Ratify submittal of the Household Hazardous Waste 19T" Cycle (FY 2010/2011) Grant Application to CalRecycle; 2. Approve Resolution No. 2011-30 ; and 3. Authorize expenditure of awarded funds from Recycle Fund, Account No. 236-4195-454-3090. Discussion In September 2009, the Governor signed SB546 (Lowenthal) making significant changes to the California Oil Recycling Enhancement Act. As part of these changes, the California Integrated Waste Management Board was dissolved and the California Department of Resources Recycling and Recovery (CalRecycle) was created. CalRecycle has since separated programs and guidelines related to individual solid waste and recycling programs. As a result, a new resolution separating the Used Oil Payment Program from the Household Hazardous Waste Program and other diversion programs was required. In addition, staff was able to complete the application just prior to the deadline of April 15, 2011; however, this did not allow staff adequate time to submit to City Council prior to submittal. I I I I I I Therefore, staff requests that Council ratify staff's submittal of the Household Cycle (FY 2010/2011) Grant, approval of the resolution, and expenditure of funds. Gibson, Director E- U Q Johp(M/Wohlmuth, City Manager RESOLUTION NO. 2011-30 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT AUTHORIZING HOUSEHOLD HAZARDOUS WASTE GRANT APPLICATIONS AND SOLID WASTE AND RECYCLNG GRANT APPLICATIONS TO CALRECYCLE. WHEREAS, the California Department of Resources Recycling and Recovery (CalRecycle) has made available grants to assist local governments establish or expand household hazardous waste collection programs, per Public Resources Code, Division 30, Part 7, Article 3.5, Section 47200, as well as other grants for solid waste and recycling diversion programs such as beverage container and tire programs; and WHEREAS, the people of the State of California have enacted Assembly Bill 1220 (Eastin, 1993) that provides grants to local governments to establish and implement waste diversion and separation programs to prevent disposal of hazardous waste, including household hazardous waste in solid waste landfills; and WHEREAS, CalRecycle has been delegated the responsibility for the administration of these programs within the State, setting up necessary procedures governing application by cities and counties under these programs; and WHEREAS, the City of Palm Desert intends to apply for household hazardous waste grants, as well as other grants through CalRecycle to fund various waste diversion projects in the future; and WHEREAS, the City of Palm Desert will enter into agreements with the State of California for development of the projects. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Palm Desert, California authorizes the following: 1. The submittal of grant applications to CalRecycle for all available grants relative to Household Hazardous Waste and other solid waste and recycling grants for the period of January 1, 2011 through December 31, 2015; and 2. The Director of Special Programs Frankie Riddle, or a designee, is hereby authorized and empowered to execute in the name of the City of Palm Desert, all necessary applications, contracts, payment requests, agreements, and amendments hereto for the Resolution No. 2011-30 purposes of securing grant funds and to implement and carry out the purposes specified in the grant application.
