Recommendation
Receive and file this clarification report regarding the annual approval of the
final Engineer's Report and order to levy for the Palm Desert Benefit
Assessment District No. 1 for Fiscal Year 2011/2012.
Background
At its June 23, 2011, meeting the City Council considered the annual approval of the Palm
Desert Benefit Assessment District No. 1 (District). This district was formed to maintain
drainage systems within Section 29. During the Public Hearing, staff was asked by
Councilman Spiegel if the assessment was increasing, to which staff answered no. Staff
was in error on this statement, and should have communicated to the Council that the levy
is increasing within the allowable limits that are built into the District. In this case, each
parcel's levy is going from $436.62 to $449.72 per year, which represents the 3 percent cost
of living increase allowed by the District. Staff apologizes for the miscommunication on this
matter.

Final Engineer's Report FY 2011/2012
Recommendation
Waive further reading and adopt:
1. A resolution of the City Council of the City of Palm Desert,
California, approving the annual Engineer's Report and ordering the
levy and collection of assessments within the City of Palm Desert
Benefit Assessment District No. 1, for Fiscal Year 2011/2012,
pursuant to the provisions of the Benefit Assessment Act of 1982 (Res. 2011-56)
Background
The City of Palm Desert Benefit Assessment District No. 01 (District) was formed to
assess property owners for the maintenance of the drainage system within Section 29.
The District was formed pursuant to state law and maximum levy amounts were set at
that time. Each parcel is assessed based on a weighted measure of apportionment
known as Equivalent Benefit Unit (EBU), which may take into consideration land use,
development status, size of the property, location of the property, development plans or
restrictions, vehicular trip generation, street frontage, densities or other property related
factors.
At its regular meeting of May 26, 2011, the City Council initiated the proceedings and
set a public hearing date of June 23, 2011. The attached resolutions would approve the
final Engineer's Report and call for the levy for Fiscal Year 2011/2012 pursuant to the
requirements of state law.

Fiscal Analysis
The assessment and collection of the full levy amount funds the on -going maintenance
of the Section 29 retention basin and associated staff costs relieving the City from any
financial burden.
