By Minute Motion, that the City Council:
Authorize the Mayor to execute grant deeds conveying to the Redevelopment
Agency the remainder portions excepting the southerly 27.0 foot portions retained for
the Alessandro Alley Improvement Project right-of-way of 44-887 San Antonio Circle,
44-850 San Antonio Circle, 44-845 San Clemente Circle, 44-889 San Clemente
Circle, vacant Lot 108 of Palma Village Unit No. 7 (APN 627-074-013) and vacant
Lot 89 of Palma Village Unit No. 7 (APN 627-092-043).
By Minute Motion, that the Agency Board:
Authorize the Chairman to execute Certificates of Acceptance of grant deeds
conveying to the Redevelopment Agency the remainder portions excepting the
southerly 27.0 foot portions retained for the Alessandro Alley Improvement Project
right-of-way of 44-887 San Antonio Circle, 44-850 San Antonio Circle, 44-845 San
Clemente Circle, 44-889 San Clemente Circle, vacant Lot 108 of Palma Village Unit
No. 7 (APN 627-074-013) and vacant Lot 89 of Palma Village Unit No. 7 (APN 627-
092-043).
Executive SummarY
Approval of staff's recommendation will authorize conveyance from the City to the Agency of the
remainder portions excepting the southerly 27.0 foot portions retained for the Alessandro Alley
Improvement Project right-of-way of six (6) properties. The subject properties are zoned R-1
(Single Family Residential). The remainder portions may be used for future low/moderate
income affordable housing.

Backqround
The proposed Alessandro Alley Improvement Project will widen and improve Alessandro Alley
with public parking spaces and landscaping improvements from Las Palmas Avenue on the east
to approximately 300 feet east of Monterey Avenue on the west. As part of the project, San
Marcos Avenue will be closed at Alessandro Alley. The project will widen Alessandro Alley by
27.0 feet to a total width of 47.0 feet, and provide parking at a 90-degree angle on the north side
of Alessandro Alley with landscaping and a barrier wall to protect the adjoining residential
parcels.
44-887 San Antonio Circle: This property (APN 627-071-012) consists of an approximately
7,909 square foot parcel with a 1,267 square foot residence and an attached garage. The
property is zoned R-1 (Single Family Residential) and backs up to Alessandro Alley. The
southerly 27 feet (1,865 square feet) is necessary to implement the Alessandro Alley
improvements. A covered patio attached to the south side of the residence needs to be
removed to fully implement the Alessandro Alley improvements.
On February 28, 2008, the City Council approved the purchase of the subject property. The
Agency Board jointly approved reimbursement to the City and for the Housing Authority to
reimburse the Agency using Housing Set-Aside funds if it is determined that the property
qualifies as low/moderate income affordable housing. It has been determined that the balance
of the improvements remaining after removal of the covered patio are not suitable for
low/moderate income affordable housing, and would require significant improvements to bring
the property up to current code requirements. Removal of the existing improvements will provide
a remainder vacant lot of approximately 6,044 square feet that may be suitable for development
of future low/moderate income affordable housing.
44-850 San Antonio Circle: This property (APN 627-071-016) consists of an approximately
18,000 square foot parcel with a 1,380 square foot residence and a detached garage. The
property is zoned R-1 and backs up to Alessandro Alley. The southerly 27 feet (1,640 square
feet) is necessary to implement the Alessandro Alley improvements. The approximate 1,200
square foot detached garage on the southerly portion of the property needs to be removed to
fully implement the Alessandro Alley improvements.
On April 9, 2009, the City Council approved the purchase of the subject property. The Agency
Board jointly approved reimbursement to the City and for the Housing Authority to reimburse the
Agency using Housing Set-Aside funds if it is determined that the property qualifies as
low/moderate income affordable housing. It has been determined that the balance of the
improvements remaining after removal of the garage are not suitable for low/moderate income
affordable housing, and would require significant improvements to bring the property up to
currenf code requirements. Removal of the existing improvements will provide a remainder
vacant lot of approximately 16,360 square feet that may be suitable for development of future
low/moderate income affordable housing.
44-845 San Clemente: This property (APN 627-071-023) consists of an approximately 18,004
square foot parcel with a 1,331 square foot residence and an attached garage. The property is
zoned R-1 and backs up to Alessandro Alley. The southerly 27 feet (1,640 square feet) is
necessary to implement the Alessandro Alley improvements.

