Wohlmuth, City Manager DATE: April 26, 2012 CONTENTS: (1) Letter dated March 29, 2012 from Children's Discovery Museum President Scott Wilson addressed to the Cove Communities Services Commission (2) Cove Communities Service Commission MOU dated 12-17-1990 Recommendation By Minute Motion, that the City Council provide direction on whether to support the proposed name change of the Children's Discovery Museum of the Desert. Background The current official name of the Children's Discovery Museum of the Desert is "Cove Communities/Anita B. Richmond Children Is Discovery Museum of the Desert". The Museum's President, Scott Wilson, has requested the Cove Communities Services Commission's consent to change the name of the Museum to "Betty Barker/Anita B. Richmond Children's Discovery Museum of the Desert". Mr. Wilson indicates that the Museum's Board has found it fitting to bestow this honor to Ms. Barker for being a founder and champion of the Museum, and for all her past twenty-five years of support and dedicated volunteer work given to the Museum. Per the Cove Commission's Memorandum of Understanding and joint funding, the Museum promised to provide an appropriate identification to recognize the joint efforts of the Cove Communities. Mr. Scott stated that the Museum will continue to prominently display the names of Rancho Mirage, Palm Desert, and Indian Wells in the lobby of the Museum on the Tower of Support. Richmond Children's Discovery Museum of the Desert 71-701 Gerald Ford Drive, Rancho Mirage, California 92270 Telephone: (760)3210602 Fax: (760) 321 1605 EXHBfT B 1-Y7 MEMORANDUM OF UNDERSTANDING CITY OF INDIAN WELLS ' CITY OF PALM DESERT • CITY OF RANCHO MIRAGE Whereas, the Cities of Indian Wells, Palm Desert and Rancho Mirage have enjoyed a history of mutual cooperation and success in many programs; and Whereas, the executive committee of the Cove Communities Public Safety Commission has di- rected an effort to resolve the issue of equitable distribution of funding for fire and paramedic services; and Whereas, the city managers from Indian Wells, Palm Desert and Rancho Mirage, together with elected officials from these communities, have worked together to develop a funding formula that equitably distributes costs of operating the Cove Communities Public Safety Commission - fire and paramedic services; and Whereas, many programs of regional benefit are being considered by the Cities of Indian Wells, Palm Desert and Rancho Mirage; and Whereas, all jurisdictions are desirous of working together for the benefit of our combined constituency. Now, therefore, be it resolved that the Cities of Indian Wells, Palm Desert and Rancho Mirage agree to the following: I. Sports Complex (Cook Street) - Palm Desert has spent $916,000 to date on the Cook Street Sports Complex and Facility. The $916,000 shall be limited to the actual out-of-pocket expenses for consultant fees dt construction costs but not to include City of Palm Desert staff time or general overhead. The parties agree that Indian Wells and Rancho Mirage will reimburse Palm Desert for 1 /2 of this outlay, based on a 50% population and 50% assessed value formula which is: a) Indian Wells 14.735% b) Palm Desert 53.485% c) Rancho Mirage 31.730% Total 100.000% Based on the above formula, Indian Wells and Rancho Mirage will pay the following amounts pursuant to the trust fund section of this Memorandum of Understanding. This facility will be available to Indian Wells and Rancho Mirage residents to the degree that the school district allows Palm Desert residents. a) Indian Wells $67,715 b) Rancho Mirage 145,323 $213,039 2. Sports Complex (New) - The new Cove Communities Sports Complex will consist of four baseball fields (estimated to cost $l million). Costs may increase when final plans are completed. Based on initial estimates, a maximum of $1 million will be contributed by the Cities as follows: a) Indian Wells (14.785%) $ 147,850 b) Palm Desert (53.485%) 534,850 c) Rancho Mirage (31.730%) 317,300 Total S 11000,000 3. YMCA Building - The Cove Communities YMCA has a contract for construction of the facility for $1,608,000. Based on the population and assessed value formula, the contribu- tion from the Cities will be as follows: a) Indian Wells (14.785%) S 237,743 b) Palm Desert (53.485%) 860,039 c) Rancho Mirage (31.730%) 510,218 Total S 1,608,000 For purposes of financing, the City of Palm Desert shall provide the cash payments for completion of the YMCA building. The City of Palm Desert shall place in trust (identified in Paragraph 5) the Indian Wells' contribution of $237,743 toward the YMCA into the Children's Museum Trust, outlined in Paragraph S. 4. Children's Museum - A Children's Museum is proposed for construction in Rancho Mirage. The City has agreed to dedicate and/or lease the Ind for the facility. The first phase of this project is estimated to cost $3 million. The Cities of Indian