CITY OF PALM DESERT SPECIAL PROGRAMS DEPARTMENT STAFF REPORT REQUEST: APPROVE THE 2011 ROCK 'N' ROLL NEW YEAR'S EVE HALF MARATHON EVENT AND SPONSORSHIP SUBMITTED BY: Frankie Riddle, Director of Special Programs DATE: July 14, 20111 CONTENTS: Rock `n' Roll Marathon Series Pamphlet Route Map Including Band, Medical, and Water Stations Detailed List of Band, Medical, and Water Station Locations Detailed List of Road Closures Sample Community Outreach Brochure for Dallas Event Recommendation By Minute Motion, approve the following: 1. The 2011 Rock 'n' Roll New Year's Eve Half Marathon scheduled for Saturday, December 31, 2011, with the condition that a Traffic Control Plan is approved by City staff; 2. Proposed event route and road closures; 3. Approval of band placement; 4. Waiver of Section 11.01.140 —Amplified Sound; 5. Waiver of Chapter 5.84 — Distribution of Literature, Peddling, and Solicitation; 6. Sponsorship in an amount not to exceed $54,000 to be paid directly for police services rendered and paid directly to the police department from Account No. 110- 4416-414-3062; and 7. Appropriation of funds in the amount of $54,000 from FY 2011/2012 Unobligated General Fund Reserve to Account No. 110-4416-414-3062. Executive Summary The City of Indian Wells approached the City of Palm Desert to determine its interest in partnering with the Indian Wells Tennis Garden, the Competitor Group (i.e., the event organizer), and the City of Indian Wells to produce a 2011 Rock'n' Roll New Years Eve Half Marathon within the two cities. The event organizer has a positive reputation and history of planning and producing these large scale events within other communities (e.g., San Diego, Los Angeles, Phoenix, Seattle, Dallas, Virginia Beach, Miami Beach, etc.) as well as having a successful brand name "Rock 'n' Roll Marathon". Their past events have been quite STAFF REPORT 2011 ROCK `N' ROLL NEW YEAR'S EVE HALF MARATHON EVENT AND SPONSORSHIP J U LY 14, 2011 PAGE 2 successful and many of their marathons have upwards of 20,000 to 30,000 runners. This event has the potential to bring many visitors to our cities, which means increased revenue due to participants' and spectator use of hotels, restaurants, and shops. Participants will arrive on Friday, December 30, 2011, for registration (the day before the event), participate in the event on Saturday, December 31, 2011, and possibly stay until Sunday, January 1, 2012 or Monday, January 2, 2012. Since it is New Year's weekend and Monday is the recognized holiday, visitors could potentially stay from two to four nights. The Rock 'n' Roll New Year's Eve Half Marathon date has been set for Saturday, December 31, 2011, from approximately 10:00 a.m. (start time) to a 3:00 p.m. (completion time for the actual run). The event will start and end at the Indian Wells Tennis Garden where pre and post activities will take place. The Tennis Garden will provide sufficient parking and event space to accommodate the planned 7,500 to 9,500 (cap) runners. Palm Desert City Council granted conceptual approval of this event at its meeting of December 9, 2010. Council directed staff to bring this item back once event details had been worked out for final approval. The Indian Wells Planning Commission conceptually approved the Rock 'n' Roll Half Marathon at its meeting of November 16, 2010, as well as conceptual approval by the Indian Wells City Council at its meeting of December 16, 2010. Palm Desert staff continued to work with the Competitor Group and the City of Indian Wells to finalize most of the details associated with this event as noted within this staff report. Indian Wells City Council at its meeting of July 7, 2011, granted final approval of the event, the route, band location(s) within their community, sponsorship in the amount of $53,400 ($18,400 police services and $35,000 marketing); however, the sponsorship was conditioned as follows: The Competitor Group will receive half ($26,700) with the approval; however, in order to receive the second half ($26,700) the event sponsor must show that 3,000 or more room nights were in Indian Wells. Background Staff has had various meetings with representatives of the City of Indian Wells, the Competitor Group, and the Tennis Garden to discuss event details relative to the Rock 'n' Roll Half Marathon such as operational issues, route, road closures, community impact and outreach, costs, etc. Provided below is information on pertinent details relative to the event: The primary details for Council consideration are as follows: Sponsorship: The Competitor Group requested a sponsorship from the City in the amount of $54,000 to offset police services as well as another $20,000 for marketing. Staff is recommending approval in an amount not to exceed $54,000 to be paid directly to the Riverside County Sheriffs Department for services rendered; however, staff is not recommending sponsorship for marketing. Route: The route will start and end at the Indian Wells Tennis Garden (review Attachments B and C for details related to the route). STAFF REPORT 2011 ROCK `N' ROLL NEW YEAR'S EVE HALF MARATHON EVENT AND SPONSORSHIP JULY 14, 2011 PAGE 3 Traffic Control Plan: Intersections and side streets along the route will require some type of closures/barricades, which will be outlined within the approved Traffic Control Plan. Staff is currently working with the Competitor Group to develop the actual plan. According to the Competitor Group, the actual plan is not created until after approval of the event and the route is received. On July 1, staff conducted a phone conference with the event coordinator to discuss specific requirements that the City would require such as water filled barricades and the potential costs associated with this type of plan. A follow up meeting has been