Award Contract No. c29780 for design services for the Fred Waring Drive and Monterey Avenue improvement project to Kimley-Horn and Associates, Inc., of Riverside, California, in the amount of $271,200; and 2. Authorize the Mayor to execute the subject agreement. Funding is available for this project in Account No. 213-4383-433-4001, Fred Waring Drive and Monterey Avenue Turn Pockets. No General Fund money is being used for this expenditure. Back�round In order to improve traffic flow on Fred Waring Drive and alleviate traffic congestion on Monterey Avenue, it is proposed to increase the number of lanes along Monterey Avenue and add various turn pockets on Fred Waring Drive. Turn pockets will be provided as follows: a right turn pocket at the entrance to the Civic Center from Staff Report Award contract to Kimley-Horn &Associates, Inc. May 27, 2010 Page 2 of 3 westbound Fred Waring Drive; from northbound San Pablo Drive to eastbound Fred Waring Drive; and a free right turn from westbound Fred Waring Drive to northbound Monterey Avenue. Monterey Avenue will be widened to four northbound lanes from Fred Waring to Park View Drive, three northbound lanes from Park View Drive to Magnesia Falls and three southbound lanes from the City Limits to Park View Drive. In addition, storm drain improvements will be made on Monterey Avenue from Fred Waring Drive to the Whitewater Channel and sliver widening of westbound Fred Waring just west of San Pablo to eliminate a slight skew through the intersection will be constructed. To accommodate these improvements and traffic patterns within the project limit, two existing bus stops will become bus turnouts, and the landscaping within the project limit will be modified as required. A Notice Inviting Proposals was advertised and staff solicited proposals for design services. On March 9, 2010, staff received eight proposals for the project. A proposal review committee comprised of staff numerically ranked the proposals in the areas of qualifications of the firm and its personnel, management approach, technical approach to this particular project, and overall completeness of the proposal. The staff review committee selected the following three highest-ranked firms for interviews: Firm Location Kimley-Horn and Associates, Inc. Riverside, CA Harris & Associates Palm Desert, CA Albert Webb & Associates Palm Desert, CA Interviews were conducted on April 9, 2010. Kimley-Horn and Associates, Inc., received the highest score when combining the results from both the proposal and the interview. The firm submitted an excellent proposal that demonstrated thorough knowledge of the project, had a very comprehensive analysis, and offered solutions/alternatives to key project issues for road geometrics, traffic, and right-of-way acquisition. The firm also had an excellent presentation and responded very well to questions during the interview. Kimley-Horn and Associates, Inc., has successfully designed similar but larger projects for the City very effectively. Their team includes sub-consultants located in Palm Desert. After the interviews, the short-listed firms submitted cost proposals. The cost proposals were scored based on a relative deviation (plus or minus) from the City's cost estimate. Kimley-Horn and Associates, Inc., had the lowest cost proposal of the short-listed firms. Each short-listed firm also received a location score based on the location of the firm and their sub-consultants. The cost and location scores were factored into each firm's overall score. Based on the overall score, Kimley-Horn and Associates, Inc., was selected as the preferred consultant. Staff proceeded to negotiate the scope and cost estimate based on the proposal received. Therefore, staff is confident in the value being received and Staff Report Award contract to Kimley-Horn &Associates, Inc. May 27, 2010 Page 3 of 3 recommends that City Council, by Minute Motion, award the contract for design services for this project to Kimley-Horn and Associates, Inc., in the amount of$271,200. Fiscal Analvsis: The City will use Local Measure A funds to fund the project. The overall project cost is estimated to be approximately $3,122,710, with design costs of $271,200 and construction costs estimated at $2,851,510. Wohlmuth, City Manager Original on File with City Clerk's Office � Contract No. c29�so AGREEMENT THIS AGREEMENT, made and entered into this 27th day of Mav , 2010, by and between THE CITY OF PALM DESERT, a municipal corporation, hereinafter referred to as "CITY" and Kimlev-Horn and Associates. Inc., hereinafter referred to as "CONSULTANT". WITNESSETH: WHEREAS, CONSULTANT is a corporation, the principal members of which are Professional CONSULTANTS duly registered under the laws of the State of California; and WHEREAS, CITY desires to engage CONSULTANT to render certain technical and professional services as set forth in Exhibit "A" (CONSULTANT'S Proposal of Services) in connection with the design of Fred Warina Drive and Monterev Avenue Improvement Proiect. NOW, THEREFORE, the parties hereto agree as follows: (1) CITY hereby agrees to engage CONSULTANT to perform the technical and/or professional services as hereinafter set forth. (2) CONSULTANT