Klassen, City Clerk DATE: September 9, 2010 CONTENTS: • Staff Report • Application for Appointment to the City Council Form Recommendation By Minute Motion: 1) Ratify the schedule for an Application and Appointment Process to fill the vacancy in the term of City Councilman Richard S. Kelly (November 2012); 2) adjourn today's meeting to a specific time on Monday, September 20, 2010, for making said appointment to the City Council. Background Councilman Richard S. Kelly passed away on Friday, August 20, 2010. His term would have run through November 2012. Government Code Section 36512 provides the City Council with 30 days from the commencement of the vacancy to either appoint someone to the position or call a Special Election for this purpose at the next available regularly established date not less than 114 days from the call of the Election. First available date for a regular polling place Special Election would be Tuesday, March 8, 2011, with an estimated cost of $66,000. The first available date for a Special Election conducted by all mail ballot would be Tuesday, May 3, 2011, at an estimated cost of$54,000. City Manager directed that a provisional Application for Appointment form (attached) be developed for availability beginning on Sunday, September 5. Following is the schedule that was authorized: Sun., September 5 Publish Application on City website, 12:00 a.m. Tues.-Fri., Sept. 7-10 Applications accepted by City Clerk's Office and verified for residency and voter registration, copied and distributed to City Council as they are received. Thurs., September 9 Ratify Process and adjourn Regular City Council Meeting to Monday, September 20, at specific time for filling the vacancy on the City Council. Mon., September 13 All City Council's choices of Applicants to interview to City Clerk's Office by 3:00 p.m., along with decision about day/time to conduct applicant interviews. Due to the anticipated volume of applications to be received and limited amount of time in which to interview, staff suggests each Councilmember provide the names of their five(5)top-ranked candidates for interview, and a maximum of 10 candidates getting the highest ranking will be scheduled. Cost to conduct a regular polling place(March 8, 2011)or all mail ballot(May 3, 2011) Special Election would be $66,000 or $54,000, respectively. Funds would need to be appropriated from the General Fund for this purpose, with the current budgeted amount in Account Nos. 110-4114-410-XXXX only having been allocated for the General Municipal Election on Tue day, November 2, 2010.
