Recommendation
By Minute Motion, that the City Council and Agency Board:
1) Conduct a public hearing and following public testimony approve
the Final Relocation Plan for Adobe Villas Apartments in the City of
Palm Desert.
2) Authorize the Director of Finance to appropriate funds and draw
monies necessary for the purpose of relocation assistance and
benefits not to exceed $204,946.00 as outlined in the Final
Relocation Plan from Account No. 850-4688-454.40-01.
3) Authorize the Executive Director to execute any documents
necessary to effectuate the actions taken by the Agency Board
herewith.
By Minute Motion, that the City Council:
1) Approve and authorize filing of the Notice of California
Environmental Quality Act ("CEQA") Exemption for the demolition of
the Adobe Villas Apartments and construction of public parking.
Executive Summary
Adobe Villas Apartments are located at 45-330 Ocotillo Drive, Palm Desert, and are
identified as Assessor's Parcel Number 627-232-005 (the "Property"). The Property is a
12-unit apartment complex that was acquired by the Palm Desert Redevelopment
Agency on September 2, 2008. The Property has operated as a market rate apartment
complex continuously since that time. The Agency proposes to construct public parking
on the Property ("Project). The construction of the Project would require the relocation
of the seven tenants that occupy the Property. Accordingly, the Agency was required to

prepare a relocation plan for these seven tenants. The attached Adobe Villas
Relocation Plan (the "Plan") outlines the eligible relocation assistance for the tenants
and complies with California Relocation Assistance Law, California Government Code
Section 7260 et seq. (the "CRAL") and the California Relocation Assistance and Real
Property Acquisition Guidelines, Title 25, California Code of Regulations, Chapter 6,
Section 6000 et seq. (the "Guidelines"). The Plan has been available for public review
for the required minimum thirty-(30) day period from March 11, 2011 to April 14, 2011.
Background
Public entities acquiring property for a public use and undertaking public projects that
may result in the displacement of residents must comply with the CRAL and the
Guidelines. The construction of the Project would require the demolition of the Adobe
Villas Apartments and result in the displacement of the seven households that occupy
the Property. Accordingly, the Project triggers relocation assistance obligations under
the CRAL and the Guidelines. Under the CRAL and the Guidelines, the Agency is
required to prepare a relocation plan addressing the circumstances and needs of those
persons potentially displaced by the Project. The Agency retained specialty
consultants, Overland Pacific & Cutler, Inc. ("OPC") in February of 2011 for the tenant
relocation implementation services as described in the Plan for Adobe Villas
Apartments.
The Plan was prepared in accordance with the specific requirements set out in Section
6038 of the Guidelines concerning projects that involve the displacement of less than 15
households. The Plan provides a description of the Project, the results of needs
assessment survey conducted among residents, a housing resource study, and details
of the Agency's proposed relocation program. No displacement activities have taken
place prior to the required reviews and approval of this Plan.
In March 2011, a copy of the Plan for the Project was provided in person to each of the
occupants of the Property. A copy was also mailed to the occupants via both regular
mail and certified mail. The occupants were notified of the 30-day review period. The
Plan was made available to the public for the mandatory 30-day review period, and no
comments were received. In addition, a notice was published in the newspaper
identifying the availability of the Plan for review by tenants that may have resided at the
Property after the Agency's acquisition of the Property in 2008 and moved after that
date. The comment period ended at 5:00 p.m. on April 14, 2011, and no comments
were received. Upon approval of the Plan by the City Council and Agency, staff will
forward a copy of the Plan to the California Department of Housing and Community
Development (HCD) as required by the Guidelines.
The City analyzed the environmental impacts of the Project and the Director of Community
Development determined that the Project, which would require the demolition of the
existing improvements on the Property for the proposed construction of public parking
and result in the displacement of the seven households from the Property, is categorically

exempt under the CEQA pursuant to Section 15332 of the California Code of
Regulations, Title 14, Division 6, Chapter 3. The Project is an in -fill development project
under Section 15332. The Project is consistent with the C-C general plan designation
and the applicable R-3 zoning designation and regulations; the Project would be
constructed on the Property, which is not greater than five acres in size and is
substantially surrounded by urban uses; the Property has no value as habitat for
endangered, rare or threatened species; approval of the Project would not result in any
significant effects relating to traffic, noise, air quality or water quality; and the Property is
adequately served by all required utilities and public services. Staff is not requesting that
the City Council and Agency Board authorize the demolition of the existing structures on
the Property and the construction of public parking at this time. Staff will submit this
request to the City Council and Agency Board at a later date. Because it is improper to
piecemeal the different components of a Project under CEQA, the City analyzed the
impact of the entire Project pursuant to CEQA and determined that the Project is
categorically exempt under Section 15332 of the CEQA Guidelines.
Staff recommends that the City Council and Agency Board hold a public hearing on the
Plan. Staff further recommends that, following the conclusion of the public hearing, the
City Council and Agency Board approve the above. actions related to the Project and the
Plan. Upon approval of the Plan, individual eligibility letters will be sent to the qualifying
tenants.