shall perform all work necessary within the schedules provided herein to complete the services set forth in Exhibit "A" attached hereto and by reference incorporated herein and made a part hereof. (3) All information, data, reports and records and maps as are existing and available from the CITY and necessary for the carryings out of the work outlined in Page 1 of 7 Contract No. c29�8o Exhibit "A" hereof shall be furnished to CONSULTANT without charge by CITY and CITY shall cooperate in every way reasonable in the carrying out of the work without delay. (4) CONSULTANT represents that, it employs or will employ at its own expense, all personnel required in performing the services under this Agreement. (5) All of the services required hereunder will be performed by CONSULTANT or under its direct supervision, and all personnel engaged in the work shall be qualified and shall be authorized or permitted under state and local law to perForm such services. (6) The execution of this Agreement by the parties hereto does not constitute an authorization to proceed. CITY's Director of Public Works has not authorized CONSULTANT to proceed. (7) The CONSULTANT shall work closely with the CIN's Director of Public Works, or his designated representative, who shall be the principal o�cer of the CITY. The CONSULTANT shall review and receive the Director of Public Works approval of the details of work as it progresses. The Registered Civil CONSULTANT hereby designated by the CONSULTANT as its representative for supervision of the work required by this Agreement is Scott Colvin, R.C.E. No. 69464. (8) The CONSULTANT warrants that he has not employed or retained any company or person, other than a bona fide employee working solely for the consultant, to solicit or secure this Agreement, and that he has not paid or agreed to pay any company or person, other than a bona fide employee working solely for the Page 2 of 7 Contract No. c29�so consuitant, any fee, commission, percentage, brokerage fee, gifts, or any other consideration, contingent upon or resulting from the award or making of this Agreement. For breach or violation of this warranty, CITY shall have the right to annul this Agreement without liability or in its discretion to deduct from the contract price or consideration, or otherwise recover, the full amount of such fee, commission, percentage, brokerage fee, gift or contingent fee. (9) The right is reserved by the CITY to terminate the Agreement at any time upon seven (7) days written notice, in the event the project is to be abandoned or indefinitely postponed, or in the event the GONSULTANT'S services, in the sole judgment of CITY, are unsatisfactory or because of the CONSULTANT'S failure to prosecute the work with diligence or within the time limits specified or because of his disability or death. In any such case, the CONSULTANT shall be paid the reasonable value of the services rendered, based upon CONSULTANT'S standard hourly rates, up to the time of the termination. The CONSULTANT shall keep adequate records to substantiate costs and provide copies of original timecards in the event of termination or suspension. (10) All documents including tracings, drawings, estimates, reports, investigations and computations shall be delivered to and become the property of the CITY. CITY acknowledges and agrees that all plans, specifications, reports and other design documents prepared by CONSULTANT pursuant to this agreement shall be used exclusively on this project and shall not be used for any other work without the written consent of CONSULTANT. In the event CITY and CONSULTANT permit the re- use or other use of the plans, specifications, reports or other design documents, CITY Page3of7 Contract No. c297so shall require the party using them to indemnify and hold harmless CITY and CONSULTANT regarding such re-use or other use, and CITY shall require the party using them to eliminate any and all references to CONSULTANT from the plans, specifications, reports and other design documents. (11) The CONSULTANT shall comply with all federal, state and local laws, ordinances and regulations applicable to work. (12) No change in the character or extent of the work to be performed by the CONSULTANT shall be made except by supplemental authority in writing between CITY and the CONSULTANT. The supplemental authority shall set forth the changes of work, extension of time and adjustment of the fee to be paid by CITY to the CONSULTANT, if any. (13) In connection with the execution of this Agreement, the CONSULTANT shall not discriminate against any employee or applicant for employment because of race, religion, color, sex or national origin. The CONSULTANT shall take affirmative actions to insure equal employment opportunity and that employees are treated, during their employment, without regard to their race, religion, color, sex or national origin. Such actions shall include, but not limited to, the following: employment, upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay, or other forms of compensation and selection for training, including apprenticeship. This clause shall be included in each related subcontract, if any, awarded by the CONSULTANT. Page 4 of 7 