C22300 WITH HARRIS & ASSOCIATES TO REVISE THE SCOPE OF WORK FOR ENGINEERING DESIGN SERVICES FOR THE COOK STREET WIDENING IN THE AMOUNT OF $31,380 (PROJECT 60'!-05) SUBMITTED BY: Mark Greenwood, P.E., Director of Public Works DATE: November 18, 2010 CONTENTS: Contract Amendment No. 6 Consultant's Proposal Summary of Contract Amendments Recommendation By Minute Motion: 1. Approve Contract Amendment No. 6 to Contract No. C22300 with Harris & Associates to revise the scope of work for the engineering design services for the Cook Street Widening in the amount of$31,380; and 2. Authorize the Mayor to execute the Agreement. Funds are available in Accounts No. 213-4385-433-4001(Measure A) and 232-4375-433- 4001 (Drainage). No General Fund money is being used for this action. Backqround On February 12, 2004, City Council approved Contract No. 22300 in the amount of $393,945 with Harris & Associates to design storm drain and intersection improvements at the Cook Street and Country Club Drive, and Cook Street and Hovley Lane East intersections. This project will eliminate cross-gutter and drainage issues at these intersections. The intersections will also be widened and the signals modified to improve traffic flow. On June 24, 2004, Council approved Amendment No. 1 to Contract 22300 in a not-to-exceed amount of $82,300 to include a hydrology study for the Monterey Avenue Storm Drain between Fred Waring Drive and the Whitewater Channel. A separate purchase order was Staff Report Approve Amendment No. 6 to Contract C22300 with Harris & Associates November 18, 2010 Page 2 of 3 opened and closed for an actual expenditure of $29,735 and the remaining unused portion went back to the Drainage Funds account. On August 25, 2005, Council approved Amendment No. 2 in the amount of $17,500 for the preliminary analysis and design of striping plans to identify where re-striping alone would be sufficient to accommodate the expansion of Cook Street from four lanes to six lanes. On January 26, 2006, Council approved Amendment No. 3 in the amount of $384,435 to expand the scope of services to include the final design to widen Cook Street to six lanes between Frank Sinatra Drive and Fred Waring Drive. On June 14, 2007, Council approved Amendment No. 4 in the amount of $117,463, for additional professional design services to split the project into two phases, design a sound wall, and rehabilitate the pavement. Phase I is for drainage and intersections improvements at Cook Street and Country Club Drive, and Cook Street and Hovley Lane East; and Phase II is for the improvements proposed to widen Cook Street from four to six lanes. On December 13, 2007, Council approved Amendment No. 5 to Contract No. 22300 in the amount of $171,749 to prepare and process an Initial Study/Mitigated Negative Declaration (IS/MND) for Phase I and an Environmental Impact Report (EIR) for Phase II. On March 12, 2009, staff presented Council with three alternatives for Cook Street Widening Phase II: Roadway Reconfiguration without Bike Lanes, Roadway Reconfiguration with Class I Bike Path, or No Project. Council selected Alternative 3, which was No Project. Since then, staff has begun the right-of-way acquisition process for Phase I for the drainage and intersection improvements at Cook Street and Hovley Lane East, and Cook Street and Country Club Drive based on the 100 percent design by Harris & Associates. Negotiations for right-of-way acquisition have been successful except for a small, approximately 65 square foot portion of property at the southwest corner of Cook Street and Country Club Drive. Consequently, staff has looked at an alternate to acquiring this property which is to slightly realign the intersections and reschedule the raised median work on Cook Street from Phase I to Phase II of the project. This modification will result in lower construction costs for Phase I, but a higher construction cost for Phase II when the raised median work will occur. Staff has obtained a proposal in the amount of $31,380 from Harris & Associates to revise the plans and specifications accordingly. Staff finds the proposal to be reasonable and fair. This amendment will result in a lower Phase I construction cost and a higher future Phase II construction cost, but the overall construction cost estimate is expected to remain approximately the same. The only option left to acquire this small easement would be using the Eminent Domain process but it is time consuming, costly, and unfeasible. Staff thinks that this easement can be avoided by realigning this intersection a little to still make the design work but the design consultant would have to revise the plans and specifications. As a result, a proposal for the additional work was requested from the current design consultant, Harris & Associates. A probable construction estimate will also be prepazed. FEES As you know,for the past 6 years,this project has suffered from numerous scope changes and schedule delays resulting in production inefficiencies and consequently cost overruns suffered by Harris.At this point, Harris is not seeking to recover any of these costs, however,we are respectfully requesting compensation to address the latest revisions in the project scope of work and inefficiencies resulting from the project being on hold for the past six months. We are requesting an amount of"not-to-exceed"fee of$31,380 for the above services. A breakdown of our fee is included for your evaluation of our proposal. Pursuant to our discussions,we are yet to receive any comments from the City on our 100°/a Plans,therefore, the above fee does not include any material changes made to the plans resulting from subsequent plan reviews by the City. Fees would be invoiced monthly based on the actual hours of work completed.
