Waive further reading and adopt Resolution No. 2011- 4 vacating excess emergency vehicular access easement (EVAE) over Lot H of Tract No. 25296-3, Bighorn Development, which was dedicated by Bighorn Development and accepted by the City in said map. Background The subject EVAE is located over all of Lot H, designated as a landscape lot, in Tract No. 25296-3, of the Canyons at Bighorn project, which is located east of Highway 74 in the south end of the city. The EVAE was dedicated to the City and accepted on the aforementioned map by the City Council on January 13, 2000, and which said map was recorded with the County of Riverside on March 3, 2000. The EVAE is considered excess by staff because another EVAE exists in close proximity to the subject EVAE that is paved for vehicular use where the subject EVAE is landscaped in natural terrain. The fire department endorses this action and staff has Staff Report Adopt Resolution Vacating a EVAE at Bighorn Development January 27, 2011 Page 2 of 2 determined that there is not a future need for the subject EVAE. This easement has never been used as an EVAE. This particular case meets all of the requirements of a "summary vacation" pursuant to the California Streets and Highways Code, Division 9, Part 3, Chapter 4, whereby the vacation procedure does not involve an evaluation from the Planning Commission nor the scheduling of a public hearing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF PALM DESERT, CALIFORNIA, AS FOLLOWS: Section 1. That the emergency vehicular access easement over Lot H of Tract No. 25296-3 be vacated as described and as set forth in Exhibit "A" attached hereto; and Section 2. That the City Clerk of the City of Palm Desert, California, shall cause a certified copy of this resolution and order to be recorded in the Office of the County Recorder of Riverside County, California; and Section 3. That from and after the date this resolution is recorded, the subject emergency vehicular access easement will no longer constitute a public service easement.
