Recommendation
By Minute Motion, approve the location of a new monument sign within
the public right-of-way located on Monterey Avenue / Highway 74 with a
minimum 15-foot back from the street.
Commission Recommendation
On October 26, 2010, the Architectural Review Commission reviewed and approved the
design for the new, non-illuminated monument sign for Third Corner Bistro.
Executive Summary
Third Corner Bistro is requesting approval of a new, non-illuminated, monument sign
located in the pubtic right-of-way on Monterey Avenue / Highway 74. The sign will be
located on Monterey / Highway 74 in place of the former sign located on Highway 111 .
According to the Palm Desert Municipal Code, permanent structures are not allowed
within the public right-of-way. However, Encroachment Permits have been issued in the
past for such structures. If the City Council approves the location of the sign, staff will

issue an Encroachment Permit. The Architectural Review Commission reviewed and
approved the sign on October 26, 2010.
Backqround
A. Property Description:
The property is located on the south side of Highway 111, east of Monterey
Avenue within the President's Plaza III parking lot. The building is in between the
former Baker's Square, now Panera Bread under construction, and California
Pizza Kitchen.
Third Corner Bistro is a new restaurant occupying the building where Palomino's
Restaurant used to be located. Palomino's restaurant had an approved off-site
monument sign on Highway 111 that received an encroachment permit from Cal
Trans, before responsibility for that right-of-way was transferred to the City of
Palm Desert. After Palomino's left the building, Mallards Restaurant occupied the
building and used the same moment sign

Proiect Description
The applicant is requesting approval of a new �nonument sign located on Monterey
Avenue. The sign is 56" high and 88" wide placed 26' from the back of the street curb to
the back of the monument sign. The applicant is requesting approval of the sign within the
public right-of-way, which is prohibited by the Municipal Code. The Department of Public
Works is willing to approve an Encroachment Permit if the sign location is approved by
the City Council.
The sign is designed with a 39" by 88" aluminum panel mounted on two (2) 4"x6" posts.
The aluminum panel will be painted in a faux stone finish to match the existing signs on
the property. The posts will be painted dark bronze. The letters will be non-illuminated 5"
letters painted white with slightly reflective vinyl for night time visibility. The sign area
totals 24 square feet.

Analvsis
The former businesses Palomino's and Mallards had a monument sign located on
Highway 111, adjacent to the former Baker's Square building, west of the entrance in
front of the Carl's Jr. Restaurant. The sign was dilapidated and removed before the
Third Corner Bistro leased the building for a new restaurant. City staff agreed that a
new tenant would be allowed to have a new offsite sign consistent with the previous
approved sign. Third Corner Bistro is requesting approval of a new, non-illuminated sign
that will match the existing signs currently on the business.
The sign location is within in the public right-of-way. The Palm Desert Municipal Code
prohibits structures from being located within the public right-of-way, and typically an
Encroachment Permit is issued for temporary structures or road closures. In the past,
Encroachment Permits have been issued on permanent structures; however, staff is
now limiting the approval of permanent structures in the public right-of-way. Staff does
not believe the new sign will have a negative impact or adversely impact the public
health or safety, and supports the new location for the business.
Fiscal Analvsis
There is no financial impact to the City for the proposed sign by a private business
owner.

modified the signage as opposed to what it was, which has been
approved. Mr. Swartz stated that at a previous meeting the original
sign was not approved and the Commission recommended
reducing it. This current proposal with the cheetah print and
signage has not been approved.
Commissioner Van Vliet stated that he did not like the large
"Between the Sheets" signage on the awning. Commissioner
Lambell stated that what was approved is far better looking than
this in multiple ways; size of the ����, th� �heetah print, and the
color of the awning. She said tha� the a�r�ing needs to bespeak
the elegance of the store and �I Paseo.
Commissioner Lambell moved: an�`Commission�r �:�vi� seconded
to deny the cheetah pattern. Cc�mrnissioner Van �lii�� asked if the
Commission is advocating gt�ing ����. to the original approved
design. Commissioner Lambell sta��d that �he applicant has a
choice to bring something.else in, but the �r'�wn is what has been
previously approved. Mr. '`�wartz inforrri�d Mr. Sadler that the
applicant has 15 days to �p���l.the decision to City Council. The
Commission and Mr,. Sadler di��us��ed options for approval of the
awning and the si�e of tl�e sign�g�.' They stated that the applicant
would have t€� �ome ba�k to get approval of signage if they decide
to go with stacked letters.

Mr. Bagato presented the project and stated that the applicant is
requesting approval of a non-illuminated sign on Monterey Avenue
instead of Highway 111. Staff believes that the sign will match the
existing signs approved for the business and recommends
approval. He stated that the Director of Public Works wilt allow the
encroachment permit if the City Council approves the location.
The Commission reviewed and discussed the sign and the location.

Mr. Swart� presented the project and said that the forest green
� awnin�'is attached to the building below the roof line and extends 5'
;r�u� and must be located out of the public right-of-way. He pointed
out that they are proposing signage on the awning and on the band
of the awning and staff is recommending approval with the removal
of the signage on the band.
Commissioner Vuksic stated that the green is a good choice to
offset the black on both sides. Mr. Jim Sadler, awning
representative stated that this color is the company color and is the
same color they had at their old location. Commissioner Vuksic
stated that it was unfortunate that the arch is the one piece of
architecture that building has and a horizontal awning will make this

Public Works has reviewed the proposed sign location for the 3rd Corner Wine Shop.
The proposed location in the right of way of Highway 74 is acceptable to Public Works
contingent upon three conditions:
■ The sign must be located 15' from the face of curb to avoid line of sight
problems.
■ The applicant must execute the standard City hold harmless and
indemnification agreements for private improvements in the public right of
way.
■ City Council reviews and approves the location.
City of Palm Desert Municipal Code 12.04.010 adopted the County of Riverside
ordinance 499 relating to encroachments in the public right of way. This ordinance
prohibits encroachment into the public right of way unless the use proposed is in the
public interest. The Public Works Department would like the proposed sign location to
be reviewed by City Council to ensure that allowing the sign in the public right of way is
in the best interest of the public. We have referred this issue to the City Attorney for his
opinion as welf.
