HomeMy WebLinkAboutAB 1607 - Public HousingCITY OF PALM DESERT CITY MANAGER'S OFFICE STAFF REPORT REQUEST: CONSIDERATION OF LEGISLATIVE REVIEW COMMITTEE ACTION ON AB 1607 (KNIGHT) AT ITS MEETING OF FEBRUARY 23, 2010 DATE: March 11, 2010 CONTENTS: AB 1607 Language Recommendation By Minute Motion, concur with the action taken by the Legislative Review Committee at its meeting of February 23, 2010, and direct staff to prepare a letter of support for the Mayor's signature with regard to AB 1607 (Knight) relative to public housing. Background Existing law provides that anyone who defrauds a housing program of a public housing authority of more than $400 is guilty of grand theft. This bill would provide, in addition, that any public housing authority may require that any application or document filed with the public housing authority be signed and submitted under penalty of perjury. By expanding the crime of perjury, this bill would impose a state - mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act fora specified reason. Section 487i of the Penal Code is amended to read: 487i. (a) Any person who defrauds a housing program of a public housing authority of more than four hundred dollars ($400) is guilty of grand theft. (b) Any public housing authority may require that any application or document filed with the public housing authority be signed and submitted under penalty of perjury. SEC. 2. No reimbursement is required by this act pursuant to Section 6 of Article XIII B of the California Constitution because the only costs that may be incurred by a local agency or school district will be incurred because this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIII B of the California Constitution.
