Authorize the City Clerk to file a Notice of Completion for Perimeter Landscape
Improvements at the Northeast Corner of Larkspur Lane and Shadow Mountain
Drive with Earth Sculptures, Inc., Contract No. R30380, Project No. P87110.
Executive Summary
Approval of staff's recommendation authorizes the City Clerk to file a Notice of Completion for
perimeter landscaping improvements along both street frontages at the northeast corner of
Larkspur Lane and Shadow Mountain Drive.
Background
The subject properties are located at the northeast corner of Larkspur Lane and Shadow
Mountain Drive (APN 627-262-008 and APN 627-262-011) and are zoned C-1 and R-3
respectively. The properties are located east of The Gardens on El Paseo and total 91,684
square feet in area (2.10 acres). They are the only unimproved properties visible from El Paseo.
On January 13, 2011, the Agency Board awarded Contract No. R30380 in the amount of
$42,044.00 to Earth Sculptures, Inc. for the perimeter landscape improvements of Larkspur
Lane and Shadow Mountain Drive. The properties have since been transferred to the City.
The improvements provide a 15-foot wide landscaping perimeter along both street frontages
that provide a visual buffer between the vacant properties and the street. The improvements
also included removal of three (3) palm trees in the center of the property for the location of a
temporary tent used during Fashion Week. A row of fast-growing Tecoma Stans shrubs that
when grown will provide a visual buffer of the adjoining residential complex to the east. The

City's Landscape Services Division prepared the irrigation and landscape plans and assisted
the Agency with the project oversight, inspection, and technical review of the installation. The
Agency will reimburse the City for staff time.
In addition, two (2) lengthy curb approaches totaling 250 lineal feet were eliminated and
replaced with curb and gutter. Installation of bollards connected by wire rope at the three (3)
remaining curb approaches limit unauthorized vehicular access to the property.
The subject properties are currently used for activities during Fashion Week and other
temporary uses throughout the year. The work was completed prior to Fashion Week, which
began March 21, 2011. The improvements enhance the aesthetics of the area and provide a
more positive image to the El Paseo shopping district.
The City's Public Works Department and Landscape Services Division have determined that the
work was satisfactorily completed. Therefore staff recommends that the City Clerk be authorized
to file a Notice of Completion with the County Recorder for the subject contract.
Fiscal Analysis
Funds for this project came from Account Number 850-4388-433-4001. The property has
recently been conveyed to the City who currently will pay the cost to maintain the improvements
of approximately $6,500 per year from the General Fund until an interim or ultimate disposition
of the property is determined. The Agency will reimburse the City at various times throughout
the year as long as the intent for the properties remains to be developed for Agency purposes.

1. That the interest or estate stated in paragraph 3 herein in the real property herein described is
SOLELY OWNED by the CITY OF PALM DESERT, A MUNICIPAL CORPORATION, a political subdivision
of the State of California, and whose address is 73-510 FRED WARING DRIVE, PALM DESERT,
CALIFORNIA 92260.
2. That the full name and address of the owner of said interest or estate is set forth in the preceding
paragraph.
3. That the nature of the title of the stated owner, as set forth in paragraph 1, is in Fee.
4. That on the 12th day of May, 2011, a work of improvement described as Perimeter Landscape
Improvements at the Northeast Corner of Larkspur Lane and Shadow Mountain Drive, Contract No.
R30380, on the real property herein described was completed.

Inc., 38-207 N. Primrose Lane, Indio, CA 92203.
6. That the real property herein referred to is situated in the City of Palm Desert, County of Riverside,
State of California, and is described as APN 627-262-008 and APN 627-262-011. See Exhibit A — Legal
Description Attached.
