STAFF REPORT
REQUEST: STREAMLINE THE USE OF VARIOUS VENDORS WHO PROVIDE
QUALIFIED SERVICES BY APPROVING AN ABATEMENT
SERVICES VENDORS LIST, AND GRANT EXEMPTION TO
BIDDING REQUIREMENTS AS PROVIDED FOR BY SECTION
3.32.090 OF THE MUNICIPAL CODE FOR THE REMAINDER OF
FISCAL YEAR 2010-2011, AND FISCAL YEAR 2011-2012
SUBMITTED BY: Pedro Rodriguez, Senior Code Compliance Officer
DATE: March 24, 2011
CONTENTS: Abatement Services Vendors List
Recommendation
By Minute Motion:
1. Approve and authorize staff to use vendors on the Abatement Services
Vendors List appended to this report; and
2. Approve exemption to bidding requirements as provided for by Section
3.32.090 of the Municipal Code for the remainder of Fiscal Year 2010-2011
and Fiscal year 2011-2012.
Background
The Code Compliance Division utilizes a variety of abatement contractors regularly
throughout the year. In order to create a list of qualified, cost effective vendors to use,
staff compiled a list of local vendors and service providers capable of offering
immediate services to abate conditions that threaten the health, safety and general
welfare of the public. A notice was also publically posted inviting interested parties to
submit letters of interest, their business and contractors' license information, and
evidence of insurance coverage. Approval of the use of the qualified providers allows
the City to save money and time, thereby providing for more efficient operations and
cost savings. The approval of the list will simplify the process to acquire the services as
needed.
Section 3.32.090 of the Palm Desert Municipal' Code exempts from portions of the
procurement processes certain services that are unique or not subject to competition
from the bidding process. Code Compliance utilizes this section (including the authority
granted in Chapter 8.20, Public Nuisances) to address urgent situations that require

expedited abatement to protect the health, safety and general welfare of the public.
These abatement services are unique in that they combine the need for prompt action
with a scope of work that varies from one purchase to the next — no two properties
require the same abatement work, but they each need immediate action to protect the
health, safety, and general welfare of the public. Because the scope of work is not
known until the condition requiring abatement arises, there is not sufficient time to
solicit bids without endangering the health and welfare of the public.
In addition to code compliance cases that require abatement, foreclosure properties
have created an impact on residential communities. These properties are abandoned
and left behind with green, stagnate swimming pools that have the potential to
propagate the deadly West Nile Virus; odorous, decaying items that include household
trash and other offensive material that is in close proximity to adjoining properties;
excessively dry grass, weeds and other plant matter that is determined to pose a
potential fire hazard to surrounding properties; beehives that are found by virtue of their
location to be an immediate threat to surrounding residents and pedestrians; and other
related situations that may adversely affect the health, safety and general welfare of the
public. Abatement services for any given property typically cost less than $500, but
occasionally reach several thousand dollars.
Approval of the staff recommendation will ensure that vendors can be engaged quickly,
and that if the value of their work exceeds a cumulative amount of $10,000 during the
course of a year, they can continue to provide contractor abatement services to the City
if they are on the abatement services vendors list. Purchases and/or services valued at
more than $25,000 will follow the standard procedure for procurement. Staff, therefore,
requests that City Council approve the use of these local vendors and services
providers for the remainder of 2010-2011, and 2011-2012 fiscal years.
Fiscal Analysis
Approval of this request will result in savings to the City in the form of stoffl ti
effort by reducing work and avoiding delays in procurement of contracto b
services.