scheduled for July 14, to continue discussions on the development of the Traffic Control Plan with the intent that a detailed preliminary plan will be submitted by July 31, 2011. The event sponsor stated that they will work with the City and the Police Department to create an approved plan and that this issue will not affect the event, nor would they approach the City to request additional funds to cover any unforeseen costs. Landlocked Areas: Businesses and residents north of Fred Waring Dr. to south of Hovley Lane East between Cook St. (including Desert Rose) to Portola and San Pablo will be landlocked for approximately four hours from 9:00 a.m. to 1:00 p.m. the day of the event. However, where possible, the road closures/barricades setup will allow residents/drivers to proceed through with the assistance of an officer. Residents and others should be able to move throughout the City on a slower basis until the actual start of the event at 10:00 a.m. After the event starts, drivers will be allowed through closures where provided for and when the police feel it is safe for runners and vehicular traffic, specifically in the landlocked areas (i.e., Fred Waring/Cook, Fred Waring/Portola, Hovely/Cook, and Portola/Hovely). Once all runners are through the Fred Waring/Cook, Fred Waring/Portola, and Portola/Hovely Lane East intersections, streets will be opened as soon as possible thereafter and most, if not all of the businesses/residents within the landlocked areas will have access throughout the community. (It is anticipated that runners will be through the intersection of Portola/Hovely Lane East at 1:00 p.m.) In addition, as long as drivers are allowed through the barricades with the assistance of police, the impact to the community will not be as significant as complete street closure(s); however, there will still be some impact. Community Impact and Public Relations Plan/Outreach: City staff and the Competitor Group will undertake various actions to inform residents of the event, route, road closures, etc. Notification will include articles in the BrightSide, the City's website, and via press releases. Residents and businesses within the landlocked areas will also be targeted to receive door hangers provided by the Competitor Group that will specifically inform them of the event, route, road closures, and what their options are if they need to leave the area. Alternative parking will be suggested within the neighboring residential communities that will not be landlocked (north of Fred Waring and south of Rutledge between Deep Canyon and Portola), Sacred Heart Church, and commercial facilities with parking lots along the south side of Fred Waring that will not be open on this day. Staff has informed the Competitor Group that they will need to approach the church and other commercial locations in the area to obtain approval to utilize parking lots for business/residents parking. Since STAFF REPORT 2011 ROCK 'N' ROLL NEW YEAR'S EVE HALF MARATHON EVENT AND SPONSORSHIP J U LY 14, 2011 PAGE 4 the major intersections are planned to allow through traffic, residents may not choose this option; however, it is available as an alternative. (Attached is a sample community relations brochure from the 2011 Rock 'n' Roll Half Marathon in Dallas.) Band Locations: The attached map reflects 10 sites for placement of bands along the course that are approximately one mile apart. Staff reviewed the proposed original locations and made recommended changes, which have been reflected in the attached map. Staff will continue to work with the event sponsor to ensure that bands are placed so that they are compatible with the surrounding neighborhoods at each specific location. The last band (which will be the headliner) will play at the Indian Wells Tennis Garden until 3:00 p.m., at which time the event will end. Bands along the route will cease playing once all of the runners come through that particular location. The music usually ranges from 80's, 90's, and Top 40. The event sponsor is aware of the sound ordinance as well as neighborhood sensitivities. As such, they have agreed to work with staff on band placement. Again, sponsor does not usually contract with performers until after they receive approval. Host Hotel: The Competitor Group has a signed agreement with Marriott Desert Springs Hotel to be one of the host/headquarter hotels. (The Hyatt Grand Champions in Indian Wells will also be a host/headquarter hotel.) The Competitor Group's website will also list other hotels within each city to give attendees an option. The Marriott has confirmed that they are working on finalizing an agreement to be one of the host hotels and are in support of the event. Marketing: The Competitor Group has already undertaken a soft promotion of this proposed event at its recent marathon in San Diego on Sunday, June 5, 2011. Apparently, from that announcement, there are approximately 522 runners already registered as of July 5, 2011. Included as part of their marketing strategy is the following: printed materials, digital media blasts, website, and goodie bags given out at expos and other events, all of which are done locally, regionally, and nationally. Competitor Group noted that the Indian Wells/Palm Desert event would be launched via press conference after obtaining final approval from each city's respective council. The Competitor Group has indicated that registration for this event will take place on Friday, December 30, 2011, which will require participants to arrive in town the day before the actual event and stay at least one night. Since the actual event is on Saturday, New Year's Eve, and this is a three (3) day holiday weekend, it is anticipated that some of the participants may stay in town and enjoy the New Year's Holiday until Sunday or