Recommendation
By Minute Motion, accept the Cal COPS Supplemental Law Enforcement
Services Funding (SLESF) grant award of $100,000 to cover the cost for the
2009 Holiday Theft Suppression Program and the acquisition of necessary
equipment, services and supplies to support front line law enforcement
services.
Commission Recommendation
On December 9, 2009, the Public Safety Commission recommended approval to accept
the SLESF grant award of $100,000 to cover the cost for the 2009 Holiday Theft
Suppression Program and the acquisition of necessary equipment, services and
supplies to support front line law enforcement services.
Executive Summary
The City of Palm Desert is eligible to receive $100,000 in Cal COPS Supplemental Law
Enforcement Services Fund (SLESF) grant funding for FY 2009/2010. The purpose of
the Cal COPS SLESF grant is to provide funds to local government for underwriting
projects to reduce crime and improve public safety. The State of California (AB1913)
via the Riverside County SLESF Oversight Committee administers the program.
In order for the City of Palm Desert to accept the available funding, an Expenditure Plan
for the proposed use of these funds must be prepared and submitted to the Riverside
County SLESF Oversight Committee. The Palm Desert Police Department proposes
that this funding be used to cover the staffing cost for the 2009 Holiday Theft
Suppression Program and the acquisition of necessary equipment, services and
supplies to support front line law enforcement services.

Backqround
Holiday Theft Suppression Program
The Palm Desert Police Department implemented the 2009 Holiday Theft Suppression
Program starting on Friday, November 27, 2009, and concluding on Saturday, January
2, 2010. The program was staffed with overtime officers working seven days a week,
between the hours of 11:00 A.M. - 9:00 P.M. Officers patrolled on a combination of
bicycles and Segway Electric Personal Assistance Mobility Devices in the City's main
business district corridor. There was also one officer in a police car patrolling the
northern sphere per overtime shift. This program increased the number of officers in
the field and focused on high visibility patrol and theft suppression during peak shopping
hours and days.
This annual program's purpose is to conduct high visibility patrols in the retail and
commercial areas of the City of Palm Desert. This region includes the Highway 111
business corridor, the EI Paseo business district, Westfield Shoppingtown Palm Desert,
and any other business complexes in the immediate area. The program also included
high visibility patrols in the adjoining residential areas of the aforementioned locations,
pro-active citizen contacts, the issuance moving and parking citations, as well as verbal
warnings.
The deputies assigned to this program handle radio calls for routine reports and arrests,
particularly calls involving theft and other business related crime in the focus area, and
enforce on-sight violations of any nature. The program also included one patrol vehicle
that provided extra patrol in the CostCo and WalMart complexes. It is estimated that this
program cost approximately $35,000 for approximately 600 hours of extra patrol
services to be funded completely out of the SLESF grant.
Equipment, Service, and Supplies
The Palm Desert Police Department also recommends committing $40,000 to
necessary equipment purchases such as computers, technology, and support
apparatus for patrol, traffic, and special team staff.
The remaining $25,000 is recommended to be spent on miscellaneous services and
supplies. These items typically have included, but are not limited to, the following: 1)
cellular phones and service, 2) bicycle maintenance, 3) rental cars, 4) training
conferences, 5) Segway service, etc. These expenditures are usually expected, routine
and are typically paid monthly.
The Cal COPS (SLESF) grant, allowed the Palm Desert Police Department to
successfully implement and complete the 2009 Holiday Theft Suppression Program and
assists in purchasing necessary equipment, services and supplies to support the City's
front line law enforcement services. Therefore, staff recommends approval to accept
this grant award in the amount of$100,000.

If the City Council concurs with Public Safety Commission and staff's recommendation,
the City of Palm Desert will accept a Cal COPS Supplemental Law Enforcement
Services Funding (SLESF) grant award of $100,000. The SLESF Expenditure Plan

B. Recommendation to accept Cal COPS Supplemental Law

Chair Nethery stated that this was a new Cal COPS Grant Award.

I Upon inquiry by Commissioner Butzbach, Lt. Shouse stated that
i the State has committed to fund the Cal COPS Program for this
jfiscal year.

� Commissioner Butzbach moved to, by Minute Motion, recommend staff to concur
with the Police Department's proposal and that the City Council accepts the Cal COPS
Grant of $100,000. Motion was seconded by Commissioner Kirkwood and carried by a
5-0 vote.

C. Pool Safety Act (H&S Code Section 155920).
Stephen Aryan introduced Russell Grance the City's Building &
Safety Director to the Commissioners.
Upon inquiry by Commissioner Lebel, Russell Grance did not
believe that there would be a fiscal impact because under current
state law, homeowners would have to select one of the seven
safety features. Mr. Grance's proposed amendment was to
eliminate three of the seven features. If any homeowner installs
any one of the three features (being eliminated) they do nothing to
protect children. The picture depicted in the staff report shows an
installation in Palm Desert Greens wherein a homeowner opted to
instalt door locks and no barrier around the swimming pool.
Anyone could enter the backyard and fall into the pool. He believed
that when the Legislature passed AB 2977, they tried to create
building codes and in that effort they made a mistake. If you look at
the building codes prior to the implementation of AB 2977, they all
required barriers of some kind around the pool. Mr. Grance was
aware that the City had several ordinances dating back to 1981, the
most recent being Ord. 1024, which allowed homes in golf
communities to maintain views by not requiring any barriers around
swimming pools.
Mr. Grance's opinion was that this sets the City up for having two
separate safety standards for children and a potential lawsuit in the
event there is a drowning. He believed that among the seven safety
features there were three that do no service for child safety. His
goal was to eliminate those three features, have the option of
having a barrier at the property line and if the dwelling was part of
the barrier alarms would need to be installed on the doors or have
isolation fencing, which is removable so the homeowner can