On April 24, 2009, the City Council approved the purchase of the subject property. The Agency
Board jointly approved reimbursement to the City and for the Housing Authority to reimburse the
Agency using Housing Set-Aside funds if it is determined that the property qualifies as
low/moderate income affordable housing. It has been determined that the improvements are not
suitable for low/moderate income affordable housing, and would require significant
improvements to bring the property up to current code requirements. Removal of the existing
improvements will provide a remainder vacant lot of approximately 16,364 square feet that may
be suitable for development of future low/moderate income affordable housing.
44-889 San Clemente Circle: This property (APN 627-071-025) consists of an approximately
7,823 square foot parcel with a 2,216 square foot triplex, pool, and attached garage all in very
poor condition. The triplex is a nonconforming use on this parcel, which is zoned R-1, and backs
up to Alessandro Alley. The southerly 27 feet (1,865 square feet) is necessary to implement the
Alessandro Alley improvements. A portion of the triplex on the southerly portion of the property
needs to be removed to fully implement the Alessandro Alley improvements, which will
functionally require removal of the entire triplex.
On May 7, 2009, the City Council approved the purchase of the subject property. The Agency
Board jointly approved reimbursement to the City and for the Housing Authority to reimburse the
Agency using Housing Set-Aside funds if it is determined that the property qualifies as
low/moderate income affordable housing. It has been determined that the improvements are not
suitable for low/moderate income affordable housing, and would require significant
improvements to bring the property up to current code requirements. Removal of the existing
improvements will provide a remainder vacant lot of approximately 5,958 square feet that may
be suitable for development of future low/moderate income affordable housing.
On August 26, 2010, the Agency Board authorized the award of contract for deconstruction of
44-887 San Antonio Circle, 44-850 San Antonio Circle, and 44-889 San Clemente Circle. There
are currentty negotiations for the sale of 44-845 San Clemente Circle; therefore, the
deconstruction of this property is currently on hold.
Lot 108: Lot 108 of Palma Village Unit No. 7 (APN 627-074-013) consists of an approximately
22,204 square foot vacant parcel located on San Clemente Circle. The property is zoned R-1
and backs up to Alessandro Alley. The southerly 27 feet (3,805 square feet) is necessary to
implement the Alessandro Alley improvements.
On October 25, 2007, the City Council approved the purchase of the subject property. The
Agency Board jointly approved reimbursement to the City and for the Housing Authority to
reimburse the Agency using Housing Set-Aside funds if it is determined that the property
qualifies for future low/moderate income affordable housing. The remainder vacant lot of
approximately 18,399 square feet may be suitable for development of future low/moderate
income affordable housing.
Lot 89: The remainder portion of Lot 89 of Palma Village Unit No. 7 (APN 627-092-043) is
currently an approximately 10,807 square foot vacant parcel located on San Benito Circle. The
property is zoned R-1 and backs up to Alessandro Alley. On April 15, 1996, the southerly 25
feet was conveyed to the City for right-of-way. On February 10, 1998, the City acquired the
remainder portion of this property. The additional southerly 2 feet (282 square feet) is necessary
to implement the Alessandro Alley improvements.

On May 7, 2009, the Agency Board approved reimbursement to the City of the fair market value
of the remainder portion and for the Housing Authority to reimburse the Agency using Housing
Set-Aside funds if it is determined that the property qualifies for future low/moderate income
affordable housing. The remainder vacant lot of approximately 10,525 square feet may be
suitable for development of future low/moderate income affordable housing.
Staff has not determined to develop the six (6) subject properties for low/moderate income
affordable housing. If a determination is made for each property individually to develop for
low/moderate income affordable housing, the Agency will then be reimbursed for the
proportional cost of the remainder portions from Housing Set-Aside funds.
Therefore, staff recommends the conveyance to the Agency of the remainder portions excepting
the southerly 27.0 foot portions retained for the Alessandro Alley Improvement Project right-of-
way of the six (6) subject properties.
Fiscal Analysis
The Agency Board has approved reimbursement to the City for the cost of the subject properties
and may be reimbursed for the proportional cost of the remainder portions from Housing Set-
Aside funds as noted. There will be no fiscal impact on the General Fund.
