By Minute Motion, that the City Council and Agency Board:
1) Authorize Rancho Housing Alliance, Inc. (RHA) to award rehabilitation
contracts to Mostar Heavy Equipment (Fontana, California) in the amount of
$41,900 for the rehabilitation at the NSP home located at 74131 El Cortez
Way; and
2) Authorize Rancho Housing Alliance, Inc. (RHA) to award rehabilitation
contracts to Sanchez Hughes Corporation (Indio, California) in the amount of
$39,236 for the rehabilitation at the NSP home located at 77115 Florida
Avenue.
Funds are available for this project in Account No. 870-4496-466-4001.
Executive Summary
On May 21, 2009„the City Council/Agency Board approved the draft 2009-2010 NSP
Action Plan and IOU between the City of Palm Desert and County of Riverside for NSP
Funding. Two homes have been acquired and bids have been secured in order to proceed
with rehabilita 'on of these two units. Approval of the authorization will allow the staff and
the consult t to proceed with awarding the rehabilitation bids to the lowest responsible
bidder in preparation of the sale of the foreclosed homes in the targeted areas to income
qualified buyers.
Background
The City of Palm Desert, along with the County of Riverside, Cities of Coachella and Palm

Springs applied for Neighborhood Stabilization Program (NSP1) funding and was approved
for its share totaling $326,784. NSP1 can be used to acquire foreclosed properties in areas
showing the largest number of foreclosure activity in order to stabilize these
neighborhoods.
On March 11, 2010, the City Council/Agency Board approved the contract with Rancho
Housing Alliance (RHA) to facilitate the acquisition, rehabilitation, homebuyer
coordination/education, and subsequent sale of the properties acquired through the NSP
program to be done on a case by case basis. Subsequently RHA identified several
foreclosed homes and ultimately two homes were purc ased by the City for the NSP
program. The City has been reimbursed by HCD for th?.4riquisition costs. Any proceeds
received from the sale of these properties to qualifiedgnyers can be used for any NSP
eligible costs including reimbursement to the Agenc r the rehabilitation, closing costs,
additional subsidy necessary to make homes ordable to qualified buyers, or an
additional acquisition for this same purpose.
Currently, the City owns and maintains a single-family dwelling located at 74-131 El Cortez
Way in the Palma Village area, and another single-family dwelling located at 77-115 Florida
Avenue in the Palm Desert Country Club. Both properties have been inspected and
evaluated in order to determine the extent of rehabilitation required to bring to current Palm
Desert standards. The improvements to be made to each of the locations are detailed in
the attached scope sheets for each property.
On January 5, 2011, RHA opened bids in accordance with the City's purchasing
requirements, which provided the following results:

Fiscal Analysis
The immediate impact will be to the Affo dable Housing Capital Budget account in the
Housing Set -Aside fund. However, upon sale of the homes to qualified buyers, the monies
spent to acquire and rehabilitate these properties up to $325,531, will be recovered through
the sale proceeds. There will be no impact on the General Fund.

NOTICE INVITING SEALED BIDS
PUBLIC NOTICE IS HEREBY GIVEN that Rancho Housing Alliance hereinafter referred to as PROJECT
ADMINISTRATOR, invites sealed bids for General Contractor (Class B) for two Single Family Housing
Rehabilitation projects and will receive such bids in the offices of Rancho Housing Alliance up to the hour
of 2:00 PM on the 5th day of January, 2011, at which time they will be publicly opened and read aloud.
The work to be done consists of furnishing all materials, tools, labor, and incidentals as required by the
Specifications and Contract Documents for the below stated projects, including but not limited to, project
management, field supervision and contract administration. The general description of the project involves
Rehab of single-family housing for the City of Palm Desert NSP to be done consisting of but not limited to:
HVAC systems, windows and doors, interior and exterior painting, roofing, landscape and irrigation, electrical,
and plumbing.
The Projects are to be completed within 60 consecutive calendar days from the date specified in the Notice to
Proceed and turned over to Rancho Housing Alliance in a move -in ready condition. Time for commencement
and completion of the work is important, and is of the essence to the Contract.
There will be mandatory job walks held on December 1st, 2010 at the following jobsite locations and times
9:00 am located at 77-115 Florida Ave. (PDCC) Palm Desert, CA. 92211 (Bid # 1).
11:00 am located at 74-131 El Cortez Way, Palm Desert, CA. 92260 (Bid # 2).
Contractors will need bid packages in hand at project wall-thrus.
Bid packages are available for pick up after November 22"d 2010 between the hours of 8:00am to 5:00pm