NOTICE OF PUBLIC HEARING AND NOTICE OF AVAILABILITY OF
REVIEW OF RELOCATION AND REPLACEMENT PLAN
NOTICE IS HEREBY GIVEN pursuant to Section 6038 of Chapter 6 of Title 25 of
the California Code of Regulations that the City of Palm Desert and the Palm Desert
Redevelopment Agency will jointly hold a public hearing regarding the adoption of the
Relocation and Replacement Housing Plan ("Relocation Plan") for the proposed
development of a public parking on the real property identified as APN 627-232-005
located at 45-330 Ocotillo Drive, Palm Desert, California ("Project"). The Project would
impact the property identified as 45-330 Ocotillo Drive, Palm Desert, California and
would result in the displacement of seven households living on the Project Site.
Said PUBLIC HEARING will be held on Thursday, April 14, 2011, before the City and
Agency at 4:00 p.m. in the Council Chamber in the Palm Desert City Hall, 73-510 Fred
Waring Drive, Palm Desert, California, at which time and place all interested persons
are invited to attend and be heard. Written comments concerning all items covered by
this public hearing notice shall be accepted up to the date of the hearing. Information
pertaining to the public hearing, including a copy of the above -referenced Relocation
Plan is available for review in the Agency office at the above address between the hours
of 8:00 a.m. and 5:00 p.m. Monday through Friday (as of the date first published). If you
challenge the proposed actions in court, you may be limited to raising only those issues
you or someone else raised at the public hearing described in this notice, or in written
correspondence delivered to the City and Agency at, or prior to, the public hearing.
In compliance with the Americans with Disabilities Act, if you need special

Adobe Villas Relocation Plan
INTRODUCTION
The Palm Desert Redevelopment Agency ("Agency") is interested in the
redevelopment of property within the City of Palm Desert. The subject property, which
is known as Adobe Villas Apartments, is located at 45-330 Ocotillo Drive, Palm Desert,
California and identified as APN 627-232-005 (the "Property"). See attached Property
site maps (Attachment 1). The Agency is proposing to develop a public parking lot on
the Property ("Project"). The construction of the Project would impact some housing
and result in the permanent displacement of seven households renting units on the
Property. Pending California State legislation to implement redevelopment provisions of
the Governor's proposed 201 1-2012 budget may impact the Agency's ability to
proceed with the Project. If the State legislation is approved, the Project may not be
approved by the Agency Board of Directors and the City Council and there would be
no displacement of the households residing on the Property.
The Agency has retained the professional firm of Overland Pacific & Cutler, Inc. ("OPC")
to assist in preparing and implementing this Relocation and Replacement Housing Plan
(the "Plan"), under the direction of and involvement with the Agency. This Plan
provides the results of a needs assessment survey, a housing resource study, and details
of the Agency's proposed relocation program. This Plan sets forth policies and
procedures necessary to conform with statutes and regulations established by the
California Relocation Assistance Law, California Government Code section 7260 et seq.
(the "CRAL") and the California Relocation Assistance and Real Property Acquisition
Guidelines, Title 25, California Code of Regulations, Chapter 6, Section 6000 et seq. (the
"Guidelines").
No displacement activities will take place prior to the required reviews and approval of
this Plan by the Agency Board of Directors.
A. ASSESSMENT OF NEEDS
OPC, on behalf of the Agency, conducted personal interviews with the seven
households living on the Property to obtain information for the preparation of this Plan.
OPC conducted the personal interviews with each of the households on March 8, 2001
through March 10, 2011. OPC subsequently discussed any follow-up questions with the
households by phone and will continue to answer any questions raised by the
households during the relocation process. The primary language of all seven household
is English. The interviews and phone discussions were conducted in English.
At this time, information obtained from the households living on the property pertinent
to establishing income and need is subjective because the information has not been
verified by required documentation. This income verification will be verified at the time
of actual displacement.
Of the twelve (12) available units on the Property, seven (7) are tenant -occupied.
Therefore, a total of seven (7) residential occupants will need to permanently relocate
to suitable replacement housing.

The following table (Table 1) provides general household characteristics and needs of
the households living on the Property.