Contract No. c29�so (14) The CITY agrees to pay the CONSULTANT for the work required by this Agreement on the foliowing basis: CONSULTANT shall submit invoices monthly for services performed in the previous month not to exceed the total contract amount of: 271 200 (Two Hundred Seventv One Thousand. Two Hundred Dollars: 00/100 ONLYI. CITY agrees to pay all undisputed invoices within thirty (30) days of receipt of invoice. CITY agrees to notify CONSULTANT of disputed invoices within fifteen (15) days of receipt of said invoice. (15) The CONSULTANT agrees to complete the work and submit the Final Design as displayed in Exhibit "A". (16) In the event that any judgment is entered in any action upon this Agreement, the party hereto against whom such judgment is rendered agrees to pay the other party an amount equal to the reasonable value of the legal services performed in his or its behalf in such action and that such amount may be added to and made a part of such judgment. (17) This Agreement shall be binding on the successors and assigns of the parties, but it shall not be assigned by the CONSULTANT without written consent of the CITY. (18) The CONSULTANT shall be an independent contractor, not an employee of the CITY. (19) Prohibited interests are as follows: Page 5 of 7 Contract No. c29�so No officer, member or employee of the CITY during his tenure or one year thereafter shall have any interest, direct or indirect, in this Agreement or the proceeds thereof. The parties hereto covenant and agree that to their knowledge no member of the City Council, officer or employee of the CITY has any interest, whether contractual, non-contractual, financial or otherwise, in this transaction, or in business of the contracting party other than the CITY, and that if any such interest comes to the knowledge of either party at any time a full and complete disclosure of all such information will be made in writing to the other party or parties, even if such interest would not be considered a conflict of interest under applicable laws. The CONSULTANT hereby covenants that he has, at the time of this Agreement, no interest, and that he shall not acquire any interest in the future, direct or indirect, which would conflict in any manner or degree with the performance of services required to be performed pursuant to this Agreement. The CONSULTANT further covenants that in the performance of this work no person having any such interest shall be employed by the CONSULTANT. (20) The CONSULTANT shall indemnify and save harmless the CITY, its officers and employees from and against any liability, loss, cost or expense resulting from any injury or damage to persons or property arising out of, pertaining to, or relating to the negligence, recklessness, or willful misconduct of the CONSULTANT, its agents or employees, while engaged in the performance of this Agreement. The CONSULTANT shall submit to CITY, prior to the issuance of the Notice to Proceed, certification of adequate coverage for "errors and omission" insurance in amounts Page 6 of 7 Contract No. �2A��o approved by the City Attorney. Any such insurance shali not be canceled prior to written notice to and approval from the CITY. (21) The City shall not be responsible for payment for services by the Consultant that are directly related to addressing discrepancies, errors, omissions, ambiguities, etc. in the plans, specifications, and estimates prepared by the consultant. (22) In case of conflicts within the contract documents, the document precedence shall be as follows: (a} This Agreement; (b) Exhibit "A" (CONSULTANT'S Proposal of Services, and any written modifications thereto). ("KHA"ar"the Consultant") is pleased to submit this letter agreement (the "Agreement") to City of Palm Desert ("the Client") for providing Engineering Services. Our project understanding, scope of services, schedule,and fee are below. PROJECT UNDERSTANDING Roadwa,�provements l. Construction of a right turn pocket from westbound Fred Waring Drive to the Civic Center entrance 2. As directed by the City of Palm Desert, the construction of a right turn pocket along northbound San Pablo Avenue from Santa Rosa Way to Fred Waring Drive may be included within the project scope (see Tasks 1.6b, 2.1 b and 3.1 b) 3. Nuisance flow sources will also be identified with alternatives for interception and conveyance presented in the report. 2. Improvements are assumed to include the installation of a stonn drain pipe from the intersection of Monterey Avenue and Fred Waring Drive to an existing 96" pipe located at the intersection of Monterey Avenue and Gran Via. The design will be based on the criteria of conveying the 10-year flow within the pipe and the 100-year with a combination of pipe and street with no flooding impact to adjacent properties. 3. Utility conflicts will be identified and relocated as appropriate to allow the constniction of the gravity starm drain system. Traffic Sig,nal Modifications l. Monterey Avenue and Fred Waring Drive—Reconfigure and replace traffic signal equipment on the northeast corner of the intersection. 