When awarded contract, insurance coverage for Contractor's work on the Project shall be no
less than the following:
Commercial General Liability:
$2,000,000 - General aggregate.
$1,000,000 - Products aggregate.
$1,000,000 per occurrence.
Comprehensive Business Automobile Liability:
$1,000,000 combined single limit.
Workers' Compensation Insurance:
$1,000,000 or State statutory limits, whichever is greater.
Awarded Contractor will provide within 14 days of contract award, and prior tom specific Certificates
of Insurance and name the Project Administrator and City of Palm Desert as Additional Insured's. All
endorsements must state on the endorsement that the insurance provided is primary and non-
contributory.

GENERAL SUMMARY
The following Federal Provisions and the attached exhibits herewith become binding on the
Contractor(s) and incorporated in the Bid Document in entirety.
The Contractor and the Subcontractor(s) shall perform all work in accordance with the project
plans and specification, including all stipulations designed to meet diversified Federal
Environmental Architectural, the Architectural Barrier Act of 1968, as amended; the Americans
with Disabilities Act of 1990, Public Law 101-336, as amended.
The Contractor and the Subcontractor(s) shall allow all authorized Federal, State and/ or County
officials access to the work area, fiscal, payroll materials and other relevant contract records. All
relevant records must be retained for at least five years.
3. The Contractor and Subcontractor(s) shall comply with the Lead Based paint poisoning Prevention
Act and the Implementation Regulations (24 CFR 35) issued pursuant thereto and any
amendments thereof.
4. The Contractor and the Subcontractor(s) shall comply with Section 503 of the Rehabilitation Act of
1973 (P.L.93-112) and the Implementation Regulations (41 CFR 60 -741) issued pursuant thereto
and any amendments thereof.
5. The Contractor and the Subcontractor(s) shall comply with Section 40-2, Vietnam Era Veterans
Adjustment Assistance Act of 1974 and the Implementation Regulations (41 CFR 60-250) issued
pursuant there to any amendment thereof.
6. The Contractor and the Subcontractor(s) shall comply with the Title IV of the Civil Rights Act of
1964 and the Title Vlll of the Civil Rights Act of 1963 and any amendment thereof.
7. For Projects $100,000 or over the Contractor and the Sub- Contractor(s) shall comply with Clean
Air Act of 1963 (P.L. 90-148) and the Federal Water Pollution Act (P.L. 52-500), as amended and
all applicable standards or regulations (40 CFR part 15 and 61) issued Pursuant to the said acts.
8. The Contractor shall comply with all laws, ordinances and regulations applicable to the work. if
the Contractor ascertains at any time that any of the requirements of the contract are at variance
with applicable law, ordinances, regulations or building code requirements, he shall promptly
notify Project Administrator and shall not proceed with the work in question, except at his own
risk, until the Project Administrator has had an opportunity to determine the extent of the
responsibility for the variance and the appropriate corrective actions undertaken.
9. The Contractor shall complete and execute the attached Certification of Bidder Regarding
Segregated Facilities (Exhibit 6-4).
10. Wherever applicable, the Contractor and the Subcontractor(s) shall comply with, Uniform
Administrative Requirements for Grants and Cooperative Agreements to State, Local and Federally
Recognized Indian Tribal Governments, 24 CFR Part 85 or Uniform Requirements for Assistance to
State and Local Governments, Circular A-102; whichever is applicable.