None of the household residents reported any medical conditions that require special
accommodations or equipment. One household is receiving a housing subsidy from
the Riverside County Housing Authority Section 8 Program. Attached are the most
current income limits as established by HCD for Riverside County (Attachment 2). Table
1 shows income categories of the households.
The households must be relocated into a dwelling that satisfies the size requirements for
the respective household and does not result in overcrowded conditions. None of the
effected households are currently living in overcrowded conditions based on the City of
Palm Desert Housing Authority's affordable housing occupancy standards (Res. No. HA-
22). Therefore, the Agency will provide relocation assistance to each eligible household
to assist the household to secure replacement housing that is comparable to the
current dwelling occupied by the household consistent with the CRAL and the
Guidelines.
The Property is located in close proximity to public amenities. Thus, the displaced
households would benefit if the replacement dwelling offered the same conveniences
as the Property. The Agency will make every effort to help locate and secure
replacement housing that will adequately accommodate the needs of the households.
If the Project moves forward, OPC will conduct interviews with all occupants to
determine if there are any additional special needs that the occupants' will require
during the relocation process.

B. REPLACEMENT HOUSING RESOURCES
A resource survey was made on March 1, 2011, to identify available comparable,
decent, safe, and sanitary units available in close proximity to the Property. Four one -
bedroom units and three two -bedroom units will be required to adequately relocate
the households living on the Property. Therefore, the survey focused on confirming the
availability of comparable, decent, safe, and sanitary units that contain the required
minimum number of bedrooms, are adequate in size for each household, and are
comparable with respect to the number of rooms and habitable living space.
The results of the resource survey show that as of March 1, 2011, there were at least 28
(twenty-eight) available comparable, decent, safe, and sanitary units of adequate size
containing one and two bedrooms (Attachment 3). These available one and two -
bedroom units ranged in rent from $725.00 per month to $1,216.00 per month. The
households' current rent range is from $650.00 per month to $900 per month. The
majority of these units have one bathroom. Some units had two bathrooms or one and
a half bathrooms. Ten of these units were located within 2 miles of the Property, and
eighteen were located within 3 (three) to 8 (eight) miles of the Property. Most of the
units had comparable or superior amenities to those found on the Property.
The replacement housing resources identified meet the specific needs as identified in
Section A. All of the replacement housing identified contain one and two bedrooms
and are located within approximately 8 (eight) miles of the units on the Property
occupied by the displaced households.
C. CONCURRENT RESIDENTIAL DISPLACEMENT
There is no concurrent residential displacement anticipated by the Palm Desert
Redevelopment Agency that would affect the available replacement housing.
D. TEMPORARY HOUSING
There is no anticipated need for temporary housing. Should such a need arise, the
Agency will respond appropriately and in conformance with all applicable laws and
requirements.
If temporary moves are necessary, the Agency may, in its discretion, provide
permanent relocation in lieu of temporary relocation if such permanent relocation will
minimize the impact to the displacee.
E. PROGRAM ASSURANCES AND STANDARDS
At this time, and if the proposed Project is approved, there are adequate funds
available to relocate all affected households that are eligible for relocation assistance
and benefits under the CRAL and the Guidelines. The Agency and the City will notify
households if the Project does not proceed and no displacement will occur because of
the Governor's 201 1-2012 budget legislation.

Relocation services will be provided to ensure that displacement does not result in
different or separate treatment of households based on race, nationality, color, religion,
national origin, sex, marital status, familial status, disability, or any other basis protected
by the federal Fair Housing Amendments Act, the Americans with Disabilities Act, Title VI
of the Civil Rights Act of 1964, Title VIII of the Civil Rights Act of 1968, the California Fair
Employment and Housing Act, and the Unruh Act, as well as any other arbitrary or
unlawful discrimination.
No one occupying the Property will be displaced without 90-days written notice and
unless "comparable" replacement housing can be located and is available. Under the
Guidelines, comparable housing includes standards such as decent, safe, and sanitary
(as defined in Section 6008(d) of the Guidelines); comparable as to the number of
bedrooms, living space, and type and quality of construction of the acquired unit but
not lesser in rooms or living space than necessary to accommodate the displaced
household; in an area that does not have unreasonable environmental conditions; not
generally less desirable than the acquired unit with respect to location to schools,
employment, health and medical facilities, and other public and commercial facilities
and services; and within the financial means of the displaced household as defined in
Section 6008, Subdivision (c) (5) of the Guidelines.
The Agency's relocation program conforms to the standards and provisions set forth in
Government Code Section 7260 et seq., the Guidelines, California Health and Safety
Code Section 33410 et seq., if applicable, and all other applicable regulations and
requirements.
F. RELOCATION ASSISTANCE PROGRAM
OPC staff will be available to assist any displaced household with questions about
relocation and/or assistance in relocating. OPC will maintain personal contact with all
individuals until the relocation process has been completed. OPC can be contacted
at 760-776-1238 from 8:00 a.m. to 5:00 p.m., Monday through Friday. In addition,
relocation staff will be available to speak on the phone to residents on weekday
evenings and weekends. Spanish-speaking bilingual relocation staff may be available
to speak to residents with limited English.
OPC offices are located at 41-555 Cook Street, Suite 250, Palm Desert, California. OPC
relocation staff can make accommodations as necessary to meet with the residents at
the property or at a designated location in near proximity to the property.
The Palm Desert Redevelopment Agency office is located at 73510 Fred Waring Drive,
Palm Desert, California, and Agency staff is available from 8:00 a.m. to 5:00 p.m.,
Monday through Friday.
A comprehensive relocation assistance program, with technical and advisory
assistance, will be provided to the displaced households. Close contact will be
maintained with each household.

