Approve a one-year extension to Contract No. C29530 with Merchants Landscape Services, Inc., for Landscape Maintenance Area No. 9 in the amount of $141,960; 2. Include repair work and services at the specified contract amount not to exceed 20 percent of contract amount or $28,392; and 3. Authorize the Mayor to execute the contract. Funds are available in the General Fund Account No. 110-4614-453-3370, Repair/Maintenance Medians. Background The subject contract was awarded by City Council to Merchants Landscape Services, Inc., (Merchants) of Palm Springs, California, on May 27, 2010. This contract area is Staff Report Approve One -Year Extension of Contract No. C29530 for LMA 9 May 12, 2011 Page 2 of 2 comprised of El Paseo, the Civic Center, the Baja Park, Entrada del Paseo, and the San Jacinto and Santa Rosa Monument Visitor Center. The current agreement with Merchants is for a term of one year with an optional one- year extension. Merchants' performance has met City standards, and they have agreed to the one-year extension of contract commencing July 1, 2011, and expiring June 30, 2012, at the current contract price of $141,960 with no cost of living increase. C39530 FIRST AMENDMENT TO AGREEMENT WHEREAS, the City of Palm Desert ("City") and Sierra Landscape Company, Inc., ("Contractor"), entered into an agreement dated May 12, 2011, to provide landscape maintenance services for Landscape Maintenance Area No. 9 ("Agreement"). The parties wish to amend the Agreement effective July 1, 2011. NOW, THEREFORE, the parties agree as follows: A. Term is amended to add the following paragraph to the end of the existing section, as amended. "The term of this Agreement is extended, and shall include the time period from July 1, 2011, through June 30, 2012." B. All other terms and conditions of the Agreement shall remain unchanged, and shall remain in full force and effect.
