REQUEST: Award of Purchase Contract to Forms and Surfaces for
Trash/Recycle Receptacles for the Palm Desert Aquatic Center

RECOMMENDATION:
By Minute Motion,
1. Approve sole source purchase of trash/recycle receptacles;
2. Award purchase contract to Forms and Surfaces; and
3. Authorize the appropriation and expenditure of funds in the amount of
$35,527.50 from the Recycle Fund; Account No. 236-4195-454-3090.
DISCUSSION:
Staff has contacted Forms and Surfaces to determine a delivery date for trash/recycle
receptacles for the Palm Desert Aquatic Center. In order to obtain the receptacles by
the opening date of June 11, 2011, the containers must be ordered by Friday, May 13,
2011. With construction of the new aquatic center, an additional 20 containers are
needed for placement in and around the facility. Staff has determined that there is
$13,480 from City/County funds that will be utilized to offset the total cost of $35,527.50.
Therefore, the total balance to be applied to the Recycle Fund will be $22,047.50.
Important to note is that City Council, at its meeting of January 22, 2009, approved the
sole source purchase of combination trash/recycle receptacles to be consistent and
continue with the same containers throughout City facilities and parks except those
purchased for Freedom Park. The containers have now been placed within the Civic
Center Park, Palma Village Neighborhood Park, the Eric Johnson Gardens, and
elsewhere throughout the City.
Forms and Surfaces is the only company that manufactures the receptacles and
currently holds the copyrights to the design. Given the above, staff would like to sole
source the purchase of the receptacles for the aquatic center so that the containers are
consistent with those placed within City parks. The Special Programs Department has
worked with the Parks Department to determine if the existing receptacles should be
utilized. According to Parks staff, the existing containers will work quite well as they
require minimal maintenance, servicing is easier, they will save time and money, and

they are more manageable as opposed to having two separate containers. Staff has
compared the cost of the proposed receptacles to others of similar design and size and
has determined that although these containers are a little more expensive they are the
best option based on the above direction to stay consistent.
Staff recommends that City Council approve the sole source purchase of trash/recycle
receptacles to Forms and Surfaces, award contract, and appropriate funds in the
amount of $35,527.50 from Account No. 236-4195-454-3090.
