Commission Recommendation On January 5, 2010 the Parks and Recreation Commission voted unanimously to approve the Mid-Valley Bike Path Alignment Study. Backqround The proposed Mid-Valley Bike Path consists of the construction of approximately 6.5 miles of a Class I bicycle path along the City's northern limits adjacent to the Union Pacific Railroad (UPRR) right-of-way. In September 2007, the City was awarded a federal Congestion Mitigation and Air Quality (CMAQ) grant for the Mid-Valley Bike Path Project in the amount of $3 million. On September 29, 2008, the CVAG Executive Committee approved deprogramming $800,000 of CMAQ funds from the Mid-Valley Bike Path Project to fund a Sun�ine street sweeping funding shortfall. On September 25, 2008, Council awarded a contract in the amount of $88,598 to RRM Design Group for the Mid-Valley Bike Path Alignment Study that has been recently completed. The attached Alignment Study identifies the preferred location of the proposed bike path generally running adjacent to the UPRR along the northern City limits, with alternatives at locations where there are anticipated issues with the proposed bike path alignment. These locations primarily consist of limited space due to the location of adjacent roadway, private property, and the UPRR right-of-way. There are several proposed alternatives at these locations, but until a field survey and 30 percent design are performed to determine the exact location of property lines and tentative location of the bike path, no overall definitive alignment can be determined. Staff Report Completion of the Mid-Valley Bike Path Alignment Study February 11, 2010 Page 2 of 3 Now that the Alignment Study has been completed with the various alternatives, the next step is for staff to issue a RFP to begin the 30 percent design and environmental clearance of the project. With the preferred alignment as shown in the Alignment Study, the City currently owns approximately 15,000 lineal feet of the proposed bike path. The City will need to acquire approximately 4,250 lineal feet of a 15-foot wide right-of-way from the UPRR, and approximately 12,700 lineal feet of a 15-foot wide easement from private property owners. No right-of-way may be acquired until the project has received environmental clearance. The Mid-Valley Bike Path is currently not included in the City's General Plan. However, staff is proposing that the Mid-Valley Bike Path be added to the General Plan, which will also require approval of the Planning Commission. Staff intends to bring the General Plan Modification before Council along with the award of the design contract for the Mid- Valley Bike Path. The modification of the General Plan and completion of environmental clearance will allow the City to condition developments to construct portions of the bike path and allow staff to seek additional grant funding. Fiscal Analvsis . There is no immediate fiscal impact. However, once design proposals are reviewed and a consultant is selected, staff will recommend the award of a design and environmental contract to the most qualified consultant. The total estimated cost of the project has increased by approximately $2.5 million. This increase is primarily due to the substantial increase in the cost of right-of-way acquisition. The increase in right-of-way cost is due to the fact that staff had originally assumed that easements would be able to be acquired from developers as conditions of development, but that development has not occurred. After meeting with UPRR staff, City staff understands that the property would have to be purchased for the construction of the bike path since UPRR's policy is not to grant easements along their right-of-way because of liability concerns. Staff Report Completion of the Mid-Valley Bike Path Alignment Study February 11, 2010 Page 3 of 3 On December 7, 2009, the CVAG Joint Meeting of the Transportation and Executive Committees "earmarked" an additional $1.1 million from the next call for CMAQ projects for the Mid-Valley Bike Path. Since these monies have not yet been allocated, they are not included in the above cost estimate. Although, $5,705,000 of the total project cost is currently unfunded, staff is recommending proceeding with the project utilizing various alternatives to ensure construction of the project with the available funds. These alternatives include: diverting the bike path onto Tamarisk Row to eliminate the potential UPRR right-of-way purchase, construction of portions of the bike path on City owned property only, and phasing the construction to match the available budget. The exact cost of the each phase cannot be determined until the City has verified the existing right-of-way, which will be verified with the 30 percent design. Funds in the amount of $400,000 are budgeted in the FY 2010 Capital Budget Reserve Account 400-4544-433-4001 to complete design of the bike path. The additional funds needed for right-of-way acquisition and construction are currently unfunded in the City's budget. Therefore, staff proposes to proceed with 30 percent design, and environmental clearance, and include the Mid-Valley Bike Path in the City's General Plan. This will allow the City to seek additional grants and funds. Final design, right-of-way acquisition, and construction of the bike path will be phased as funds become available.