11. Wherever applicable, the Contractor and the Subcontractor(s) shall comply with Section 109 of
The Housing and Community Development Act of 1974 and the Implementation Regulations (24
CFR 570.601) issued pursuant thereto and any ammendments thereof.
12. For projects $100,000 or over the Contractor shall submit a Bid Guarantee Bond in an amount no
less than 5% of the total contract price, along with the bid.
13. Federal Employee Benefit Clause: No member of or delegate to the congress of the United States,
and no Resident Commissioner shall be admitted to any share or part of this agreement or to any
benefit to arise from the same.
14. The Questionairre Regarding Bidders (Exhibit B-8) and List of Subxontractors (Exhibit B-9) are
considered part of the Federal Contracting Requirements and are included in the bid documents.
Both documents are required to be completed by the Prime Contractor.
15. Upon award of contract, Contractor is required to complete Contractor Certification Regarding
Status as a Section 3 Business Concern for (PA-1). This requirement applies to all tiers of
subcontractors providing or performing any portion of the work of the contract documents, prior
to work being performed.

2. Rejection of Bid; Holding Open of Bid. It is understood that RANCHO reserves the right to reject
this Bid Proposal and that this Bid Proposal shall remain open and not be withdrawn for the period of

The Bidder acknowledges that if this Bid Proposal is not fully in compliance with applicable
requirements set forth in the Call for Bids, the Instructions for Bidders and in each of the foregoing
documents, the Bid Proposal maybe rejected as non -responsive.
4. Award of Contract. It is understood and agreed that if written notice of the acceptance of this Bid
Proposal and award of the Contract thereon is mailed, telegraphed or delivered by RANCHO to the
undersigned after the opening of Bid Proposals and within the time this Bid Proposal is required to
remain open or at any time thereafter before this Bid Proposal is withdrawn, the undersigned will
execute and deliver to RANCHO the Agreement in the form attached hereto in accordance with the
Bid Proposal as accepted within fourteen (14) calendar days after notification of acceptance and
award. Concurrently with delivery of the executed Agreement to RANCHO, the Bidder awarded the
Contract shall deliver to RANCHO: (a) Certificates of Insurance evidencing all insurance coverages
required under the Contract Documents; and (b) the Drug -Free Workplace Certificate. The Work
under the Contract Documents shall be commenced by the undersigned Bidder, if awarded the
Contract, on the date stated in RANCHO's Notice to Proceed issued pursuant to the Contract
Documents. Completion of the Work and all Major Milestones shall be achieved within the Contract
Time and Major Milestones specified in the Contract Documents.
5. Notices. All notices or other correspondence shall be addressed to RANCHO and the Bidder at their
respective addresses set forth herein. Notices shall be effective only if in writing and in conformity
with the requirements for service of notices set forth in the Contract Documents.
6. Contractor's License. The undersigned Bidder is currently and duly licensed in accordance with the
California Contractors License Law, California Business & Professions Code §§7000 et seq., under

7. Designation of Subcontractors. In compliance with the Subletting and Subcontracting Fair
Practices Act (California Public Contract Code §§4100, et seq.) and amendments thereof, each Bidder
shall set forth in the Subcontractors List: (a) the name and location of the place of business of each
Subcontractor who will perform work or labor or render services to the Bidder in or about the
construction of the Work to be performed under the Contract Documents in an amount in excess of
one-half of one percent (0.5%) of the Bidder's Bid Proposal; and (b) the trade and/or portion of the
Work which will be performed by each listed Subcontractor. The Bidder shall list only one
Subcontractor for each trade and/or portion of the Work as is defined by the Bidder in its Bid
Proposal. If a Bidder fails to list a Subcontractor for a portion of the work in excess of one-half of

Subcontractor for the same portion of Work to be performed under the Contract Documents valued in

