Recommendation
By Minute Motion:
1. Ratify Change Order No. 1 to Contract No. C23480A with DBX Inc.,
for the Traffic Signal Modification Fred Waring Drive at San Pascual
Project the amount of $11,895.10 (Project No. 566-05);
2. Move $11,895.10 from contingency to base; and
3. Accept the work as complete and authorize the City Clerk to file the
Notice of Completion for Contract C23480A.
Funding is available for this change order in Account No. 234-4276-422-4001, Traffic
Signal Public Safety.

Background
On June 14, 2012, City Council awarded Contract No. C23480A to DBX, Inc., of
Temecula, California in the amount of $ 159,093.00, and set aside a 10 percent
contingency. This project was to modify the pedestrian crossing at the intersection to a
fully functional six -phase traffic signal. Curb modifications were not originally a part of
this project. Due to changes in the ADA regulations the curb ramp modifications were
required. To avoid project delay, staff request authorization from the City Manager to
proceed with the modifications. The cost of the curb modifications was $6,750.00. The
approved memorandum is attached for your reference.
During the course of construction the contractor encountered unforeseen utility conflicts
with the placement of the traffic signal pole on the southeast corner of the intersection.
The conflicts required additional investigation to find a suitable location for the pole. To
avoid costly delays and public inconvenience this work was done on a time and material
basis. The total cost incurred for this conflict was $5,145.10.
The project is now complete. Staff has inspected the work performed by the contractor
and has found said work to be in accordance with the contract requirements.
Fiscal Analysis
This improvement project is partially funded by a Highway Safety Improvement Program
grant, in the amount of $143,183.70. The remainder of the project is funded by the
Traffic Signal Public Safety fund. Funds are available in account 234-4276-422-4001 for
the balance of the contract and the contract change order.

JUSTIFICATION:
The project did not originally include curb ramp modifications. Due to changes in ADA regulations the modifications
were required as a part of this project. Unforeseen utility conflicts made the installation of the traffic signal pole as
designed impossible. A new location in keeping with the requirements of.the signal design and current conditions
was necessary.

This Change Order covers changes to the subject contract as described herein. The Contractor shall construct,
furnish equipment and materials, and perform all work as necessary or required to complete the Change Order
items for a lump sum price agreed upon between the Contractor and the City of Palm Desert, otherwise referred to
as Owner.
Contract Time Extension 0 Days.
Revised Contract Total $170,988.10.
The undersigned Contractor approves the foregoing Change Order # 1 as to the changes, if any, in the contract
price specified for each item including any and all supervision costs and other miscellaneous costs relating to the
change in work, and as to the extension of time allowed, if any, for completion of the entire work on account of said
Change Order # 1. The Contractor agrees to furnish all labor and materials and perform all other necessary work,
inclusive of that directly or indirectly related to the approved time extension, required to complete the Change Order
items. This document will become a supplement of the contract and all provisions will apply hereto. It is understood
that the Change Order shall be effective when approved by the Owner.
Execution of this Change Order by the Contractor constitutes a binding accord and satisfaction that fully satisfies,
waives, and releases the Owner from all claims, demands, costs, and liabilities, in contract, law or equity, arising
out of or related to the subject of the Change Order, whether known or unknown, including but not limited to direct
and indirect costs and/or damages for delay, disruption, acceleration, loss of productivity, and stacking of trades, as
well as any and all consequential damages.
This document will become a supplement to the Contract and all provisions will apply hereto, all items included
above must have required signatures as per the purchase resolution.

Subject: Fred Waring Drive at San Pascual Traffic Signal Modification-566-05
The Fred Waring Drive at San Pascual Traffic Signal Modification project is currently under
construction. This project will modify the current pedestrian crossing to a fully functional six -
phase traffic signal. Curb ramp modifications were not originally a part of this project. Due
to changes in the ADA regulations these ramp modifications must now be addressed.
Staff requested a quote from the contractor, DBX, Inc., to bring all four ramps into ADA
compliance. The ramp at the southwest comer of Fred Waring Drive and San Pascual
will require 30 linear feet of removal and reconstruction. The other three ramps require
the installation of truncated domes. The price for the ramp reconstruction is $4,500.00.
The installation of truncated domes is $750.00 per ramp. The total for the additional
work is $6,750.00. A copy of the quote is attached for your reference.
Staff has found this price to be reasonable and is requesting your authorization to proceed
with the work.
While this project is largely funded through a federal CMAQ grant, this cost will not be
recoverable. Funds are available in account number 234-4276-422-4001 for this work.
I will prepare a formal Change Order for approval by the City Council.