OPC staff will provide the following services:
1. OPC will personally interview each displaced household/tenant residing on
the Property to gather information appropriate to determine the household's
eligibility for relocation assistance and benefits under the CRAL and the
Guidelines. OPC will explain to the displaced households residing on the
Property the relocation payments and other assistance for which households
and individuals may be eligible, including related eligibility requirements and
the procedures for obtaining such assistance.
OPC will personally interview each displaced household/tenant residing on
the Property to gather information appropriate to determine each
household's needs and preferences with regard to the replacement of
existing accommodations.
OPC will provide to each eligible displaced household/tenant timely referrals
to at least three comparable replacement units. If necessary, OPC will
provide transportation to such households/tenants to inspect potential
replacement units. OPC will assist the households/tenants to complete
appropriate forms and in coordinating moving arrangements. OPC will
provide the displaced households/tenants with information regarding the
timing of the Project and will provide appropriate notices and information to
prepare the households for the required moves. OPC will process
expeditiously claims for compensable expenses associated with the move.
4. OPC will provide, as appropriate, special assistance to the eligible displaced
households/tenants in the form of referrals to governmental and social
service agencies.
5. OPC will assist the eligible displaced households/tenants with the completion
and filing of relocation claims, rental applications, and appeals forms, if
necessary.
6. OPC will provide bilingual assistance, as needed.
7. OPC staff will distribute informational brochures to the displaced
households/tenants residing on the Property (Attachment 4).
G. CITIZEN PARTICIPATION/PLAN REVIEW
This Plan will be provided to each household and will be made available to the public
for the mandatory thirty (30) day review period. Comments to this Plan will be included
as a Plan addendum prior to submission for approval before the Palm Desert
Redevelopment Agency Board. A copy of the approved Plan will be forwarded to the
California Department of Housing and Community Development (HCD).

H. RELOCATION BENEFIT CATEGORIES
The Agency will provide relocation benefits in accordance with the California
Relocation Assistance Law (CRAL), the Guidelines, and all other applicable regulations
and requirements. The Agency will pay relocation benefits to the eligible
households/tenants upon submission of required claim forms and documentation in
accordance with approved procedures. The Agency will provide appropriate benefits
for each eligible displaced household consistent with the above laws and requirements.
RESIDENTIAL MOVING EXPENSE PAYMENTS
The displaced households may be eligible to receive a payment for moving expenses.
The Agency will make moving payments based upon either a fixed room count
schedule for self -moves or an invoice for actual reasonable moving expenses from a
licensed professional mover.
Fixed Payment (For Self -Moves) - A fixed payment for self -move moving
expenses based on the number of rooms containing furniture or other personal
property to be moved. The fixed moving payment will be based upon the most
recent Federal Highway Administration schedules maintained by the California
Department of Transportation. At present, the room count (4) translates into
$1,175 for a Fixed Move (Attachment 5). Displaced households electing this
option are responsible for the entire move.

2. Actual Reasonable Moving Expense Payments - The displaced households may
elect to have a licensed, professional mover perform the move; if so, the
displacing entity will pay for the actual cost of the move up to 50 miles and all
reasonable charges for packing, unpacking, insurance, and utility connection
charges. The payment will be made directly to the mover.
Pursuant to Public Law 105-1 17, aliens not lawfully present in the United States are not
eligible for relocation assistance, unless such ineligibility would result in exceptional
hardship to a qualifying spouse, parent, or child any of whom is a citizen or an alien
admitted for permanent residence. All persons seeking relocation assistance are
required to certify that they are a United States citizen or national, or an alien lawfully
present in the United States.
RENTAL ASSISTANCE/DOWN PAYMENT ASSISTANCE
Eligible displaced households that are residential tenants and established residency on
the Property for a minimum of 90 days prior to the "initiation of negotiations" will be
eligible for both Rental Assistance and Moving Expense Payments. The "Initiation of
Negotiations" is defined as the first written offer to buy the Property from which the
households will be displaced. In this case, the estimated or actual date of the first
written offer to purchase the Property is February 28, 2008. Accordingly, as displaced
persons under the Guidelines, those tenants residing on the Property prior to February

