Kevin Swartz, Assistant Planner Jesus Escamilla 74-350 Alessandro Drive, Suite A-1 Palm Desert, CA 92260 October 28, 2010 Letter from Mr. Jesus Escamilla dated September 21, 2010 That the City Council, by Minute Motion, deny the request for reduction of the processing deposit from $2,915 to $1,500 for the processing of a Conditional Use Permit for West Coast Barber College located in the residential multiple family zone. Executive Summary Approval of staff's recommendation would deny the applicant, Mr. Jesus Escamilla, a reduction of the processing deposit for a Conditional Use Permit for West Coast Barber College. The applicant would be required either to pay the full deposit and proceed through the CUP process in a timely manner, or to cease operating as a barber college. Analysis On April 22, 2010, the applicant applied for a business license to operate a barber college at said location. The application was denied by the Director of Community Development to operate a private barber college in the R-3(4) zone without approval of a Conditional Use Permit. Sometime after, the applicant was cited by the Code Enforcement Division for operating the barber college without an approved Conditional West Coast Barber College October 28, 2010 Page 2 of 2 Use Permit. In July 2010, the applicant stated that the business is not a college, only a barber shop. Staff issued a business license with a condition that the business must be maintained as a barber shop. Today, the applicant is still operating as a barber college. City staff has given the applicant more than a month to submit the application for a CUP, and an application still has not been formally submitted. Mr. Escamilla has submitted a hardship request for an adjustment to the required deposit. Currently the $2,915 deposit is based on the average cost of processing all CUPs. Because the applicant does not appear to be making a sincere effort to move through the approval process in a timely manner, Staff does not recommending granting leniency on the required deposit. If the completed application and required deposit are not received within five business days, Staff will resume code enforcement actions for the operation of a private college in an R3 Zone without a Conditional Use Permit. At the time of the meeting I already had my business license and thought I was at par with the city's requirements. During that meeting was when I found out about having to apply for a Conditional Use Permit to operate as a Barber College. I'd like to take this moment to ask for your help in this matter. I am asking for leniency in the fee and ask to pay in the amount of $1,500.00 deposit. I am in the process of recruiting students for our college in hopes of becoming a successful business in the city of Palm Desert. Though we have students enrolled at this time, there are just enough to keep the business running. I am also brainstorming ideas to become more involved in our community and offer services at lower costs to help my students advance in their technical skills and provide affordable barbering services to our residents. Starting this business has been both a rewarding and challenging experience and I hope you are able to help me with this matter. Thank you for your time and consideration it is greatly appreciated.
