Recommendation
By Minute Motion:
1. Authorize the Mayor to execute a quitclaim deed to eliminate an
existing 10-foot wide drainage easement over Lot 41 of Tract No.
4980, M.B. 80/43-45, Office of County Recorder, Riverside County
(APN 630-190-047); and
2. Accept an 8-foot wide drainage easement instead to better
accommodate the future house footprint.
Background
By Grant of Easement that recorded May 18, 1993, the City acquired a 10-foot wide
storm drain easement through Lot 41, Assessor's Parcel No. 630-190-047, which is a
vacant lot between Ironwood Park and Haystack Road. The easement accommodates
the drainage out of Ironwood Park to Haystack Road.
The lot owner has had house plans prepared for this property and, in order to make
better use of the lot, is requesting that the City's existing storm drain easement be
reduced by two feet. Staff has analyzed the request, which included a field inspection,
and also required the owner to pot hole for the physical location of the storm drain line.

Staff has resolved that the easement can be reduced by two feet and not affect the
City's ability to maintain its facility.

An easement for the operation and maintenance of the underground storm drain facility and
emergency overflow, in, over and upon the westerly 8.00 feet of Lot 41 of Tract No. 4980 in the City
of Palm Desert, County of Riverside, State of California, as per map filed in Book 80, Pages 43
through 45 inclusive of Maps in the office of the County Recorder of said county.
