Palm Canyon Cathedral City, CA 92234 CASE NO: TUP 11-202 DATE: June 23, 2011 CONTENTS: Applicant Statement Site Plan Recommendation That the City Council provide staff direction on a requested Temporary Use Permit for Recreational Vehicle (RV) sales located within the Sam's Club parking lot. Upon Council consideration, direct staff to modify, approve or deny the proposed temporary use. Background On May 31, 2011, Mike Thompson RV submitted an application for a Temporary Use Permit to conduct RV sales on the dates July 7 — July 10, 2011 from 9:00 a.m. to 6:00 p.m. in the Sam's Club parking lot on Monterey Avenue. Special private or public events require a Temporary Use Permit and allow each business or applicant to use up to ten days per calendar year. Staff discovered that Mike Thompson RV had already used the allowable ten days during previous events. The applicant is requesting 24 - 30 more sales days through the end of this year. The applicant requests approval for a four day event from July 7 — 10 from 9:00 a.m. to 6:00 p.m. Along with this request, the applicant has asked to hold monthly events through December 2011. Each event would be held within the first fourteen days of the month and would last no longer than four or five days. This flexibility would allow the applicant to work out appropriate dates with the property owner. Staff is requesting that the City Council provide direction on the proposed Temporary Use Permit to allow RV sales on the dates and location requested. If approved, the applicant would be required to obtain a daily City Business License, complete, and return appropriate sales tax forms after each event. To date, the applicant has generated interest during past events in Palm Desert, and then returned to Cathedral City to complete the sales transactions. Therefore, no sales tax revenue has been received by Palm Desert from the past events. In the event that the City Council elects to grant the applicant's request, staff recommends that the following conditions be imposed on the Temporary Use Permit: • Applicant must obtain a daily City Business License for all dates on which the temporary use is conducted. • Applicant must apply for and be granted by the State Board of Equalization a Sublocation for the Palm Desert site and credit Palm Desert as the point -of -sale for all revenue generated from transactions originating from this approved temporary use. Fiscal Analysis Fiscal impact regarding the approval of the Temporary Use Permit for Mike Thompson RV sales would result in a sales tax benefit of any units sold during future events. These units generally range in price from $25,000 to $250,000. We would like to have one sale within the first 14 days of each month from now through Dec. 2011.Thi6, would be a 4 or 5 day sale. This should be a win win situation for Mike Thompson and the City of Palm Desert. This will help us generate sales for ourselves which should increase business for Sam's Club and sales tax revenue for Palm Desert. Our sales price is greater than $25K per unit and as high as $250K per unit with 1 % of the sales tax going to the City of Palm Desert. These sales also help us maintain a sales force any where from 5 to 15 salesmen and service crew of 4, which also stimulates the local economy. We would be happy to go over figures and projections with you or your representatives. Please advise as to how to proceed.