Monday, making it a weekend getaway. The Rock 'n' Roll Half Marathon is 13.1 miles with demographics that reflect 38 percent are male and 62 percent are female runners between the average ages of 24 and 44 with 64 percent earning between $75,000 - $100,000+. Since this is a holiday weekend, many will bring their spouses or significant others, as well as spectators and others that will be in town as a result of the event. Estimations provided by the Competitor Group reflects that this event could potentially generate approximately 13,000 room nights and have an economic impact to the local economy of approximately $12,000,000 to the Coachella Valley. STAFF REPORT 2011 ROCK `N' ROLL NEW YEAR'S EVE HALF MARATHON EVENT AND SPONSORSHIP J U LY 14, 2011 PAGE 5 The potential benefits of the Rock 'n' Roll Half Marathon will be increased revenue to our local businesses such as hotels, restaurants, shops, etc., as well as national and international marketing and promotion of Palm Desert and the Coachella Valley. Fiscal Analysis The fiscal impact to the FY 2011/2012 General Fund Reserve will be the sponsorship amount up to $54,000 for police services rendered. Staff recommends that City Council approve the 2011 Rock `n' Roll New Year's Eve Half Marathon, sponsorship cost, and other details outlined in the recommendation above. The event would cause traffic in our neighborhood to be rerouted from 9:00 am to noon and homes in our community (Venezia) being land locked. This is one of the worst dates of the year to hold such a disruptive event. The Palm Desert segment of the event would occur in the morning of a major holiday during the height of the "snow bird" season when a maximum number of homes in the community are occupied. There will also be a large number of visitors staying at residences -- owners and their guests will be busy preparing for New Year's eve celebrations. They need to be able to drive in and out of the community during the morning, afternoon, and evening hours. The event appears to be sponsored by a profit making corporation and I understand that there is an entry fee of $175 per person which hopefully would be used in part to pay for any services that the local governments would have to provide. As a matter of public policy, government property should not be used to benefit a private corporation -- especially if the event results in substantial inconvenience to tax paying residents or if government subsidies are to be provided. This corporation apparently holds similar events in San Diego and a number of other larger US cities where such events can presumably be held with routes that are primarily through commercial districts -- not residential areas. One could plan a 12/13 mile route that would go from one end of the Coachella Valley to the other exclusively along major roads such as Route 111 and Fred Waring Drive without having to land lock any residential communities -- if this can not be done, the event should not be approved. What is the purpose of this event, who proposed it and whom will it benefit? It was indicated that parts of Hovley Lane East would be closed during that timeframe. We operate Stor-n-Lock Self Storage at 74-853 Hovley Lane East. This event would take place on the 'last' day of the year, which is typically a very busy day for our customers, especially since it is a Saturday and we are closed on New Years Day. Many people are trying to access their storage spaces during this timeframe and either drop items off, or pick up stored items. The last day of the month is always a busy time for us and our customers. Plus, it is usually the busiest time of the month for people who are moving out. Others are simply stopping in the office to pay the following months rent. Closing or being inaccessible would create a hardship for our customers and for our business. The notice did not indicate a traffic plan. Apparently this is still under review. Consideration should be given to businesses who are open and whom could be negatively affected by the final traffic plan. I am in favor of community activities and events that provide a positive benefit to those who live and work in the area. But I cannot support activities that have a negative effect on my business and my customers. Please let me know what the final traffic plan will be so we can plan accordingly. I will try to attend the meeting but want to make sure you have this information in case I am not able to attend. We are a Dialysis Center located on the corner of Hovely Lane East and Corporate Way between Portola and Cook. We are open six days a week providing Dialysis 13 hours each day. On Saturday we average 48 patients spread over three shifts. Our turn over — that is when patients are ending treatment and departing the clinic and the next group of patients are arriving - occur between 8 — 10 AM and 11:00 AM to 1:00 PM. During those two time periods 32 patients will be crossing paths coming in and out of the building. Transportation varies between self/family transport, professional transportation services and non emergency ambulance. We will need to maintain access to the clinic during these time periods. If alternate routes of entry to the clinic are established we can communicate that prior to the event to our patients and their drivers. We would appreciate you assistance on this as to which would be the most efficient route(s) to use. As you have already noted emergency vehicles would need to be able to access the clinic in the most direct route possible. Please feel free to contact me with any questions. Here are just some of the reasons: --Like many others, we plan to drive out of our local area to have dinner and celebrate 2012; we don't need to leave before 10 a.m. (actually prior to that we are sure the streets will be blocked) and