2. Monterey Avenue and Park View Drive—Replace traffic signal equipment on northeast and southeast corners of the intersection. Additionally, this widening will increase the pedestrian crossing times across Monterey Avenue and may require modifications to the minimum green time for Park View Drive. 3. Fred Waring and San Pablo Avenue — Traffic signal equipment on the northwest corner of the intersection will be replaced due to the proposed widening. Additionally,as directed by the City(Tasks 1.6b,2.1b and 3.Ib), the existing traffic signal pole, controller and meter pedestal may require replacement as the current locations are in conflict with the proposed northbound right-tum lane. Landscaping Improvements 1. Fred Waring/westbound deceleration lane into City parking lot: Approximately 200 linear feet+/-of planter to be affected east of entry. 2. Align Fred Waring Drive westbound lanes east and west of San Pablo: Median Islands and eastbound lanes are not affected by realignment.Adjust turf area to the west and planters to the east parkways only. 3. Fred Waring Drive/westbound right-turn lane addition onto Monterey Avenue.Landscape area affected shall be from the western most entry/exit to the McCallum Theater,west to Monterey Avenue. Adjust the turf area, relocate existing palms and adjust existing shrub planting area(s). 4. Monterey Avenue / northbound lane addition from Fred Waring Drive to Magnesia Falls Drive. Median islands and southbound lanes not included in scope-of-work. Adjust existing turf area(s), shrub planter areas, relocate existing palms, coordinate & relocate existing entry monuments into the College at Park View Drive. Kimley-Horn . and Associates� II�C. Mc Aaron Kulp,May 10,2010,Pg.3 SCOPE OF SERVICES Task 1:Preliminary Design and Concept Task 1.1—Data Collection and Review Kimley-Horn will collect record information for the proposed work areas, to the extent readily available, from the City. It is assumed the as-built plans will be researched and compiled by the City, and be made available for pick up by Kimley- Horn. We have already performed a preliminary site visit to collect field photos and collect detailed project notes; one site visit will be performed as part of this task to review the record information received from the City. Deliverables: ■ Site photos (available upon request). Task 1.2— Utility Service Kimley-Horn will contact Dig Alert to identify each of the known utility companies within the proposed project limits. We will prepare plans and utility notification letters and send out to each known utility service provider within the project area. Kimley-Horn will track the responses from the utility providers and will follow-up with any non-responsive entities. Utiliry location information and coordination requirements received from the utility providers will be added to the base map. After the completion of the project survey and initial project layout, Kimley-Horn proposes to meet with the City to discuss any potential conflicts and our recommendations for mitigating the conflicts. Kimley-Horn will meet with each utility company where utility adjustments or relocations are identified to be necessary. We will obtain potholing for critical design elements that may be a potential conflict and will identify the location and elevation on the plan and profile sheets for any potholed locations. Up to a total of 10 potholes are anticipated to be necessary for this project. Deliverables: • Copies of utility notification letters and any responses received • Minutes of any utility coordination meetings held ■ Base file of existing utilities in CADD(upon request) Kimley-Horn and Associates, �nC. Mr.Aaron Kulp,May 10,2010,Pg.4 Task 1.3—Field Survey/Base Mapping/Right-Of-Way Needs Assessment Kimley-Horn will provide field survey and base mapping for the pr�ject locations anly within those areas of unprovement. These services will include roadway cross- sections at 25' intervals, intersecting driveway profiles, existing visible surf'ace utility locatio�ls,drainage stn�cture invert elevations and topogra}�hic features f'or the following project areas: 1. MONTEREY AVENUE — From approximately 600' north of Parkview Drive to the southern limits of the intersection of Fred Waring Drive. Cross-sections will be taken on the east side only and will comprise of the centerline(where no median exists), edge of pavement at the center median, edge of travelled way, edge of pavement, flowline of gutter, top of curb, back of sidewalk and ground shots approximately 30' east of the existing public right-of-way. The edge of pavement and top of curb for the west side of the street and median will be taken periodically in order to complete the base map and allow for striping design. 2. MONTEREY AVENUE — From approximately 600' north of Parkview Drive to Gran Via. Cross-sections will be taken at 75' intervals uf the pavement surface only, together with visible utilities located between the eenterline and east curb line. This data collection will be for the digital terrain model creation and base map for the storm drain installation. 