No. 22 CITY OF PALM DESERT OFFICE OF THE CITY MANAGER STAFF REPORT REQUEST: ADOPT A RESOLUTION OF THE CITY COUNCIL OF PALM DESERT, CALIFORNIA, DECLARING ITS SUPPORT FOR THE LOCAL TAXPAYER, PUBLIC SAFETY, AND TRANSPORTATION PROTECTION ACT (PROPOSITION NO. 22) SUBMITTED BY: Gary Rosenblum, Risk Manager DATE: July 8, 2010 CONTENTS: Resolution No. 2010- 60 Recommendation By Minute Motion, waive further reading and adopt. Committee Recommendation The Legislative Review Committee typically does not provide a recommendation on any voter decided measure. However, given the current economic climate and intent of Proposition 22 to prevent any loss of future city/redevelopment agency revenues, staff respectFully recommends the City Council adopt this resolution supporting the Local Taxpayer, Public Safety, and Transportation Protection Act. Back4round On December 23, 2009, a coalition, which includes the League of California Cities and local government transportation and public safety leaders, began collecting the 694,354 signatures required to place a measure, the Local Taxpayer, Public Safety, and Transportation Protection Act, on the November 2010 statewide ballot, Enough signatures were obtained to have this initiative placed on the November 2010 ballot as Proposition 22. Proposition 22 is titled, "Prohibits the State from Taking Funds Used for Transportation or Local Government Projects and Services: Initiative Constitutional Amendment." The purpose of the proposition is to close loopholes and change the California State Constitution to prevent the State government from seizing, diverting, shifting, borrowing, transferring, suspending or otherwise taking or interFering with tax revenues dedicated to funding local government services. These revenues include those funds associated with redevelopment agencies, or dedicated to transportation improvement projects and mass transit. Staff Report Resolution No. 2010- 60 , Support of Proposition 22 July 8, 2010 Page 2 of 2 This fiscal year, the Palm Desert Redevelopment Agency was required to remit $25.5 million to the State for the purpose of reducing the State's budget shortfall. If this proposition is passed by state voters in November, the State will not be able to require the Redevelopment Agency or any other municipal entity to remit funds that have been acquired for valid municipal purposes such as transportation projects, public safety and redevelopment. Fiscal Analvsis There is no direct fiscal impact to the City associated with approval of this resolution. However, if Proposition 22 is passed by the voters, it would close loopholes and changes the State Constitution to further prevent the California Legislature from seizing, diverting, shifting, borrowing, transferring, suspending, or otherwise taking or interfering with tax revenues dedicated to funding local government services, including those associated with redevelopment, or dedicated to transportation improvement projects, and mass transit.
