Recommendation
By Minute Motion, approve waiver of business license requirement for speakers that
provide presentations to the Community Gardens Group, Youth Committee, and Citizens
on Patrol.
Discussion
As part of the Special Programs Department's efforts to educate members of the Community
Gardens, Youth Committee, and Citizens on Patrol, staff works with various individuals to
schedule presentations and lectures for the individual groups. Individuals selected to speak
have personal knowledge and experience relative to a specific topic of interest pertaining to the
groups and as a courtesy are paid a small stipend to cover time, travel, and preparation of
materials associated with the presentation. These individuals are not in business, but rather
have volunteered to conduct presentations to the respective groups based on their personal
knowledge and expertise.
According to the Palm Desert Municipal Code, Title 5, Business Taxes, Licenses, and
Regulations, all businesses except those activities identified as exemptions are required to
obtain a City business license. Since the speakers are not providing services related to a
charitable, religious, or other similar activity, they are not identified as an exemption. Staff is
therefore requesting that City Council waive the business license requirement to accommodate
those speakers that provide presentations to the above groups.
