Recommendation
By minute motion, that the City Council approve a permit to close streets
and sidewalks owned by the City on El Paseo located between Highway
74 and Ocotillo Drive, and to allow the consumption of alcoholic
beverages within this area.
Background
Pursuant to Palm Desert Municipal Code 9.58.040, the City Council must grant
permission to allow the consumption of alcoholic beverages on city -owned property. It is
also a policy that City Council review any street closure requests, which is requested as
a part of this application.
Chartwell Properties (formally Churchill Management) completed an application for a
Temporary Use Permit to hold the fundraising event Behind a Miracle on the evening of
November 19, 2011, from 5:00 p.m. to 8:00 p.m. The event is by invitation only with
approximately 400 or more guests expected to attend. It will include a cocktail reception,
a temporary faux -ice rink, served food, a choir, entertainers, and the installation of the
Christmas tree on top of the Gucci store. The sidewalks and streets will be closed and
barricaded between Highway 74 and Ocotillo drive. An encroachment permit has been
reviewed by the Public Works Department for these lane closures and is approvable
upon receipt of City Council direction and/or approval of the event.

Last year, a similar event was held that closed one lane of traffic on El Paseo in both
directions immediately adjacent to the sidewalk on the same block. Staff is not aware of
any complaints received regarding the event last year. The event on December 4, 2010,
was specifically conditioned such that all alcoholic consumption was to occur inside the
gated event area only, not to serve minors, and to provide security to ensure that no
one would leave the gated area with an alcoholic drink in hand. The same conditions
will apply to the event this year.
Fiscal Analysis
There is no direct fiscal impact associated with the approval of this request. The City
will receive nominal sales tax revenue generated from this event, which encourages
attendees to make purchases from The Shops on El Paseo, from which a portion of the
proceeds will be donated to the charity -the Luci Curci Cancer Center at Eisenhower.

A MIRACLE ON EL PASEO benefitting BIGHORN "Behind a Miracle"
The Shops on El Paseo will partner again with BIGHORN "Behind a Miracle" (BAM) to kick off the Holiday
season with "A MIRACLE ON EL PASEO" on Saturday, November 19, 2011 to raise dollars for the Luci Cerc
Cancer Center at Eisenhower and to launch the Holiday Season in the Coachella Valley. The event for approx.
400 plus guests will be held from 5pm — 8pm on the street, sidewalks and inside the stores along El Paseo,
between Monterey/Hwy 74 and Ocotillo as well as sidewalks along the first five stores east of Ocotillo from the
former BCBG store to Rangoni Shoes. To facilitate the event set up, we request the following street closure:
Saturday, November 19`h from 7.30 am — midnight
73061 El Paseo Hwy 74/ Monterey to Ocotillo south curb lane and #2 traffic on Eastbound El Paseo
73040-73080 El Paseo Hwy 74/ Monterey to Ocotillo curb lane and #2 traffic on Westbound El Paseo
Westbound El Paseo curb lane from Chicos #73100 to Ocotillo
(please note the above is identical closure to the December 4`h, 2010 BAMfundraising event)
An additional for 2011, to accommodate media coverage and a mini -ice skating rink we request:
Saturday, November 19'° from 4.30 om — midnight
73061 El Paseo Hwy 74/ Monterey to Ocotillo full closure Eastbound and Westbound, #1 traffic lane
• We will have k-rail barrier capping the streets on curb and #2 lanes from 7:30am
• We wil I provide orange cone barrier between #2 and # 1 lanes from 7:30 am — 4:30pm.
• At 4:30, full Road Closure signs operational and orange cones moved from between lanes to create
additional East West barrier next to K-rail.
• OPTION: if city recommends additional k-rail to be installed at both ends of Eastbound # 1 lane, we
can also facilitate such.
• The #1 lane Westbound will remain free from any structure, for emergency fire lane access.
Our intent is to utilize Tops N Barricades professional closure services to provide safety k-rail, cones, re-
directing signage to facilitate traffic control and public safety.
To facilitate an ease of traffic flow during the full Eastbound closure request the following directional detour
signage is suggested:
• STREET CLOSED SIGNS: at East and West Ends of relevant block of El Paseo at 4:30 pm
• STREET CLOSED AHEAD: East of Sage on El Paseo
• DETOUR, Turn Left: to Ocotillo - while heading West on El Paseo
• DETOUR, Turn Left: to Tumbleweed while heading South on Ocotillo
• DETOUR, Turn Left: to Sage, while heading North on Tumbleweed
• Which bnngs the driver back to El Paseo with an option of remaining northbound on Sage or turning
Right (Eastbound) on El Paseo.