GENERAL SUMMARY
The following Federal Provisions and the attached exhibits herewith become binding on the
Contractor(s) and incorporated in the Bid Document in entirety.
1. The Contractor and the Subcontractor(s) shall perform all work in accordance with the project
plans and specification, including all stipulations designed to meet diversified Federal
Environmental Architectural, the Architectural Barrier Act of 1968, as amended; the Americans
with Disabilities Act of 1990, Public Law 101-336, as amended.
2. The Contractor and the Subcontractor(s) shall allow all authorized Federal, State and/ or County
officials access to the work area, fiscal, payroll materials and other relevant contract records. All
relevant records must be retained for at least five years.
3. The Contractor and Subcontractor(s) shall comply with the Lead Based paint poisoning Prevention
Act and the Implementation Regulations (24 CFR 35) issued pursuant thereto and any
amendments thereof.
4. The Contractor and the Subcontractor(s) shall comply with Section 503 of the Rehabilitation Act of
1973 (P.L.93-112) and the Implementation Regulations (41 CFR 60 -741) issued pursuant thereto
and any amendments thereof.
5. The Contractor and the Subcontractor(s) shall comply with Section 40-2, Vietnam Era Veterans
Adjustment Assistance Act of 1974 and the Implementation Regulations (41 CFR 60-250) issued
pursuant there to any amendment thereof.
6. The Contractor and the Subcontractor(s) shall comply with the Title IV of the Civil Rights Act of
1964 and the Title VIII of the Civil Rights Act of 1963 and any amendment thereof.
7. For Projects $100,000 or over the Contractor and the Sub- Contractor(s) shall comply with Clean
Air Act of 1963 (P.L. 90-148) and the Federal Water Pollution Act (P.L. 52-500), as amended and
all applicable standards or regulations (40 CFR part 15 and 61) issued Pursuant to the said acts.
8. The Contractor shall comply with all laws, ordinances and regulations applicable to the work. If
the Contractor ascertains at any time that any of the requirements of the contract are at variance
with applicable law, ordinances, regulations or building code requirements, he shall promptly
notify Project Administrator and shall not proceed with the work in question, except at his own
risk, until the Project Administrator has had an opportunity to determine the extent of the
responsibility for the variance and the appropriate corrective actions undertaken.
9. The Contractor shall complete and execute the attached Certification of Bidder Regarding
Segregated Facilities (Exhibit B-4).
10. Wherever applicable, the Contractor and the Subcontractor(s) shall comply with, Uniform
Administrative Requirements for Grants and Cooperative Agreements to State, Local and Federally
Recognized Indian Tribal Governments, 24 CFR Part 85 or Uniform Requirements for Assistance to
State and Local Governments, Circular A-102; whichever is applicable.

The Housing and Community Development Act of 1974 and the Implementation Regulations (24
CFR 570.601) issued pursuant thereto and any ammendments thereof.
12. For projects $100,000 or over the Contractor shall submit a Bid Guarantee Bond in an amount no
less than 5% of the total contract price, along with the bid.
13. Federal Employee Benefit Clause: No member of or delegate to the congress of the United States,
and no Resident Commissioner shall be admitted to any share or part of this agreement or to any
benefit to arise from the same.
14. The Questionairre Regarding Bidders (Exhibit B-8) and List of Subxontractors (Exhibit B-9) are
considered part of the Federal Contracting Requirements and are included in the bid documents.
Both documents are required to be completed by the Prime Contractor.
15. Upon award of contract, Contractor is required to complete Contractor Certification Regarding
Status as a Section 3 Business Concern for (PA-1). This requirement applies to all tiers of

4. Award of Contract. It is understood and agreed that if written notice of the acceptance of this Bid
Proposal and award of the Contract thereon is mailed, telegraphed or delivered by RANCHO to the
undersigned after the opening of Bid Proposals and within the time this Bid Proposal is required to
remain open or at any time thereafter before this Bid Proposal is withdrawn, the undersigned will
execute and deliver to RANCHO the Agreement in the form attached hereto in accordance with the
Bid Proposal as accepted within fourteen (14) calendar days after notification of acceptance and
award. Concurrently with delivery of the executed Agreement to RANCHO, the Bidder awarded the
Contract shall deliver to RANCHO: (a) Certificates of Insurance evidencing all insurance coverages
required under the Contract Documents; and (b) the Drug -Free Workplace Certificate. The Work
under the Contract Documents shall be commenced by the undersigned Bidder, if awarded the
Contract, on the date stated in RANCHO's Notice to Proceed issued pursuant to the Contract
Documents. Completion of the Work and all Major Milestones shall be achieved within the Contract
Time and Major Milestones specified in the Contract Documents.
5. Notices. All notices or other correspondence shall be addressed to RANCHO and the Bidder at their
respective addresses set forth herein. Notices shall be effective only if in writing and in conformity
with the requirements for service of notices set forth in the Contract Documents.