28, 2008 may be eligible for both moving payment and rental assistance/down
payment assistance as provided below.
Except in the case of Last Resort situations, Rental Assistance Payments will be limited to
a maximum of $5,250 based upon the monthly housing need over a forty-two (42)
month period.
In addition, the eligible households may opt to apply the amount to which they are
entitled toward the purchase of a replacement unit. An eligible household that opts to
utilize the full amount of its rental assistance to purchase a replacement unit will have
the funds deposited in an open escrow account, provided that the entire amount is
used for the down payment and eligible, incidental costs associated with the purchase
of a decent, safe, and sanitary replacement home. The escrow instructions would
provide that if escrow fails to close within a reasonable period of time, the entire funds
must be returned to the Agency. If escrow fails to close, eligibility for assistance in
renting a replacement unit would be determined.
To be eligible to receive the rental assistance benefits, the displaced household has to
rent or purchase and occupy a decent, safe, and sanitary replacement dwelling within
one year from the date the household moves from the displacement dwelling on the
Property.
LAST RESORT HOUSING PAYMENT
A comparable housing survey, which was completed on March 1, 2011, determined
that comparable housing was available within an 8-mile radius of the Property. A
combination of factors, including the income levels of the tenants, current rents, and
the cost of replacement dwellings, however, may create the need for Last Resort
Housing.
Last Resort Housing Payments are authorized by statute if affordable "comparable
replacement housing" cannot be found for the displaced tenant (i.e., housing not more
than 30% of the household's average monthly income). In this case, payments may be
made beyond the $5,250 statutory cap up to 42 months worth of rental assistance. The
supplemental increment beyond $5,250 may be paid in installments or in a lump sum at
the discretion of the displacing entity.
Unless the Last Resort Housing Payment is excessive, the Redevelopment Agency will
allow a lump sum payment. Likewise, if a household chooses to purchase a
replacement home rather than rent, the household will have the right to request a lump
sum payment of the entire balance to which they are entitled.
To be eligible for Last Resort Housing Payments, eligible displaced tenants must be
legally residing in the U.S.

I. PAYMENT OF RELOCATION BENEFITS
Relocation benefit payments will be made expeditiously. Claims and supporting
documentation for relocation benefits must be filed with the Agency within eighteen
(18) months from:
The date the claimant moves from the acquired property.
OR
• The date on which final payment for the acquisition of real property is made,
whichever is later. Procedures for preparing and filing of claims and processing
and delivering of payments are attached (Attachment 6).
No household will be displaced until comparable housing is located as defined above
and in Section 6008, Subdivisions (c) and (d) of the Guidelines. Relocation staff will
inspect any replacement units to which referrals are made to verify that they meet all
the standards of decent, safe, and sanitary as defined in Section 6008, Subdivision (d) of
the Guidelines. However, a household will not be denied benefits if it chooses to move
to a replacement unit that does not meet the standards of decent, safe, and sanitary
housing.
J. EVICTION POLICY
The Agency recognizes that eviction is permissible only as a last resort and that
relocation records must be documented to reflect the specific circumstances
surrounding any eviction. Eviction will only take place in cases of nonpayment of rent,
serious violation of the rental agreement, a dangerous or illegal act in the unit, or if the
household refuses all reasonable offers to move. Eviction will not affect the eligibility of
a person legally entitled to relocation benefits.
K. APPEALS POLICY
The appeals policy will follow the standards described in Section 6150 et seq. of the
Guidelines as modified by the Palm Desert Redevelopment Agency's Relocation
Assistance and Real Property Acquisition Guidelines. Briefly stated, the displaced
household will have the right to ask for review when there is a complaint regarding any
of its rights to relocation and relocation assistance, such as a determination as to
eligibility, the amount of payment, or the failure to provide a comparable replacement
housing referral. A copy of the City of Palm Desert, Palm Desert Redevelopment
Agency, and the Palm Desert Housing Authority's Relocation Assistance and Real
Property Acquisition Guidelines (Resolution 99-104, Ordinance 926A, Resolution HA-8,
Resolution HA-10, Resolution 383, Resolution 99-85, and Resolution 99105 is attached
(Attachment 7).
L. PROJECTED DATES OF DISPLACEMENT
Households will receive a 90-day written notice to vacate before they are required to
move. These notices are expected to be issued on or about April 18, 2011. Relocation
is expected to be completed for all households on or about July 18, 2011.

