assistance under
the Act prepared, approved or adopted are hereby superseded by
the method and rules and regulations approved and adopted by this
Resolution, provided that the method and rvles and regulations
approved and adopted by this Resolution shall not be construed to
retroactively apply to actions undertaken by the Agency prior to
the effective date of this Resolution.
