Recommendation
By Minute Motion, authorize the City Manager to execute the Public, Education
and Government (PEG) Channel agreement with Time Warner for the
broadcasting of the taped meetings.
Background
The PEG channel will be shared with the cities of Rancho Mirage, Indio, La Quinta and
Coachella. Staff will negotiate with Time Warner to find the most suitable time slot available for
the broadcast of the Council meetings. There is a cost of $25 per hour for Time Warner staff to
encode the meetings, which is directly equated to the length of the Council meeting. These
charges are deducted from our quarterly franchisee fee paid to the City by Time Warner Cable.
Fiscal Impact
Approving the PEG Channel agreement will cost $25 per hour for encoding time. This cost will
be deducted from our quarterly franchise fee payment.

AGREEMENT
This agreement made this day of , 2011, by and between the City of
Palm Desert (the "City") and Time Warner Entertainment-Advance/Newhouse Partnership
("Time Warner Cable").
Time Warner Cable agrees to manage the Public, Education and Governmental (PEG)
Access channel currently shared by the City of Palm Desert and the cities of Indio, La Quinta,
Coachella and Rancho Mirage.
In consideration for Time Warner Cable's agreement to perform the functions outlined
below, the City will reimburse Time Warner Cable for associated costs including the time
incurred for performing the referenced functions. Time Warner Cable will charge the City
$25.00 per hour, but said rate may be subject to change from time to time. Time Warner Cable
will remit an itemized statement to the City for the services rendered on a monthly basis and will
deduct the cost of managing the PEG Access channel from the quarterly franchise fee payment
remitted to the City. This agreement may be terminated by either party upon thirty (30) days
written notice to the other party:

Functions to be performed by Time Warner Cable
(a) Time Warner Cable will encode all content received in Beta-SP, Mini -DV tape or
DVD format from the City of Palm Desert, educational institutions and public access producers
resident in the City.
(b) Time Warner Cable will insert and play back the above -referenced content on the
PEG Access Channel in accordance with a mutually agreed upon schedule, insofar as
reasonably possible.
(c) Time Warner Cable will update community bulletin boards with City and/or
community events and announcements.
Notwithstanding anything to the contrary contained herein, the City reserves the right to
exercise editorial control over any public access content to be put on the PEG Access channel.