3. FRED WARING DRIVE (Monterey) — From the intersection with Monterey Avenue approximately 350' easterly.Cross-sections will be taken on the north side only and will comprise of the centerline(where no median exists), edge of pavement at the center median, edge of travelled way, edge of pavement, flow line of gutter, top of curb, back of sidewalk and ground shots approximately 30' north of the existing public right-of-way. The edge of pavement and top of cwb for the south side of the street and median will be taken periodically in order to complete the base map and allow for striping design. 4. FRED WARING DRIVE (San Pablo) — From the intersection with San Pablo Avenue approximately 300' westerly (north side only), 350' southerly and 150' easterly (east and south sides only). Cross-sections will be taken on the half-width described above and will comprise of the centerline(where no median exists), edge of pavement at the center median, edge of travelled way, edge of pavement, flow line of gutter, top of curb, back of sidewalk and ground shots approxirnately 30' north of the existing public right-of-way. The edge of pavement and top of curb for the south side of the street and median will be taken periodically in order to complete the base map and allow for striping design. 5. FRED WARING DRNE (San Pasqual) — From the intersection with San Pasqual Avenue approximately 350' westerly. Cross-sections will be taken Kimley-Horn ' �d A$$�('late$, �nC. Kimley-Horn will rese�rch readily available record deeds and maps for properties adjacent to the corridor areas (specified above) in an effort to plot the recard right- of=���ay. We will research and recover existing monuments suf�cient to tie d�e record right-of-way to the engineering design surveys. Ki���ley-Horn will develop rigl�t-of- way Eilans at 1"�-40'. Kimley-Horn will layout the proposed improvements on the field survey base map collected in the field to back check the survey. These proposed improvements will be tied to existing monumentation collected as part of this task. The base map and the proposed improvements will be prepared at 1"=20'. Kimley-Horn will attend a working meeting with the Gity after this submittal to confirin the acceptance of the base map prepared, review the proposed improvements,and discuss of the right-of-way needs of the project. Deliverables: ■ One hard copy of base map on 24"x36"paper ■ One hard copy of right-of-way plans on 24"x36"paper ■ One electronic copy of base map files in AutoCAD�fonnat ■ One electronic copy of survey field notes • One hard copy Title Report of affected parcels Task 1.4—Geotechnical Analysis Kimley-Harn will retain Sladden Engineering as a subconsultant to complete the geotechnical field investigation which will include the excavation of up to four exploratory bores, soil testing, and the preparation of a geotechnical report. The exploratory bores will be exca�ated with a truck mounted drill rig and hollow-stem augers. Disturbed and relatively undisturbed samples will be obtained within the bores for laboratory testing. Sladden Engineering will perform laboratory testing on soil samples to determine soil characteristics and pertinent engineering properties that should be considered in an engineering evaluation. Testing will include soil classification determination, in- situ density and moisture content determination, maximum density/optimum moisture determination, shear strength determination, testing, and soluble sulfate content determination. Kimley-Horn and Associates� (C�C. Mr.Aaron Kulp,May]0,2010,Pg.6 Based on the tests completed, a formal geotechnical report will be prepared suminarizing the findings. The report will include descriptions of the field and laboratory procedures and results, a discussion regarding the engineering evaluation methods and results, and recommendations. Geotechnical recommendations are anticipated to include general site preparation criteria, foundation design parameters, lateral values, groundwater considerations, soil corrosivity considerations, and pavement design sections. (It is assumed that the City wilt approve a TI value b�fore proceeding.) Deliverable: One electronic copy and four hard copies of the final geotechnical report Task 1.5—Drainage Analysis Kimley-Horn wi11 prepare a drainage analysis for the tributary watershed to the intersection of Monterey Avenue and Fred Waring Drive and proposed storm drain north to Gran Via. The analysis will include hydrologic and hydraulic calculations for the tributary watershed to detennine the 100-year and 10-year flow rates, along with design of the existing stonn drainage system located in the area. Existing readily available mapping and field work will be used to define the limits of the study as well as note locations of ponding,nuisance flow, and other drainage issues along the corridor. The results of the analysis will be used to present a conceptual alternative far intercepting and conveying discharge at the intersection. The alternative will include a combination of a storm drain system and surface discharge. A connection to the existing 96" storm drain pipe is anticipated for the outfall of the storm drain system at the intersection of Monterey Avenue and Gran Via. The consultant will specifically analyze the contributing developments near the project who are adding the nuisance water to the project. Existing detention/infiltration basins will be identified in the report.