Wells, Palm Desert and Rancho Mirage agree to make $1,608,000 contribution to this facility, the equivalent con- tribution for the YMCA Building outlined above, subject to the following condition: a) The Children's Museum must raise $1.4 million in private funds prior to the Cities' contribution of $1,608,000, thereby insuring that the first phase of the project would be constructed prior to the Cities giving any commitment or transferring any money. S. Payment by Cities (Trust Funds) - Upon execution of the final agreements among the three cities, all funds remaining due for the above identified projects, shall be placed in separate interest bearing trust accounts, administered by the Cove Community Public Safety Com- mission, and released with construction progress payments unless otherwise specified. a) The cost of the existing Cook Street Sports Facility shall be funded in accordance with Paragraph 1, and released upon completion of the new Sports Complex. b) Funding for the new Sports Complex shall be in accordance with Paragraph 2. W c) Using the same percentages established in Paragraphs 1, 2, and 3, the City of Indian Wells shall place funds on deposit towards the Children's Museum $237,743, Palm Desert shall deposit the Indian Wells' YMCA contribution of $237,743 and an additional $112,078, and Rancho Mirage shall deposit both its YMCA contribution of $510,218 and Children's Museum contribution of $510,218, for a total of $1,020,436. d) In the event the Children's Museum is not funded within five years, the City of Indian Wells Funds will receive back its $237,743, plus interest, and Palm Desert shall be refunded its $237,743, Indian Wells' YMCA contribution, and it's $112,078 Children Museum Contribution, plus interest. 6. Fire Tax Formula - Indian Wells, Palm Desert and Rancho Mirage entered into an agree- ment with Riverside County that provides for the collection and crediting of fire taxes. Currently, the first SI million generated is 100% returned to the Cove Communities Public Safety Commission. Additional funds generated are credited at a rate of 70% off the bill sent to us by the County. When last estimated, the County diverts approximately $500,000 annually from the Cove Communities. The Cities of Indian Wells, Palm Desert and Rancho Mirage hereby agree to use all avail- able means necessary to increase the 70% credit to a minimum 90% credit. This entails the complete and unequivocal commitment from staff and the elected officials to work with Riverside County to expeditiously accomplish this purpose. Palm Desert shall be the lead agency in negotiations with Riverside County. These negotiations shall commence immedi- ately and conclude prior to April 1, 1991, so that they may be included in the Riverside County Fire Department budget for FY 1991/92, commencing July 1, 1991. 7. Other Facilities: a) The parties agree to continue to work together to discuss the construction of future regional public facilities. b) The Cities agree to work together to discuss the possible coordination of library ser- vices. The Cities agree to work together to study the future needs of our residents and alternatives for construction, administration and operations. I. General Activities; a) The Cities shall work to achieve a formula for ongoing maintenance of both sports facilities (Cook Street & New) that will include the following: - Coachella Valley Parks and Recreation District % - School Districts % - User Groups % b) Contributions of capital funds by the Cities, to projects developed under this MOU, will establish entitlements to continued use of the facilities even if a City withdraws from the program. c) The Cities agree there will be an appropriate identification of facilities which reflects the joint effort and source of funding developed in order to construct the facility. d) This Memorandum of Understanding (MOU) is intended to set forth a framework by which all the cities can agree regarding the above -referenced facilities. The necessary legal documentation to establish the legal entities and mechanisms to effectuate this MOU shall be developed upon the execution of the MOU. Signed Richard Oliphant, Mayor . The structural fire tax credit beginning Fiscal Year 1990/91 shall be frozen in ratio to the Fiscal Year 1989/90 and credited based on bow it is earned in each member City based on assessed value in accordance with attached Exhibit A. Each member City agrees to work cooperatively in an effort to retain a larger local share of Structural Fut Tax collected by the County of Riverside. The current goal is to reduce the current 30% formula to at least 10%. 4. Palm Desert has given notice of that City's intent to withdraw from the Joint Powers Authority effecdve July 1,1991. In the event negotiations are successfully concluded on fair sharing of coats for regional facilities prior to said dates, said City may rescind such intent and withdrawal.
