PROGRAM (OPP) APPLICATION (1ST CYCLE) TO CALRECYCLE

By Minute Motion, authorize the following:
1. Ratification of staff submittal of the 2010/11 Used Oil Payment Program
(OPP) Application (1St Cycle) to CalRecycle; and
2. Expenditure of awarded funds from Recycle Fund, Account No. 236-4195-
454-3090.
Discussion
In September 2009, the Governor signed SB546 (Lowenthal) making significant
changes to the California Oil Recycling Enhancement Act. As part of these changes,
the California lntegrated Waste Management Board was dissolved, and the California
Department of Resources Recycling and Recovery (CalRecycle) was created.
CalRecycle has since changed the Used Oil Block Grant (UBG) Program to the Used
Oil Payment Program (OPP) of which FY 2010/2011 will be the first grant cycle. As a
result, a new resolution separating the Used Oil Payment Program (OPP) from other
diversion programs is required. In addition to this change, CalRecycle has implemented
an on-line application process that is more streamlined and efficient. Since most of the
jurisdiction's information is already entered under the new program's process, staff is
only required to submit the on-line application.
While the City of Palm Desert is eligible to receive an allocation through the FY 2010/11
Used Oil Payment Program (OPP), the actual award amount will not be known until the
State approves its annual budget. As such, CalRecycle suggested that jurisdictions
base the FY 2010/11 OPP award amount on the amount awarded for the FY 2009/10
Used Oil Block Grant (15t" Cycle) which was $6,953.00. Given that the FY 2010/11

OPP application deadline was June 30, 2010, staff has already submitted the on-line
application.
Therefore, staff requests City Council ratification of the FY 2010/11 Used Oil Payment
Program (OPP) application submittal, approval of Resolution, and expenditure of funds.
Fiscal Analvsis
Funding for services and other activities relative to the City's Recycle Program was
included as part of the FY 2010/11 Budget process. Funds are available within the
Recycle Fund, Account No. 236-4195-454-3090.

RESOLUTION NO. 2010-59
RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF PALM DESERT AUTHORIZING USED OIL
PAYMENT PROGRAM APPLICATIONS TO
CALRECYCLE
WHEREAS, pursuant to Public Resources Code § 48690 the Department
of Resources Recycling and Recovery (CalRecycle), formerly known as the
California lntegrated Waste Management Board, has established the Used Oil
Payment Program (OPP) to make payments to qualifying jurisdictions for
implementation of their used oil programs; and
WHEREAS, in furtherance of this authority CalRecycle is required to
establish procedures governing the administration of the Used Oil Payment
Program; and
WHEREAS, CalRecycle's procedures for administering the Used Oil
Payment Program require, among other things, an applicant's governing body to
declare by resolution certain authorizations related to the administration of the
Used Oil Payment Program.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Palm Desert authorizes the following:
1. Submittal of a Used Oil Payment Program applications to CalRecycle; and
2. That the Director of Special Programs, or his/her designee, is hereby
authorized and empowered to execute in the name of the City of Palm Desert all
documents, including but not limited to, applications, agreements, annual reports
including expenditure reports and amendments necessary to secure said
payments to support our Used Oil Collection Program; and
3. That this authorization is effective until rescinded by the City Council of the
City of Palm Desert.
