Upon Council consideration, direct staff to approve or deny the proposed temporary use. Backqround On December 4, 2009, Tabares Entertainment Inc., submitted an application for a Temporary Use Permit to operate Circus Vargas on the dates January 26 — 31, 2010 at the Westfield Mall. Staff distributed the application to various departments for comments. On December 9, 2009, the Director of Community Development sent a letter to the applicant that stated that this application would not be approved over-the-counter. Staff discussed the information contained in the letter with the applicant, who decided to appeal the Director's decision to City Council. The event is proposed at the Westfield Mall on the south side, visible from Highway 111 and Monterey Avenue. The exact event location is directly north of the vacant restaurant building located on the southeast corner of Westfield's property, formerly the Macaroni Grill. Site plans and tent layouts are provided for further clarification of the location. The typical event set up is illustrated in an attached photo, along with the description of the event. No games of chance, rides, or pertorming animals will be a part of Circus Vargas. Also, no alcohol wilf be sold or served and no outside contracted vendors will be aliowed at the event. The Tabares Entertainment event provides shows aimed primarily at a family oriented audience. Staff Report Approval of Circus Vargas at Westfield Page 2 of 2 January 14, 2010 Staff requested that the applicant look into other possible locations, but the applicant reports that they were requested by the Westfield organization to play at their Palm Desert property. The applicant has stated this has been a request of Westfield for several years, and it happened to fit into their schedule this year. Due to the late addition of this location, and at the request of the Westfield organization, the applicant does not intend to play at any other Coachella Valley location, even if not approved here. The City Council previously directed staff not to approve TUP's for automobile sales in this location at Westfield between Thanksgiving and Easter, but has recently shown a willingness to relax this standard. Staff is concerned that the circus set up at this highly visible location could be detrimental to the surrounding shopping district and office professional uses during the peak season by creating a visual distraction, traffic, and parking congestion. However, staff is also mindful that Westfield is an important partner with the City in the generation of sales tax, and recognizes the importance in accommodating their requests when practicable. Staff is requesting that City Council provide direction on the proposed Temporary Use Permit to operate Circus Vargas on the dates and location requested. If approved, the applicant would be required to obtain a Daily City Business License and provide proof, to the satisfaction of the Director of Finance, that a Combined 1% State and Local Tax Allocations for Temporary Sales Locations form has been filed with the State of California Board of Equalization. Fiscal Analvsis Fiscal impact regarding the approval of the Temporary Use Permit for Circus Vargas is minimal. Circus tickets are not considered tangible and are therefore not taxable. However novelty items, merchandise and food concessions sold at the event are taxable, according to Regulation 1501 of the Sales and Use Tax Regulations. The City of Palm Desert would receive minimal fiscal benefit from the proposed event due to sales of these event-associated items, and potentially incidental business sales as people pass through the city on the way to or from the event. After our discussion and your clarification on circuses vs. carnivals, I discussed your event with the City Manager. At this time, it is our opinion that we need to receive #urther direction from the City Council. Planning Department staff has rauted your submitted information to Public Works, �ire, Suilding and Safety, and the Sheriff's Departments. Whi1e I am not wilVing to approve your application as an over-the-counter routine application, Ms. Grisa has informed me that you have requested, in writing, vie e-mail, to appeaf this process to the City Council after your discussion with her yesterday regarding the results of my meeting with the City Manager.