M. ESTIMATED RELOCATION COSTS
The displacing entity anticipates using the following funds for the relocation costs
associated with this redevelopment project:
Redevelopment Agency Funds
No Federal Community Development Block Grant (CDBG), Section 108 Loan
Guarantee, or HOME Investment Partnerships funds have been nor will be used for this
redevelopment project, nor any other funds that would make Section 104(d) of the
Housing and Community Development Act (HCD) applicable to this project.
The Agency will provide all applicable assistance and benefits required by the CRAL
and the Guidelines to the eligible displaced households. Households may qualify for
Last Resort Housing Payments based on their income.
The following summary sets forth the relocation cost estimates anticipated based on the
highest level of assistance that may be required, and assumes that all households
currently residing on the Property are eligible under the CRAL and the Guidelines for
replacement housing payments and moving payments. Thus, the relocation cost
estimates include anticipated costs for all currently -occupied units. The following
estimates may be lower if the households do not satisfy the definition of "displaced
persons" under the CRAL and the Guidelines and thus are not eligible for relocation
benefits.
The estimated relocation cost estimate does not include any payments related to
property acquisition or redevelopment. In addition, the estimated relocation cost
estimate does not consider the cost of any services necessary to implement the Plan.

Informational Statement for Families and Individuals

1. GENERAL INFORMATION
The dwelling in which you now live is in a project area to be improved by, or financed through, the
Displacing Agency using state and/or local funds. If and when the project proceeds, and it is necessary for
you to move from your dwelling, you may be eligible for certain benefits. You will be notified in a timely
manner as to the date by which you must move. Please read this information, as it will be helpful to you in
determining your eligibility and the amount of the relocation benefits you may receive under the state law.
You will need to provide adequate and timely information to determine your relocation benefits. The
information is voluntary, but if you don't provide it, you may not receive the benefits or it maytake longer to
pay you. We suggest you save this infortmational statement for reference.
The Displacing Agency has retained the professional firm of Overland, Pacific & Cutler, Inc. (OPC) to
provide relocation assistance to you. The firm is available to explain the program and benefits. Their address
and telephone number is listed on the cover.
PLEASE DO NOT MOVE PREMATURELY. THIS IS NOT A NOTICE TO VACATE YOUR
DWELLING. However, if you desire to move sooner than required, you must contact your representative
with Overland, Pacific & Cutler, Inc., so you will not jeopardize any benefits. This is a general informational
brochure only, and is not intended to give a detailed description of either the law or regulations pertaining to
the Displacing Agency's relocation assistance program.
Please continue to pay your rent to your current landlord, otherwise you may be evicted and
jeopardize the relocation benefits to which you may be entitled to receive. Once the Displacing
Agency acquires the property, you will also be required to pay rent to the Displacing Agency.
2. ASSISTANCE IN LOCATING A REPLACEMENT DWELLING
The Displacing Agency, through its representatives, will assist you in locating a comparable replacement
dwelling by providing referrals to appropriate and available housing units. You are encouraged to actively
seek such housing yourself.
When a suitable replacement dwelling unit has been found, your relocation consultant will carry out an
inspection and advise you as to whether the dwelling unit meets decent, safe and sanitary housing
requirements. A decent, safe and sanitary housing unit provides adequate space for its occupants, proper
weatherproofing and sound heating, electrical and plumbing systems. Your new dwelling must pass
inspection before relocation assistance payments can be authorized.
3. MOVING BENEFITS
If you must move as a result of displacement by the Displacing Agency, you will receive a payment to assist
in moving your personal property. The actual, reasonable and necessary expenses for moving your household
belongings may be determined based on the following methods:

• A Fixed Moving Payment based on the number of rooms you occupy (see below); or
• A payment for your Actual Reasonable Moving and Related EWennses based on at least two
written estimates and receipted bills; or
• A combination of both (in some cases).
For example, you may choose a Self Move, receiving a payment based on the Fixed Residential Moving Cost
Schedule shown below, plus contract with a professional mover to transport your grand piano and /or other
items that require special handling. In this case, there may bean adjustment in the number of rooms which
qualify under the Fixed Residential Moving Cost Schedule.
A. Fixed Moving Payment
A Fixed Moving Payment is based upon the number of
rooms you occupy and whether or not you own your own
furniture. The payment is based upon a schedule approved
by the Displacing Agency, and ranges, for example, from
$400.00 for one furnished room to $2,150.00 for eight
rooms in an u nfiimished dwelling. (For details see the
table). Your relocation representative will inform you of
the annount you are eligible to receive, if you choose this
type of payment.
If you select a fixed payment, you will be responsible for
arranging for your own move, and the Displacing Agency
will assume no liability for any loss or damage of your
personal property. A fixed payment also includes utility
hook-up, credit check and other related moving fees.

