Recommendation

Committee Recommendation
At its March 22, 2011 meeting, the Audit, Finance, and Investment Committee voted
unanimously to recommend that the City Council adopt the above resolution.
Background
On February 10, 2011, the City of Palm Desert ("City") entered into a contract with the Family
YMCA of the Desert ("YMCA") that authorized the YMCA to manage the Palm Desert Aquatic
Center (`Aquatic Center"). One of the provisions of that agreement stipulates that a bank
account must be established in the City's name, and that the YMCA must deposit into that
account all monies received from Aquatic Center operations.
The YMCA/City bank account will have a two -signature requirement, with three authorized
YMCA check signers and three City check signers. The proposed City check signers are:
Paul Gibson, Finance Director / City Treasurer
Jose Luis Espinoza, Assistant Finance Director
Clayton von Helf, Manager, Information Systems
All three proposed check signers are long-term City employees.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, AUTHORIZING SIGNING AUTHORITY FOR CITY EMPLOYEES
ON THE YMCA / CITY OF PALM DESERT AQUATIC CENTER BANK
ACCOUNT
WHEREAS, pursuant to California Government Code Section 53631, the City of Palm
Desert Treasurer is authorized to open depository accounts at financial institutions in order to
receive deposits, and to pay liabilities;
WHEREAS, the City of Palm Desert ("City") has executed a Management & Operations
Agreement, dated February 10, 2011, with the Family YMCA of the Desert ("YMCA") to operate
the Palm Desert Aquatic Center ("Aquatic Center"), and said agreement requires that the City
establish a bank account for the Aquatic Center, and that the YMCA deposit into that account all
monies received from Aquatic Center operations; and
WHEREAS, said bank account will be established at the Palm Desert branch of First
Bank, and will require account signers from both the YMCA and the City.
NOW THEREFORE, BE IT RESOLVED, that the City Council does hereby authorize the
following City officers or their successors in office to have signing authority on the YMCA /
City of Palm Desert Aquatic Center bank account:
Paul S. Gibson Jose Luis Espinoza Clayton von Helf
City Treasurer Assistant Finance Director Information Systems Manager
PASSED, APPROVED, AND ADOPTED, by the City Council of the City of Palm Desert,
Riverside County, California, at its regular meeting held on this 14th day of April, 2011, by the
following vote, to wit:
