REQUEST: STREAMLINE THE USE OF VARIOUS VENDORS AND
QUALIFIED SERVICES BY APPROVING THE ABATEMENT
SERVICES VENDORS LIST, AND GRANTING EXCEPTION TO
BIDDING REQUIREMENTS AS PROVIDED FOR BY SECTION
3.32.090 OF THE PALM DESERT MUNICIPAL CODE FOR FISCAL
YEAR 2009-2010, AND FISCAL YEAR 2010-2011

Recommendation
1. By Minute Motion, approve and authorize staff to use vendors on the Abatement
Services Vendors List appended to this report; and
2. Grant exception to bidding requirements as provided for by Section 3.32.090 of the
Municipal Code for Fiscal Year 2009-2010 and Fiscal year 2010-2011.
Backqround
The Code Compliance Division utilizes a variety of abatement contractors regularly
throughout the year. In order to create a pool of qualified, cost effective vendors to use,
the Code Compliance staff posted the vendor list and an invitation to be added to it.
Subsequent to this posting, staff compiled a list of vendors and service providers
capable of offering immediate service depending upon the conditions and health and
safety circumstances of a residential property. Approval of the use of these providers
allows the City to save money and time, thereby providing for more efficient operations
and cost savings. The approval of the list will simplify the process to acquire the
services as needed.
Section 3.32.090 of the Palm Desert Municipal Code exempts emergency situations
that threatens the "public health, welfare or safety" from the bidding process. Code
Compliance utilizes this section (including the authority granted in chapter 8.20, Public
Nuisances) to address urgent situations that require expedited abatement to protect the
public health and safety.

These situations include green, stagnate pools that have been found to propagate the
deadly West Nile Virus; odorous, decaying items that include household trash and other
offensive material that is in close proximity to the public; abandoned vehicles that may
be placed precariously on blocks or leaking large amounts of fluids onto the ground;
excessively dry weeds and other plant matter that is determined to pose a potential fire
hazard to surrounding properties; beehives that are found by virtue of their location to
be an immediate threat to surrounding residents and pedestrians; and other related
situations that may adversely affect the health and safety of the public. On any
questionable situation, the City Attorney is consulted.
Approval of the staff recommendation will ensure that vendors that exceed a cumulative
amount of $10,000 during the course of a year can continue to provide contractor
abatement services to the City at the lowest bid, and are on the abatement services
vendors list. Purchases and/or services valued at more than $25,000 will follow the
standard procedure for procurement. Staff, therefore, requests that City Council
approve the use of these vendors and services for the 2009-2010, and 2010-2011 fiscal
year.