B. Actual Moving Expense (Professional Move)
If you wish to engage the services of a licensed commercial mover and have the Displacing Agency
pay the bill, you may claim the ACTUAL cost of moving your personal property up to 50 miles.
Your relocation representative will inform you of the number of competitive moving bids (if any)
which may be required, and assist you in developing a "mover" scope of services for Displacing
Agency approval.
4. REPLACEMENT HOUSING PAYMENT - TENANTS AND CERTAIN OTHERS
You may be eligible for a payinent of up to $5,250.00 to assist you in renting or purchasing a comparable
replacement dwelling. In order to qualify, you must either be a tenant who has occupied the present dwelling
for at least 90 days prior to the initiation of negotiations or an owner who has occupied the present dwelling
between 90 and 180 days prior to the initiation of negotiations.
A. Rental Assistance. If you qualify, and wish to rent your replacement dwelling, your in<ax mum rental
assistance benefits will be based upon the difference over a forty-two (42) month period between the
rent you must pay for a comparable replacement dwelling and the lesser of your current rent and
estimated utilities or thirty percent (309'0) of your gross monthly household income. You will be
required to provide your relocation representative with monthly rent and household 'income
verification prior to the determination of your eligibility for this payment.

B. Down -payment Assistance. If you qualify, and wish to purchase a home as areplacement dwelling,
you can apply up to the total amount of your rental assistance payment towards the down -payment
and non -recurring incidental expenses. Your relocation representative will clarify procedures
necessary to apply for this payment.
Where a tenant is sharing a dwelling with an owner -occupant and paying the owner -occupant rent for the
privilege, the tenant shall not be entitled to more than one-half of the rental assistance otherwise payable.
6. SECTION 8 TENANTS
When you do move, you may be eligible to transfer your Section 8 eligibility to a replacement site. In such
cases, a comparable replacement dwelling will be determined based on your family composition at the time of
displacement and the current housing program criteria. This may not be the size of the unit you currently
occupy. Your relocation representative will provide counseling and other advisory services along with
moving benefits.
6. REPLACEMENT HOUSING PAYMENT - HOMEOWNERS
A. If you own and occupy a dwelling to be purchased by the Displacing Agency for at least 180 days
prior to the initiation of negotiations, you may be eligible to receive a payment of up to $22,500.00 to
assist you in purchasing a comparable replacement unit. This payment is intended to cover the
following items:
1. Purchase Price Differential - An amount which, when added to the amount for which the
Displacing Agency purchased your property, equals the lesser of the actual cost of your
replacement dwelling; or the amount determined by the Displacing Agency as necessary to
purchase a comparable replacement dwelling. Your relocation representative will explain both
methods to you.
2. Mortgage Interest Differential - The amount which covers the increased interest costs, if
any, required to finance a replacement dwelling. Your relocation representative will explain
limiting conditions.
3. Incidental Expenses - Those one time incidental costs related to purchasing a replacement
unit, such as escrow fees, recording fees, and credit report fees. Recurring expenses such as
prepaid taxes and 'insurance premiums are not compensable.
B. Rental Assistance Option - If you are an owner -occupant and choose to rent rather than purchase a
replacement dwelling, you may be eligible for a rental assistance payment of up to the amount that
you could have received under the Purchase Price Differential, explained above. The payment will be
based on the difference between an economic rent of the dwelling you occupy and the rent you must
pay for a comparable replacement dwelling.
If you receive a rental assistance payment, as described above, and later decide to purchase a
replacement dwelling, you may apply for a payment equal to the amount you would have received if
you had 'initially purchased a comparable replacement dwelling, less the amount you have already
received as a rental assistance payment.