would want to leave around 2 p.m. --right in the middle of this marathon. --Like others, we could be called in at the last minute to work at Eisenhower Medical Center where we volunteer; --Like others, we could need to go to see a doctor that day, yet not need an ambulance to get there. These are only 3 of the reasons we came up with that could be interfered with if streets in our area are completely blocked for six hours on what amounts to a very busy holiday weekend. Who or what organization is sponsoring this marathon? Why is it so important to be held on a busy day of the year? We have noted organized bicycle events on Portola that did not cause that street or the streets surrounding the event to be totally blocked. Why is it necessary for this event? Has the applicant for this event provided you with a plan for which streets would be affected? We would certainly want to know that and could probably come up with some other reasons this whole thing is not a good idea. We think it is commendable that the Palm Desert City Council thought that this issue was important enough and affected a significant number of the city's citizens to send the subject notice to those citizens affected and ask for our input. We cannot, however, attend the meeting personally because we will be working at Eisenhower Medical Center as volunteers during the time your meeting occurs. As a former runner and cyclist I participated in numerous organized events through out California and Mexico which did not require land locking homes. Does Palm Desert lack the intellectual capability to plan such an event without land locking homes or is the City merely responding to an applicant who lacked the ability or common sense? The event however does raise the issue once again that our Storm Channels are not being adequately utilized for recreational purposes. I personally used the Jedediah Smith trail in the American River flood plain numerous times every week, logging many thousands of miles until I relocated to Palm Desert. Not having a recreational trail the entire length of the White Water Storm Channel is a travesty of missed opportunity. Can you imagine the tourist draw, the public health benefits, and the ease of routing events such as Rock N Roll through a White Water trail? Perhaps such a trail was simply not shovel ready? I hope you are able to efficiently resolve the Rock N Roll event routing issue with intelligence rather than utilizing hours of City staff time, additional legal notices and public hearings. What greater good will be accomplished by having "a multitude of homes," as the notice puts it, landlocked for hours on what is often a very busy day in preparation for the New Year's Day holiday? We find it distasteful that the city would consider an event that would land lock residents for as many as three hours of time at the start of a holiday weekend. Many of our residents will be out and about getting ready for the guests expected for the New Year's holiday, the first such New Year's holiday that includes a weekend in 6 years. It appears that this decision has already been made and now the city is just making sure all the legalities are handled, considering that the profit making entity which sponsors these events has been advertising and collecting fees for the event for more than a month. We ask that if the city approve such an event that it does not impact our residents directly by keeping them in their homes. We ask that an alternate route be designed and approved that would not land lock our community. If an alternate route can not be agreed upon, then we remain strongly opposed. It will be bad enough getting around Palm Desert for the day to do all the things that normally need to be done on a Saturday. I am unable to attend the hearing this Thursday, July 14th in the Council Chamber to be heard in regards to the planned marathon on New Year's eve. This email will express my concerns regarding the event. Because FW Drive is multi lanes, would you please consider limited traffic to flow in and out of our home owner association? Your notice mentions that parts of Fred Waring will be "land locked" and with a multi -lane street it does not seem necessary to block traffic in all 6 lanes for the event occurring from 10am to 4pm. Even though we may be slightly inconvenienced I feel that this event is a positive healthy thing for our citizens and visitors to do on New Years eve. I am strongly opposed to Council sponsorship of this event in terms of funding $54,000, as well as street closures resulting in land locking your constituency. My reason's are as follows: • In terms of the City of Palm Desert sponsorship in the amount of $54,000, for police services, I would like to state that The Competitor Group is a for profit company that makes substantial profit from this event. They should be paying us for the additional police services needed for their event. In terms of street closures, I am happy to endure occasional inconveniences for our local community charitable events. But this event is neither local nor charitable. The Competitor Group is a for profit company. The event begins and ends in the City of Indian Wells yet the majority of street closures resulting in "land locked" situations are in Palm Desert. Land locking homes for any length of time is not acceptable. But most especially on New Year's Eve when people want and need to be out shopping in Palm Desert preparing for the evening's festivities and taking advantage of all the New Year's Eve sales. The community impact and public relations outreach planned for after Council approval should have taken place prior to the public hearing. In closing I would like to state that I am all for marketing our beautiful city, and I understand the importance of bringing people in.
