Recommendation
By Minute Motion:
1. Approve Change Order No. 1 to Contract No. C23110A in the amount
of $3,975 and extend the contract time frame by 13 days with no
penalty assessed against the contractor;
2. Authorize the Mayor to execute said Change Order No. 1; and
3. Accept the work as complete and authorize the City Clerk to file a
Notice of Completion for Contract No. 23110A.
Funds are available in Measure "A" Account No. 213-4362-433-4001, Highway 111
Improvements.
Background
On December 8, 2011, City Council awarded Contract No. C23110A in the amount of $526,805
to B & T Works, Inc., of Wildomar, California, for the Highway 111 Sidewalk Improvement
Project. The project removed a deep cross gutter depression at Plaza Way, created a dual left -
turn pocket at Plaza Way, constructed a bus bay east of San Pablo, and constructed sidewalk to
provide contiguous sidewalk throughout Palm Desert along Highway 111.
Prior to the construction of the bus bay at San Pablo, Public Works was alerted to the fact that
the construction of the bus bay would leave only a six-inch curb between the traffic on Highway
111 and the parking lot for the Jensen's Shopping Center. For the majority of Highway 111

there is a landscaped berm or a large parkway that puts some protection between the vehicles
on the highway and the commercial parking lots. It was determined that a wall would act as a
small barrier, providing some measure of safety and improving aesthetics.
The contractor provided a cost proposal in the amount of $7,760 to construct the wall. Staff
reviewed the proposal and, upon the recommendation of Public Works, the City Manger
approved the extra work. The City Manager has authority to approve change orders up to
$20,000.
Additionally, the City received a credit for removing traffic signal loops from the project.
According to the plans, the loops were to be installed in Highway 111 at Plaza Way. However,
because the Highway will be resurfaced this summer, the loops will be replaced as part of that
project, saving the City $3,785.
Finally, prior to the commencement of work on the first phase of this project, the City began
reviewing the insurance requirements for Capital Improvement Projects. Unfortunately the
Notice to Proceed had already been issued, starting the clock on the contract days. The
insurance issue was settled 13 days later, changing the actual date that the City allowed the
contractor to commence work from January 18, 2012, to January 31, 2012. As part of Change
Order No. 1, the contract time frame is extended by 13 days to March 1, 2012, with no penalty
assessed against the contractor.
Staff has inspected the work performed by the contractor and has found said work to be
complete and in accordance with the contract requirements. The work was completed on time,
and under the contract amount.
Fiscal Analysis
The initial contract amount was $526,805. This change order will increase the contract amount
by $3,975 to $530,780. The sidewalk improvements and bus bay construction are not expected
to require a significant amount of maintenance. Therefore, the fiscal impact of the
improvements is negligible.

This Change Order covers changes to the subject contract as described herein. The Contractor shall construct, furnish
equipment and materials, and perform all work as necessary or required to complete the Change Order items for a
lump sum price agreed upon between the Contractor and the City of Palm Desert, otherwise referred to as Owner.
Contract Time Extension 13 Days.
Revised Contract Total $530,780.00
The undersigned Contractor approves the foregoing Change Order # 1 as to the changes, if any, in the contract
price specified for each item including any and all supervision costs and other miscellaneous costs relating to the
change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said
Change Order # 1 . The Contractor agrees to furnish all labor and materials and perform all other necessary work,
inclusive of that directly or indirectly related to the approved time extension, required to complete the Change Order
items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood
that the Change Order shall be effective when approved by the Owner.
Execution of this Change Order by the Contractor constitutes a binding accord and satisfaction that fully satisfies,
waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity, arising out of
or related to the subject of the Change Order, whether known or unknown, including but not limited to direct and
indirect costs and/or damages for delay, disruption, acceleration, loss of productivity, and stacking of trades, as well as
any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included above
must have required signatures as per the purchase resolution.