Subcontractor who will perform work or labor or render services to the Bidder in or about the
construction of the Work to be performed under the Contract Documents in an amount in excess of
one-half of one percent (0.5%) of the Bidder's Bid Proposal; and (b) the trade and/or portion of the
Work which will be performed by each listed Subcontractor. The Bidder shall list only one

It is with great regret to notify you that Sanchez Hughes Corporation withdraws as bidder for the NSP
Rehabilitation project located on Florida St. in Palm Desert Country Club. At the time our bid was
submitted, we were in the process of obtaining worker's compensation insurance which would allow us
to meet the minimum requirements to bid. Our license was exempt from having workers compensation
insurance with the Contractor's State License Board. However, we knew it was a requirement to work
on the projects through the NSP program.
Unfortunately, the costs for obtaining the insurance surpassed the profit margin we had in the bid. I
apologize for not being able to contact you in a timelier manner; however,w a did not obtain our quote
until last Friday from the State Compensation Insurance Fund.
I do look forward working with you on future opportunities that may be more feasible for our company.

$41,900 for the rehabilitation at the NSP home located at 74131 El Cortez
Way; and
2) Authorize Rancho Housing Alliance, Inc. (RHA) to award rehabilitation
contracts to SaRGhez Hughes GeFperatien AA Max Quality Construction
(Indio, California) in the amount of $39,236 $41,724 for the rehabilitation at
the NSP home located at 77115 Florida Avenue.
Funds are available for this project in Account No. 870-4496-466-4001.
Executive Summary
On May 21, 2009, the City Council/Agency Board approved the draft 2009-2010 NSP
Action Plan and MOU between the City of Palm Desert and County of Riverside for NSP
Funding. Two homes have been acquired and bids have been secured in order to proceed
with rehabilitation of these two units. Approval of the authorization will allow the staff and
the consultant to proceed with awarding the rehabilitation bids to the lowest responsible
bidder in preparation of the sale of the foreclosed homes in the targeted areas to income
qualified buyers.
Background
The City of Palm Desert, along with the County of Riverside, Cities of Coachella and Palm
Springs applied for Neighborhood Stabilization Program (NSP1) funding and was approved

for its share totaling $326,784. NSP1 can be used to acquire foreclosed properties in areas
showing the largest number of foreclosure activity in order to stabilize these
neighborhoods.
On March 11, 2010, the City Council/Agency Board approved the contract with Rancho
Housing Alliance (RHA) to facilitate the acquisition, rehabilitation, homebuyer
coordination/education, and subsequent sale of the properties acquired through the NSP
program to be done on a case by case basis. Subsequently RHA identified several
foreclosed homes and ultimately two homes were purchased by the City for the NSP
program. The City has been reimbursed by HCD for the acquisition costs. Any proceeds
received from the sale of these properties to qualified buyers can be used for any NSP
eligible costs including reimbursement to the Agency for the rehabilitation, closing costs,
additional subsidy necessary to make homes affordable to qualified buyers, or an
additional acquisition for this same purpose.
Currently, the City owns and maintains a single-family dwelling located at 74-131 El Cortez
Way in the Palma Village area, and another single-family dwelling located at 77-115 Florida
Avenue in the Palm Desert Country Club. Both properties have been inspected and
evaluated in order to determine the extent of rehabilitation required to bring to current Palm
Desert standards. The improvements to be made to each of the locations are detailed in
the attached scope sheets for each property.
On January 5, 2011, RHA opened bids in accordance with the City's purchasing

Based upon the withdrawal letter from the low bidder, staff recommends authorizing RHA
to award contract to AA Max Quality Construction for the rehabilitation of the single-family
dwelling on Florida Avenue. Staff has confirmed in writing with AA Max Quality
Construction that lump sum bid includes addendum #1.
Fiscal Analysis
The immediate impact will be to the Affordable Housing Capital Budget account in the
Housing Set -Aside fund. However, upon sale of the homes to qualified buyers, the monies
spent to acquire and rehabilitate these properties up to $325,531, will be recovered through
the sale proceeds. There will be no impact on the General Fund.