7. QUALIFICATION FOR, AND FILING OF, RELOCATION CLAIMS
To qualify for a Replacement Housing Payment, you mist rent or purchase and occupy a comparable
replacement unit within one year from the following:
For a tenant, the date you move from the displacement dwelling.
For an owner -occupant, the latter of:
a. The date you receive final payment for the displacement dwelling, or, in the case of
condennnation, the date the full amount of estimated just compensation is deposited in court,: or
b. The date you move from the displacement dwelling.
All claims for relocation benefits must be filed with the Displacing Agency within eighteen (18) months
from the date on which you receive final payment for your property, or the date on which you move,
whichever is later.
S. LAST RESORT HOUSING ASSISTANCE
If comparable replacement dwellings are not available when you are required to move, or if replacement
housing is not available within the monetary li nits described above, the Displacing Agency will provide Last
Resort Housing assistance to enable you to rent or purchase a replacement dwelling on a timely basis. Last
Resort Housing assistance is based on the individual circumstances ofthe displaced person. Your relocation
representative will explain the process for determining whether or not you qualify for Last Resort assistance.
If you are a tenant, and you choose to purchase rather than rent a comparable replacement dwelling, the
entire amount of your rental assistance and Last Resort eligibility must be applied toward the down -payment
and eligible incidental expenses of the home you intend to purchase,
9. RENTAL AGREEMENT
As a result of the Displacing Agency's action to purchase the property where you live, you may become a
tenant of the Displacing Agency. If this occurs, you will be asked to sign a rental agreement which will
specify the monthly rent to be paid, when rent payments are due, where they are to be paid and other
pertinent information.
10. EVICTIONS
Any person, who occupies the real property and is not in unlawful occupancy, is presumed to be entitled to
relocation benefits. Except for the causes of eviction set forth below, no person lawfully occupying property
to be purchased bythe Agency will be required to move without having been provided with at least 90 days
written notice from the Agency. Eviction will be undertaken only in the event of one or more of the
following reasons:
• Failure to pay rent; except in those cases where the failure to pay is due to the lessor's failure to
keep the premises in habitable condition, is the result ofharassment or retaliatory action or is the
result of discontinuation or substantial interruption of services;
• Performance of dangerous illegal act in the unit,

• Material breach ofthe rental agreement and failure to correct breach within the legally prescribed
notice period;
• Maintenance of a nuisance and failure to abate within a reasonable time following notice;
• Refusal to accept one of a reasonable number of offers of replacement dwellings; or
• The eviction is required by State or local law and cannot be prevented by reasonable efforts on
the part of the public entity.
11. APPEAL PROCEDURES - GRIEVANCE
Any person aggrieved by a determination as to eligibility for, or the amount of, a payment authorized by the
Displacing Agency's Relocation Assistance Program may have the appeal application reviewed by the
Displacing Agency in accordance with its appeals procedure. Complete details on appeal procedures are
available upon request from the Displacing Agency.
12. TAX STATUS OF RELOCATION BENEFITS
California Government Code Section 7269 indicates no relocation payment received shall be considered as
income for the purposes of the Personal Income Tax Law, Part 10 (commencing with Section 170 01) of
Division 2 of the Revenue and Taxation Code, or the Bank and Corporation Tax law, Part 11 (commencing
with Section 23001) of Division 2 of the Revenue and Taxation Code. Furthermore, federal regulations (49
CFR Part 24, Section 24.209) also indicate that no payment received under this part (Part 24) shall be
considered as income for the purpose of the Internal Revenue Code of 1954, which has been redesignated as
the Internal Revenue Code of 1986. No federal dollars are anticipated for this project. Therefore, federal
regulations may not apply and the IRS may consider relocation payments as income. The preceding statement
is not tendered as legal advice in regard to tax consequences, and displacees should consult with their own
tax advisor or legal counsel to determine the current status of such payments.

other applicable state and federal anti -discrimination and fair housing laws. You may file a complaint if you
believe you have been subjected to discrimination. For details contact the Displacing Agency.

ATTACHMENT 6: RELOCATION PAYMENT POLICY REGARDING PROCEDURES FOR RELOCATION
PAYMENTS AND ASSISTANCE
Relocation assistance policy
The Palm Desert Redevelopment Agency will provide all relocation assistance in
accordance with the State of California, Title 25, Housing and Community
Development Guidelines ("Code"), as amended. A copy of the Code is available at
the City Clerk's office during normal operating hours. Relocation resources shall be
available to all displaced persons without discrimination.
Claims and supporting documents for relocation assistance must be filed with the
Agency within 18 months from the date the claimant moves from the acquired
property
Relocation payment procedures
The filing and processing of claims will be as follows:
1. Claimant (s) will provide all necessary documentation to substantiate eligibility
for assistance.
2. Required claim forms will be prepared by OPC relocation personnel in
conjunction with claimant(s). Signed claims and supporting documentation will
be submitted by OPC relocation personnel to the Agency.
3. The Agency will review and approve claims for payment or request additional
information as necessary.
4. The Agency will issue relocation assistance checks for pick-up by OPC at the
Agency offices, unless circumstances dictate otherwise.
5. Final payments will be issued after confirmation that the Project area premises
have been completely vacated, and actual residency after replacement unit is
verified.
6. Receipts of payments will be maintained in the relocation case file.
