Authorize the Mayor to execute Certificates of Acceptance of grant deeds conveying the southerly 27.0 foot portions of 44-870 San Antonio Circle and of vacant Lot 98 of Palma Village Unit No. 7 (APN 627-092-006) for the Alessandro Alley Improvement Project right-of-way. By Minute Motion, that the Agency Board: 2. Authorize the Chairman to execute grant deeds conveying the southerly 27.0 foot portions of 44-870 San Antonio Circle and of vacant Lot 98 of Palma Village Unit No. 7 (APN 627-092-006) for the Alessandro Alley Improvement Project right-of-way. 3. Authorize staff to reimburse the Agency using Housing Set-Aside funds for the remainder portion of 44-870 San Antonio Circle if it is determined that the property qualifies as low/moderate affordable housing. Executive Summary Approval of staff's recommendation will authorize conveyance from the Agency to the City of the southerly 27.0 foot portions of 44-870 San Antonio Circle and of vacant Lot 98 of Palma Village Unit No. 7 (APN 627-092-006) for the Alessandro Alley Improvement Project. The subject properties are zoned R-1 (Single Family Residential). The remainder portions may be used for future low/moderate affordable housing. Staff Report Alessandro Alley Right-of-Way Property Conveyance Page 2 of 3 November 18, 2010 Backqround The proposed Alessandro Alley Improvement Project will widen and improve Alessandro Alley with public parking spaces and landscaping improvements from Las Palmas Avenue on the east to approximately 300 feet east of Monterey Avenue on the west. As part of the project, San Marcos Avenue will be closed at Alessandro Alley. The project will widen Alessandro Alley by 27.0 feet to a total width of 47.0 feet, and provide parking at a 90-degree angle on the north side of Alessandro Alley with landscaping and a barrier wall to protect the adjoining residential parcels. 44-870 San Antonio Circle: This property consists of an approximately 14,580 square foot parcel with a 942 square foot residence, pool, and a detached garage. The property is zoned R- 1 (Single Family Residential) and backs up to the Alessandro Alley. The southerly 27 feet (4,055 square feet) is necessary to implement the Alessandro Alley improvements. On June 22, 2005, the Agency Board approved the purchase of the subject property. It has been determined that the improvements are not suitable for low/moderate income affordable housing, and would require significant improvements to bring the property up to current code requirements. Removal of the existing improvements will provide a remainder vacant lot of approximately 10,525 square feet that may be suitable for development of future low/moderate income affordable housing. On August 26, 2010, the Agency Board authorized the Award of Contract for deconstruction of the subject property as well as neighboring properties associated with the Alessandro Alley Improvement Project. Staff has not determined to develop the subject property for low/moderate income affordable housing. Lot 98 APN 627-092-006: On October 11, 2007, the Agency Board authorized the acquisition of vacant Lot 98 of Palma Village Unit No. 7 (APN 627-092-006). The subject property is an approximately 7,909 square foot vacant parcel zoned R-1 (Single Family Residential) and backs up to the Alessandro Alley. The southerly 27 feet (1,865 square feet) is necessary to implement the Alessandro Alley improvements. The remainder portion is approximately 6,044 square feet. The Agency authorized staff to reimburse the Agency using Housing Set-Aside funds if the property qualified for low/moderate income affordable housing. On October 14, 2010, the Agency Board authorized the City Clerk to publish a Notice of Public Hearing for conveyance to donate the remainder portion to Habitat for Humanity of the Coachella Valley, Inc. The donation of the said property, subject to the appropriate agreements for the purpose of building a single family residence for a lower income household, qualifies for reimbursement to the Agency using Housing Set-Aside funds. Therefore, staff recommends the conveyance of the 27.0 foot portions of the subject properties to the City for the Alessandro Alley Project.
